| 7 | 7 | | relating to the operation in certain counties of an integrated care |

| 8 | 8 | | management model under the Medicaid managed care program. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 533, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 533.064 to read as follows: |
|---|
| 12 | 12 | | Sec. 533.064. IMPLEMENTATION OF INTEGRATED CARE MANAGEMENT |
|---|
| 13 | 13 | | MODEL IN CERTAIN COUNTIES. Notwithstanding Section 533.062, the |
|---|
| 14 | 14 | | commission may not contract with an administrative services |
|---|
| 15 | 15 | | organization to perform the coordination of care and other services |
|---|
| 16 | 16 | | and functions of the integrated care management model developed |
|---|
| 17 | 17 | | under Section 533.061, and may not otherwise implement the model, |
|---|
| 18 | 18 | | in the Dallas or Tarrant Medicaid service area, as those areas |
|---|
| 19 | 19 | | existed on January 1, 2009. |
|---|
| 20 | 20 | | SECTION 2. (a) To the extent permitted by law or the terms |
|---|
| 21 | 21 | | of the contract, the Health and Human Services Commission shall |
|---|
| 22 | 22 | | terminate a contract entered into before the effective date of this |
|---|
| 23 | 23 | | Act with an administrative services organization to perform |
|---|
| 24 | 24 | | services and functions described by Section 533.062, Government |
|---|
| 25 | 25 | | Code, in the Dallas or Tarrant Medicaid service area. |
|---|
| 26 | 26 | | (b) On and after the effective date of this Act, the Health |
|---|
| 27 | 27 | | and Human Services Commission may not enter into or renew a contract |
|---|
| 28 | 28 | | with an administrative services organization to perform services |
|---|
| 29 | 29 | | and functions described by Section 533.062, Government Code, in the |
|---|
| 30 | 30 | | Dallas or Tarrant Medicaid service area. |
|---|
| 31 | 31 | | SECTION 3. If before implementing any provision of this Act |
|---|
| 32 | 32 | | a state agency determines that a waiver or authorization from a |
|---|
| 33 | 33 | | federal agency is necessary for implementation of that provision, |
|---|
| 34 | 34 | | the agency affected by the provision shall request the waiver or |
|---|
| 35 | 35 | | authorization and may delay implementing that provision until the |
|---|
| 36 | 36 | | waiver or authorization is granted. |
|---|
| 37 | 37 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 38 | 38 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 39 | 39 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 40 | 40 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 41 | 41 | | Act takes effect September 1, 2009. |
