66 AN ACT
77 relating to the creation of the Clearwater Ranch Municipal Utility
88 District No. 1; providing authority to impose a tax and issue bonds;
99 granting a limited power of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8353 to read as follows:
1313 CHAPTER 8353. CLEARWATER RANCH MUNICIPAL UTILITY DISTRICT NO. 1
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8353.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Clearwater Ranch Municipal
1919 Utility District No. 1.
2020 Sec. 8353.002. NATURE OF DISTRICT. The district is a
2121 municipal utility district created under Section 59, Article XVI,
2222 Texas Constitution.
2323 Sec. 8353.003. CONFIRMATION AND DIRECTORS' ELECTION
2424 REQUIRED. The temporary directors shall hold an election to
2525 confirm the creation of the district and to elect five permanent
2626 directors as provided by Section 49.102, Water Code.
2727 Sec. 8353.004. CONSENT OF MUNICIPALITY REQUIRED. The
2828 temporary directors may not hold an election under Section 8353.003
2929 until each municipality in whose corporate limits or
3030 extraterritorial jurisdiction the district is located has
3131 consented by ordinance or resolution to the creation of the
3232 district and to the inclusion of land in the district.
3333 Sec. 8353.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3434 The district is created to serve a public purpose and benefit.
3535 (b) The district is created to accomplish the purposes of:
3636 (1) a municipal utility district as provided by
3737 general law and Section 59, Article XVI, Texas Constitution; and
3838 (2) Section 52, Article III, Texas Constitution, that
3939 relate to the construction, acquisition, improvement, operation,
4040 or maintenance of macadamized, graveled, or paved roads, or
4141 improvements, including storm drainage, in aid of those roads.
4242 Sec. 8353.006. INITIAL DISTRICT TERRITORY. (a) The
4343 district is initially composed of the territory described by
4444 Section 2 of the Act creating this chapter.
4545 (b) The boundaries and field notes contained in Section 2 of
4646 the Act creating this chapter form a closure. A mistake made in the
4747 field notes or in copying the field notes in the legislative process
4848 does not affect the district's:
4949 (1) organization, existence, or validity;
5050 (2) right to issue any type of bond for the purposes
5151 for which the district is created or to pay the principal of and
5252 interest on a bond;
5353 (3) right to impose a tax; or
5454 (4) legality or operation.

5656 SUBCHAPTER B. BOARD OF DIRECTORS
5757 Sec. 8353.051. GOVERNING BODY; TERMS. (a) The district is
5858 governed by a board of five elected directors.
5959 (b) Except as provided by Section 8353.052, directors serve
6060 staggered four-year terms.
6161 Sec. 8353.052. TEMPORARY DIRECTORS. (a) On or after the
6262 effective date of the Act creating this chapter, the owner or owners
6363 of a majority of the assessed value of the real property in the
6464 district may submit a petition to the Texas Commission on
6565 Environmental Quality requesting that the commission appoint as
6666 temporary directors the five persons named in the petition. The
6767 commission shall appoint as temporary directors the five persons
6868 named in the petition.
6969 (b) Temporary directors serve until the earlier of:
7070 (1) the date permanent directors are elected under
7171 Section 8353.003; or
7272 (2) the fourth anniversary of the effective date of
7373 the Act creating this chapter.
7474 (c) If permanent directors have not been elected under
7575 Section 8353.003 and the terms of the temporary directors have
7676 expired, successor temporary directors shall be appointed or
7777 reappointed as provided by Subsection (d) to serve terms that
7878 expire on the earlier of:
7979 (1) the date permanent directors are elected under
8080 Section 8353.003; or
8181 (2) the fourth anniversary of the date of the
8282 appointment or reappointment.
8383 (d) If Subsection (c) applies, the owner or owners of a
8484 majority of the assessed value of the real property in the district
8585 may submit a petition to the Texas Commission on Environmental
8686 Quality requesting that the commission appoint as successor
8787 temporary directors the five persons named in the petition. The
8888 commission shall appoint as successor temporary directors the five
8989 persons named in the petition.

9191 SUBCHAPTER C. POWERS AND DUTIES
9292 Sec. 8353.101. GENERAL POWERS AND DUTIES. The district has
9393 the powers and duties necessary to accomplish the purposes for
9494 which the district is created.
9595 Sec. 8353.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9696 DUTIES. The district has the powers and duties provided by the
9797 general law of this state, including Chapters 49 and 54, Water Code,
9898 applicable to municipal utility districts created under Section 59,
9999 Article XVI, Texas Constitution.
100100 Sec. 8353.103. AUTHORITY FOR ROAD PROJECTS. Under Section
101101 52, Article III, Texas Constitution, the district may design,
102102 acquire, construct, finance, issue bonds for, improve, operate,
103103 maintain, and convey to this state, a county, or a municipality for
104104 operation and maintenance macadamized, graveled, or paved roads, or
105105 improvements, including storm drainage, in aid of those roads.
106106 Sec. 8353.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
107107 project must meet all applicable construction standards, zoning and
108108 subdivision requirements, and regulations of each municipality in
109109 whose corporate limits or extraterritorial jurisdiction the road
110110 project is located.
111111 (b) If a road project is not located in the corporate limits
112112 or extraterritorial jurisdiction of a municipality, the road
113113 project must meet all applicable construction standards,
114114 subdivision requirements, and regulations of each county in which
115115 the road project is located.
116116 (c) If the state will maintain and operate the road, the
117117 Texas Transportation Commission must approve the plans and
118118 specifications of the road project.
119119 Sec. 8353.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
120120 OR RESOLUTION. The district shall comply with all applicable
121121 requirements of any ordinance or resolution that is adopted under
122122 Section 54.016 or 54.0165, Water Code, and that consents to the
123123 creation of the district or to the inclusion of land in the
124124 district.
125125 Sec. 8353.106. LIMITATION ON USE OF EMINENT DOMAIN. The
126126 district may not exercise the power of eminent domain outside the
127127 district to acquire a site or easement for:
128128 (1) a road project authorized by Section 8353.103; or
129129 (2) a recreational facility as defined by Section
130130 49.462, Water Code.
131131 Sec. 8353.107. DIVISION OF DISTRICT. (a) The district may
132132 be divided into two or more new districts only if the district:
133133 (1) has no outstanding bonded debt; and
134134 (2) is not imposing ad valorem taxes.
135135 (b) This chapter applies to any new district created by the
136136 division of the district, and a new district has all the powers and
137137 duties of the district.
138138 (c) Any new district created by the division of the district
139139 may not, at the time the new district is created, contain any land
140140 outside the area described by Section 2 of the Act creating this
141141 chapter.
142142 (d) The board, on its own motion or on receipt of a petition
143143 signed by the owner or owners of a majority of the assessed value of
144144 the real property in the district, may adopt an order dividing the
145145 district.
146146 (e) The board may adopt an order dividing the district
147147 before or after the date the board holds an election under Section
148148 8353.003 to confirm the district's creation.
149149 (f) An order dividing the district shall:
150150 (1) name each new district;
151151 (2) include the metes and bounds description of the
152152 territory of each new district;
153153 (3) appoint temporary directors for each new district
154154 or provide that the owner or owners of a majority of the assessed
155155 value of the real property in each new district may submit a
156156 petition to the Texas Commission on Environmental Quality
157157 requesting that the commission appoint as temporary directors the
158158 five persons named in the petition; and
159159 (4) provide for the division of assets and liabilities
160160 between or among the new districts.
161161 (g) On or before the 30th day after the date of adoption of
162162 an order dividing the district, the district shall file the order
163163 with the Texas Commission on Environmental Quality and record the
164164 order in the real property records of each county in which the
165165 district is located.
166166 (h) Any new district created by the division of the district
167167 shall hold a confirmation and directors' election as required by
168168 Section 8353.003. A new district that is not confirmed is subject
169169 to dissolution under general law.
170170 (i) Municipal consent to the creation of the district and to
171171 the inclusion of land in the district granted under Section
172172 8353.004 acts as municipal consent to the creation of any new
173173 district created by the division of the district and to the
174174 inclusion of land in the new district.
175175 (j) Any new district created by the division of the district
176176 must hold an election as required by this chapter to obtain voter
177177 approval before the district may impose a maintenance tax or issue
178178 bonds payable wholly or partly from ad valorem taxes.

180180 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
181181 Sec. 8353.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
182182 district may issue, without an election, bonds and other
183183 obligations secured by:
184184 (1) revenue other than ad valorem taxes; or
185185 (2) contract payments described by Section 8353.153.
186186 (b) The district must hold an election in the manner
187187 provided by Chapters 49 and 54, Water Code, to obtain voter approval
188188 before the district may impose an ad valorem tax or issue bonds
189189 payable from ad valorem taxes.
190190 (c) The district may not issue bonds payable from ad valorem
191191 taxes to finance a road project unless the issuance is approved by a
192192 vote of a two-thirds majority of the district voters voting at an
193193 election held for that purpose.
194194 Sec. 8353.152. OPERATION AND MAINTENANCE TAX. (a) If
195195 authorized at an election held under Section 8353.151, the district
196196 may impose an operation and maintenance tax on taxable property in
197197 the district in accordance with Section 49.107, Water Code.
198198 (b) The board shall determine the tax rate. The rate may not
199199 exceed the rate approved at the election.
200200 Sec. 8353.153. CONTRACT TAXES. (a) In accordance with
201201 Section 49.108, Water Code, the district may impose a tax other than
202202 an operation and maintenance tax and use the revenue derived from
203203 the tax to make payments under a contract after the provisions of
204204 the contract have been approved by a majority of the district voters
205205 voting at an election held for that purpose.
206206 (b) A contract approved by the district voters may contain a
207207 provision stating that the contract may be modified or amended by
208208 the board without further voter approval.

210210 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
211211 Sec. 8353.201. AUTHORITY TO ISSUE BONDS AND OTHER
212212 OBLIGATIONS. The district may issue bonds or other obligations
213213 payable wholly or partly from ad valorem taxes, impact fees,
214214 revenue, contract payments, grants, or other district money, or any
215215 combination of those sources, to pay for any authorized district
216216 purpose.
217217 Sec. 8353.202. TAXES FOR BONDS. At the time the district
218218 issues bonds payable wholly or partly from ad valorem taxes, the
219219 board shall provide for the annual imposition of a continuing
220220 direct ad valorem tax, without limit as to rate or amount, while all
221221 or part of the bonds are outstanding as required and in the manner
222222 provided by Sections 54.601 and 54.602, Water Code.
223223 Sec. 8353.203. BONDS FOR ROAD PROJECTS. At the time of
224224 issuance, the total principal amount of bonds or other obligations
225225 issued or incurred to finance road projects and payable from ad
226226 valorem taxes may not exceed one-fourth of the assessed value of the
227227 real property in the district.
228228 SECTION 2. The Clearwater Ranch Municipal Utility District
229229 No. 1 initially includes all the territory contained in the
230230 following area:

12771277 (b) The governor, one of the required recipients, has
12781278 submitted the notice and Act to the Texas Commission on
12791279 Environmental Quality.
12801280 (c) The Texas Commission on Environmental Quality has filed
12811281 its recommendations relating to this Act with the governor, the
12821282 lieutenant governor, and the speaker of the house of
12831283 representatives within the required time.
12841284 (d) All requirements of the constitution and laws of this
12851285 state and the rules and procedures of the legislature with respect
12861286 to the notice, introduction, and passage of this Act are fulfilled
12871287 and accomplished.
12881288 SECTION 4. This Act takes effect immediately if it receives
12891289 a vote of two-thirds of all the members elected to each house, as
12901290 provided by Section 39, Article III, Texas Constitution. If this
12911291 Act does not receive the vote necessary for immediate effect, this
12921292 Act takes effect September 1, 2009.
