8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 1001.056, Occupations Code, is amended | |
10 | 10 | by adding Subsection (c) to read as follows: | |
11 | 11 | (c) The exemption provided by this section does not apply to | |
12 | 12 | a person or entity that is: | |
13 | 13 | (1) providing services necessary to comply with | |
14 | 14 | windstorm certification standards for a residential dwelling; or | |
15 | 15 | (2) constructing, enlarging, altering, or repairing, | |
16 | 16 | or drawing plans or specifications for, a residential dwelling slab | |
17 | 17 | located on soil with a plasticity index of greater than 30, | |
18 | 18 | determined in accordance with ASTM International standard D4318-05 | |
19 | 19 | (Standard Test Methods for Liquid Limit, Plastic Limit, and | |
20 | 20 | Plasticity Index of Soils) as that standard was in effect on January | |
21 | 21 | 1, 2009. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
