44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to calculation of the net resources of a person ordered to
77 pay child support.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 154.062, Family Code, is amended by
1010 amending Subsection (d) and adding Subsection (f) to read as
1111 follows:
1212 (d) The court shall deduct the following items from
1313 resources to determine the net resources available for child
1414 support:
1515 (1) social security taxes;
1616 (2) federal income tax based on the tax rate for a
1717 single person claiming one personal exemption and the standard
1818 deduction;
1919 (3) state income tax;
2020 (4) union dues; [and]
2121 (5) expenses for the cost of health insurance or cash
2222 medical support for the obligor's child ordered by the court under
2323 Section 154.182; and
2424 (6) if the obligor does not pay social security taxes,
2525 nondiscretionary retirement plan contributions.
2626 (f) For purposes of Subsection (d)(6), a nondiscretionary
2727 retirement plan is a plan to which an employee is required to
2828 contribute as a condition of employment.
2929 SECTION 2. The change in law made by this Act applies only
3030 to a proceeding to establish or modify a child support obligation
3131 that is pending in a trial court on or filed on or after the
3232 effective date of this Act.
3333 SECTION 3. This Act takes effect September 1, 2009.
