66 AN ACT
77 relating to the dispensing of drugs by physicians.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 158.001(b), Occupations Code, is amended
1010 to read as follows:
1111 (b) A physician may dispense dangerous drugs and controlled
1212 substances to the physician's patients and charge the patients for
1313 the drugs [This section does not permit a physician to operate a
1414 retail pharmacy] without complying with Chapter 558.
1515 SECTION 2. Section 551.004(b), Occupations Code, is amended
1616 to read as follows:
1717 (b) This subtitle does not prevent a practitioner from:
1818 (1) administering a drug to a patient of the
1919 practitioner; or
2020 (2) supplying drugs to a patient as provided by
2121 Section 158.001(b).
2222 SECTION 3. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
