66 AN ACT
77 relating to the confidentiality of newborn screening information.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter B, Chapter 33, Health and Safety
1010 Code, is amended by adding Section 33.017 to read as follows:
1111 Sec. 33.017. CONFIDENTIALITY. (a) Reports, records, and
1212 information obtained or developed by the department under this
1313 chapter are confidential and are not subject to disclosure under
1414 Chapter 552, Government Code, are not subject to subpoena, and may
1515 not otherwise be released or made public except as provided by this
1616 section.
1717 (b) Notwithstanding other law, reports, records, and
1818 information obtained or developed by the department under this
1919 chapter may be disclosed:
2020 (1) for purposes of diagnosis or follow-up authorized
2121 under Section 33.014;
2222 (2) with the consent of each identified individual or
2323 an individual authorized to consent on behalf of an identified
2424 child;
2525 (3) as authorized by court order;
2626 (4) to a medical examiner authorized to conduct an
2727 autopsy on a child or an inquest on the death of a child; or
2828 (5) to public health programs of the department for
2929 public health research purposes provided that the disclosure is
3030 approved by an institutional review board or privacy board of the
3131 department as authorized by the federal privacy requirements
3232 adopted under the Health Insurance Portability and Accountability
3333 Act of 1996 (Pub. L. No. 104-191) contained in 45 C.F.R. Part 160
3434 and 45 C.F.R. Part 164, Subparts A and E.
3535 (c) Notwithstanding other law, reports, records, and
3636 information that do not identify a child or the family of a child
3737 may be released without consent if the disclosure is for:
3838 (1) statistical purposes;
3939 (2) purposes related to obtaining or maintaining
4040 certification, approval, or quality assurance for the department's
4141 laboratory or a public or private laboratory to perform newborn
4242 screening tests;
4343 (3) purposes relating to review, quality assurance, or
4444 improvement of the department's newborn screening under this
4545 subchapter or the department's newborn screening program services
4646 under Subchapter C;
4747 (4) research purposes, provided that the disclosure is
4848 approved by an institutional review board or privacy board of the
4949 department; or
5050 (5) quality assurance related to equipment and
5151 supplies, provided that:
5252 (A) the assessment is performed by a person who
5353 is not a laboratory;
5454 (B) only newborn screening specimens are
5555 disclosed; and
5656 (C) the disclosure is approved by an
5757 institutional review board or privacy board of the department.
5858 (d) A state officer or employee, a department contractor, or
5959 a department contractor's employee, officer, director, or
6060 subcontractor may not be examined in a civil, criminal, special, or
6161 other judicial or administrative proceeding as to the existence or
6262 contents of records, reports, or information made confidential by
6363 this section unless disclosure is authorized by this section.
6464 SECTION 2. This Act takes effect immediately if it receives
6565 a vote of two-thirds of all the members elected to each house, as
6666 provided by Section 39, Article III, Texas Constitution. If this
6767 Act does not receive the vote necessary for immediate effect, this
6868 Act takes effect September 1, 2009.
