55 AN ACT
66 relating to excellence exemptions available to school districts.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Subchapter F, Chapter 39, Education Code, is
99 amended by amending Subsections (a) and (b) and adding Subsection
1010 (e) to read as follows:
1111 Sec. 39.112. EXCELLENCE EXEMPTIONS. (a) Except as
1212 provided by Subsection (b), a school campus or district that is
1313 rated exemplary is exempt from requirements and prohibitions
1414 imposed under this code including rules adopted under this code. An
1515 exemption under this section applies to the school year in which a
1616 school campus or district is rated exemplary and to the following
1717 school year.
1818 (b) A school campus or district is not exempt under this
1919 section from:
2020 (1) a prohibition on conduct that constitutes a
2121 criminal offense;
2222 (2) requirements imposed by federal law or rule,
2323 including requirements for special education or bilingual
2424 education programs; or
2525 (3) a requirement, restriction, or prohibition
2626 relating to:
2727 (A) curriculum essential knowledge and skills
2828 under Section 28.002 or minimum graduation requirements under
2929 Section 28.025;
3030 (B) public school accountability as provided by
3131 [Subchapters B, C, D, and G] this chapter;
3232 (C) extracurricular activities under Section
3333 33.081;
3434 (D) health and safety under Chapter 38;
3535 (E) competitive bidding under Subchapter B,
3636 Chapter 44;
3737 (F) elementary school class size limits, except
3838 as provided by Subsection (d) or Section 25.112;
3939 (G) removal of a [disruptive] student from the
4040 classroom under [Subchapter A,] Chapter 37;
4141 (H) at risk programs under Subchapter C, Chapter
4242 29;
4343 (I) prekindergarten programs under Subchapter E,
4444 Chapter 29;
4545 (J) rights and benefits of school employees;
4646 (K) special education programs under Subchapter
4747 A, Chapter 29; or
4848 (L) bilingual education programs under
4949 Subchapter B, Chapter 29.
5050 (M) Administrative hearings under Section 7.057
5151 and Subchapters F and G, Chapter 21;
5252 (N) Governance of a school district under Chapter
5353 11;
5454 (O) Creation, consolidation, annexation and
5555 boundary changes authorized under Chapter 13;
5656 (P) Admission of students under Section 25.001;
5757 excused student absences under Section 25.087; and truancy
5858 provisions under Sections 25.093, 29.094, 25.095, and 25.0951;
5959 (Q) School finance requirements and the Public
6060 Education Information Management System under Chapters 41, 42, and
6161 46; and
6262 (R) Parental Rights under Ch 26.
6363 (c) The agency shall monitor and evaluate deregulation of a
6464 school campus or district under this section and Section 7.056.
6565 (d) The commissioner may exempt an exemplary school campus
6666 from elementary class size limits under this section if the school
6767 campus submits to the commissioner a written plan showing steps
6868 that will be taken to ensure that the exemption from the class size
6969 limits will not be harmful to the academic achievement of the
7070 students on the school campus. The commissioner shall review
7171 achievement levels annually. The exemption remains in effect until
7272 the commissioner determines that achievement levels of the campus
7373 have declined.
7474 (e) Nothing in this section shall be construed to prohibit a
7575 school district from voluntarily complying with any provision of
7676 this title, nor from eligibility for any state or federal funds
7777 generally available to school districts, in accordance with
7878 eligibility requirements for such funding.
