66 AN ACT
77 relating to availability of professional liability insurance under
88 a self-insurance trust for health care.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 2212.054, Insurance Code,
1111 is amended to read as follows:
1212 Sec. 2212.054. POWERS AND DUTIES OF TRUST.
1313 SECTION 2. Section 2212.054(a), Insurance Code, is amended
1414 to read as follows:
1515 (a) A trust may:
1616 (1) purchase, on behalf of the members of the
1717 association that created the trust or other members who are
1818 licensed to practice medicine or dentistry in this state, [medical]
1919 professional liability insurance, specific excess insurance,
2020 aggregate excess insurance, and reinsurance, as necessary in the
2121 opinion of the trustees;
2222 (2) purchase required risk management services; and
2323 (3) pay claims that arise under any deductible
2424 provisions.
2525 SECTION 3. Section 2212.054, Insurance Code, is amended by
2626 adding Subsection (c) to read as follows:
2727 (c) A trust may not make membership in the association that
2828 created the trust a condition of issuing a contract for
2929 professional liability insurance or other insurance to a person
3030 licensed to practice medicine or dentistry in this state.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
