66 AN ACT
77 relating to the operation in certain counties of an integrated care
88 management model under the Medicaid managed care program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 533, Government Code, is
1111 amended by adding Section 533.064 to read as follows:
1212 Sec. 533.064. IMPLEMENTATION OF INTEGRATED CARE MANAGEMENT
1313 MODEL IN CERTAIN COUNTIES. Notwithstanding Section 533.062, the
1414 commission may not contract with an administrative services
1515 organization to perform the coordination of care and other services
1616 and functions of the integrated care management model developed
1717 under Section 533.061, and may not otherwise implement the model,
1818 in the Dallas or Tarrant Medicaid service area, as those areas
1919 existed on January 1, 2009.
2020 SECTION 2. (a) To the extent permitted by law or the terms
2121 of the contract, the Health and Human Services Commission shall
2222 terminate a contract entered into before the effective date of this
2323 Act with an administrative services organization to perform
2424 services and functions described by Section 533.062, Government
2525 Code, in the Dallas or Tarrant Medicaid service area.
2626 (b) On and after the effective date of this Act, the Health
2727 and Human Services Commission may not enter into or renew a contract
2828 with an administrative services organization to perform services
2929 and functions described by Section 533.062, Government Code, in the
3030 Dallas or Tarrant Medicaid service area.
3131 SECTION 3. If before implementing any provision of this Act
3232 a state agency determines that a waiver or authorization from a
3333 federal agency is necessary for implementation of that provision,
3434 the agency affected by the provision shall request the waiver or
3535 authorization and may delay implementing that provision until the
3636 waiver or authorization is granted.
3737 SECTION 4. This Act takes effect immediately if it receives
3838 a vote of two-thirds of all the members elected to each house, as
3939 provided by Section 39, Article III, Texas Constitution. If this
4040 Act does not receive the vote necessary for immediate effect, this
4141 Act takes effect September 1, 2009.
