6	6	AN ACT
7	7	relating to the powers and duties of the Hopkins County Hospital
8	8	District.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 1043.052, Special District Local Laws
11	11	Code, as effective April 1, 2009, is amended to read as follows:
12	12	Sec. 1043.052. NOTICE OF ELECTION. Notice [At least 10
13	13	days before the date] of an election of directors [, notice of the
14	14	election] shall be published [one time] in a newspaper of general
15	15	circulation in the district in accordance with Section 4.003,
16	16	Election Code [Hopkins County].
17	17	SECTION 2. Section 1043.059(d), Special District Local Laws
18	18	Code, as effective April 1, 2009, is amended to read as follows:
19	19	(d) Subject to Subsection (e), the board may provide
20	20	financial inducements [, including income subsidies or guarantees
21	21	and reimbursement of relocation expenses,] to a full-time medical
22	22	intern or [resident] physician [serving in a hospital] who
23	23	contractually agrees to:
24	24	(1) reside and practice in Hopkins County; and
25	25	(2) provide care and treatment to its needy residents.
26	26	SECTION 3. Section 1043.108, Special District Local Laws
27	27	Code, as effective April 1, 2009, is amended to read as follows:
28	28	Sec. 1043.108. PROPERTY, FACILITIES, AND EQUIPMENT FOR
29	29	HEALTH CARE PROVIDERS [STAFF PHYSICIANS]. (a) The board shall
30	30	determine the type, number, and location of buildings required to
31	31	establish and maintain office facilities for health care providers
32	32	[staff physicians] as necessary to provide adequate health
33	33	[medical] care services.
34	34	(b) The board may:
35	35	(1) acquire property, including equipment, and
36	36	construct facilities for the district for use by health care
37	37	providers [staff physicians]; and
38	38	(2) mortgage or pledge the property or facilities as
39	39	security for the payment of the purchase or construction price.
40	40	(c) The board for the district may:
41	41	(1) lease the office facilities and equipment to
42	42	health care providers [staff physicians]; and
43	43	(2) sell or otherwise dispose of the property,
44	44	including facilities and equipment.
45	45	SECTION 4. Section 1043.152(c), Special District Local Laws
46	46	Code, as effective April 1, 2009, is amended to read as follows:
47	47	(c) Any district resident [taxpayer] is entitled to:
48	48	(1) appear at the time and place designated in the
49	49	notice; and
50	50	(2) be heard regarding any item included in the
51	51	proposed budget.
52	52	SECTION 5. Section 1043.154(b), Special District Local Laws
53	53	Code, as effective April 1, 2009, is amended to read as follows:
54	54	(b) Not later than December 31 each year, the audit shall be
55	55	filed[:
56	56	[(1) with the comptroller; and
57	57	[(2)] at the district office.
58	58	SECTION 6. Section 1043.059(e), Special District Local Laws
59	59	Code, as effective April 1, 2009, is repealed.
60	60	SECTION 7. This Act takes effect immediately if it receives
61	61	a vote of two-thirds of all the members elected to each house, as
62	62	provided by Section 39, Article III, Texas Constitution. If this
63	63	Act does not receive the vote necessary for immediate effect, this
64	64	Act takes effect September 1, 2009.
