| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter I, Chapter 504, Transportation Code, | |
| 11 | 11 | is amended by adding Section 504.802 to read as follows: | |
| 12 | 12 | Sec. 504.802. CERTAIN LICENSE PLATES CREATED BY DEPARTMENT. | |
| 13 | 13 | (a) If the department has created a specialty license plate under | |
| 14 | 14 | Section 504.801 for professional firefighters, the department | |
| 15 | 15 | shall allow the sponsor of the license plate to nominate a state | |
| 16 | 16 | agency for receipt of funds under Section 504.801(b) at any time | |
| 17 | 17 | after the creation of the license plate. | |
| 18 | 18 | (b) Funds received by a state agency under this section | |
| 19 | 19 | shall be used in making grants to support the activities of an | |
| 20 | 20 | organization of professional firefighters located in this state | |
| 21 | 21 | that provides emergency relief and college scholarship funds to | |
| 22 | 22 | professional firefighters and dependents. | |
| 23 | 23 | SECTION 2. This Act takes effect immediately if it receives | |
| 24 | 24 | a vote of two-thirds of all the members elected to each house, as | |
| 25 | 25 | provided by Section 39, Article III, Texas Constitution. If this | |
| 26 | 26 | Act does not receive the vote necessary for immediate effect, this | |
| 27 | 27 | Act takes effect September 1, 2009. |
