88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1010 Code, is amended by adding Chapter 3870 to read as follows:
1111 CHAPTER 3870. MAVERICK IMPROVEMENT DISTRICT
1212 OF PALO PINTO COUNTY
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 3870.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the board of directors of the
1616 district.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Maverick Improvement
1919 District of Palo Pinto County.
2020 Sec. 3870.002. NATURE OF DISTRICT. The district is a
2121 special district created under Section 59, Article XVI, and
2222 Sections 52 and 52-a, Article III, Texas Constitution.
2323 Sec. 3870.003. CONFIRMATION AND DIRECTORS' ELECTION
2424 REQUIRED. The temporary directors shall hold an election to
2525 confirm the creation of the district and to elect five permanent
2626 directors as provided by Section 49.102, Water Code.
2727 Sec. 3870.004. CONSENT OF MUNICIPALITY REQUIRED. The
2828 temporary directors may not hold an election under Section 3870.003
2929 until each municipality in whose corporate limits or
3030 extraterritorial jurisdiction the district is located has
3131 consented by ordinance or resolution to the creation of the
3232 district and to the inclusion of land in the district.
3333 Sec. 3870.005. FINDINGS OF BENEFIT AND PUBLIC PURPOSE.
3434 (a) The district is created to serve a public purpose and benefit.
3535 By creating the district and in authorizing the county of Palo Pinto
3636 and other political subdivisions to contract with the district, the
3737 legislature has established a program to accomplish the public
3838 purposes set out in Section 52-a, Article III, Texas Constitution.
3939 (b) The district is created to accomplish the purposes of
4040 promoting, developing, encouraging, and maintaining employment,
4141 commerce, transportation, housing, tourism, recreation, economic
4242 development, safety, and the public welfare in the district and to
4343 accomplish the purposes of:
4444 (1) a municipal utility district as provided by
4545 general law and Section 59, Article XVI, Texas Constitution;
4646 (2) a county development district as provided by
4747 general law and Section 52-a, Article III, Texas Constitution;
4848 (3) Section 52, Article III, Texas Constitution,
4949 related to the construction, acquisition, improvement, operation,
5050 or maintenance of macadamized, graveled, or paved roads, or
5151 improvements, including storm drainage, in aid of those roads; and
5252 (4) Section 52-a, Article III, Texas Constitution,
5353 related to the provision of public recreational facilities,
5454 including docks and boat access facilities, pedestrian ways and
5555 street lighting and parking, and the installation of signage and
5656 landscaping and the development of certain areas in the district
5757 that are necessary for the restoration, preservation, and
5858 enhancement of scenic beauty.
5959 Sec. 3870.006. INITIAL DISTRICT TERRITORY. (a) The
6060 district is initially composed of the territory described by
6161 Section 2 of the Act creating this chapter.
6262 (b) The boundaries and field notes contained in Section 2 of
6363 the Act creating this chapter form a closure. A mistake made in the
6464 field notes or in copying the field notes in the legislative process
6565 does not affect the district's:
6666 (1) organization, existence, or validity;
6767 (2) right to issue any type of bond for the purposes
6868 for which the district is created or to pay the principal of and
6969 interest on a bond;
7070 (3) right to impose a tax; or
7171 (4) legality or operation.

7373 SUBCHAPTER B. BOARD OF DIRECTORS
7474 Sec. 3870.051. GOVERNING BODY; TERMS. (a) The district is
7575 governed by a board of five elected directors.
7676 (b) Except as provided by Section 3870.052, directors serve
7777 staggered four-year terms.
7878 Sec. 3870.052. TEMPORARY DIRECTORS. (a) On or after
7979 September 1, 2009, the owner or owners of a majority of the assessed
8080 value of the real property in the district may submit a petition to
8181 the Texas Commission on Environmental Quality requesting that the
8282 commission appoint as temporary directors the five persons named in
8383 the petition. The commission shall appoint as temporary directors
8484 the five persons named in the petition.
8585 (b) Temporary directors serve until the earlier of:
8686 (1) the date permanent directors are elected under
8787 Section 3870.003; or
8888 (2) September 1, 2013.
8989 (c) If permanent directors have not been elected under
9090 Section 3870.003 and the terms of the temporary directors have
9191 expired, successor temporary directors shall be appointed or
9292 reappointed as provided by Subsection (d) to serve terms that
9393 expire on the earlier of:
9494 (1) the date permanent directors are elected under
9595 Section 3870.003; or
9696 (2) the fourth anniversary of the date of the
9797 appointment or reappointment.
9898 (d) If Subsection (c) applies, the owner or owners of a
9999 majority of the assessed value of the real property in the district
100100 may submit a petition to the Texas Commission on Environmental
101101 Quality requesting that the commission appoint as successor
102102 temporary directors the five persons named in the petition. The
103103 commission shall appoint as successor temporary directors the five
104104 persons named in the petition.

106106 SUBCHAPTER C. POWERS AND DUTIES
107107 Sec. 3870.101. GENERAL POWERS AND DUTIES. The district has
108108 the powers and duties necessary to accomplish the purposes for
109109 which the district is created.
110110 Sec. 3870.102. MUNICIPAL UTILITY DISTRICT POWERS AND
111111 DUTIES. The district has the powers and duties provided by the
112112 general law of this state, including Chapters 49 and 54, Water Code,
113113 applicable to municipal utility districts created under Section 59,
114114 Article XVI, Texas Constitution.
115115 Sec. 3870.103. ROAD PROJECTS. Under Section 52, Article
116116 III, Texas Constitution, the district may design, acquire,
117117 construct, finance, improve, operate, and maintain macadamized,
118118 graveled, or paved roads, or improvements, including storm
119119 drainage, in aid of those roads, and may convey those roads or
120120 improvements to this state, a county, or a municipality to operate
121121 and maintain.
122122 Sec. 3870.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
123123 road project must meet all applicable construction standards,
124124 zoning and subdivision requirements, and regulatory ordinances of a
125125 municipality in whose corporate limits or extraterritorial
126126 jurisdiction the road project is located.
127127 (b) If a road project is not located in the corporate limits
128128 or extraterritorial jurisdiction of a municipality, the road
129129 project must meet all applicable construction standards, zoning and
130130 subdivision requirements, and orders of a county in which the road
131131 project is located.
132132 (c) If the state will maintain and operate the road, the
133133 Texas Transportation Commission must approve the plans and
134134 specifications of the road project.
135135 Sec. 3870.105. COMPLIANCE WITH MUNICIPAL CONSENT
136136 ORDINANCES OR RESOLUTIONS. The district shall comply with all
137137 applicable requirements of any ordinance or resolution adopted by
138138 the governing body of a municipality under Section 54.016 or
139139 54.0165, Water Code, that consents to the creation of the district
140140 or to the inclusion of land in the district.
141141 Sec. 3870.106. LIMITATION ON USE OF EMINENT DOMAIN. The
142142 district may exercise the power of eminent domain only inside the
143143 district's boundaries.
144144 Sec. 3870.107. AGREEMENTS; GRANTS. (a) The district may
145145 make an agreement with or accept a gift, grant, or loan from any
146146 person.
147147 (b) The board may enter into a contract with another
148148 political subdivision or the state to share the costs of
149149 construction, acquisition, operation, or maintenance of a
150150 transportation improvement, including a road, a bridge, a culvert,
151151 a parking facility, or another public improvement.
152152 (c) The implementation of a district project is a
153153 governmental function or service for the purposes of Chapter 791,
154154 Government Code.
155155 Sec. 3870.108. DIVISION OF DISTRICT. (a) The district may
156156 be divided into two or more new districts only if the district:
157157 (1) has no outstanding bonded debt; and
158158 (2) is not imposing ad valorem taxes.
159159 (b) This chapter applies to any new district created by the
160160 division of the district, and a new district has all the powers and
161161 duties of the district.
162162 (c) Any new district created by the division of the district
163163 may not, at the time the new district is created, contain any land
164164 outside the area described by Section 2 of the Act creating this
165165 chapter.
166166 (d) The board, on its own motion or on receipt of a petition
167167 signed by the owners of a majority of the assessed value of real
168168 property in the district according to the most recent certified
169169 appraisal roll for the county in which the district is located, may
170170 adopt an order dividing the district. An order dividing the
171171 district may be adopted before or after an election to confirm the
172172 district as required by Section 3870.003.
173173 (e) The board may adopt an order dividing the district
174174 before or after the date the board holds an election under Section
175175 3870.003 to confirm the district's creation.
176176 (f) An order dividing the district shall:
177177 (1) name each new district;
178178 (2) include the metes and bounds of each new district;
179179 (3) appoint temporary directors for each new district;
180180 and
181181 (4) provide for the division of assets and liabilities
182182 between each new district.
183183 (g) On or before the 30th day after the adoption of an order
184184 dividing the district, the district shall file the order dividing
185185 the district with the Texas Commission on Environmental Quality and
186186 record the order in the real property records of the county in which
187187 the district is located.
188188 (h) Any new district created by the division of the district
189189 shall hold a confirmation and directors' election as required by
190190 Section 49.102, Water Code.
191191 (i) Municipal consent to the creation of the district and to
192192 the inclusion of land in the district granted under Section
193193 3870.004 acts as municipal consent to the creation of any new
194194 district created by the division of the district and to the
195195 inclusion of land in the new district.
196196 (j) Any new district created by the division of the district
197197 must hold an election in the manner provided by Chapters 49 and 54,
198198 Water Code, to obtain voter approval before the district may impose
199199 a maintenance tax or issue bonds payable wholly or partly from ad
200200 valorem taxes.

202202 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
203203 Sec. 3870.151. ELECTIONS REGARDING TAXES OR BONDS.
204204 (a) The district may issue, without an election, bonds and other
205205 obligations secured by:
206206 (1) revenue other than ad valorem taxes; or
207207 (2) contract payments described by Section 3870.153.
208208 (b) The district must hold an election in the manner
209209 provided by Chapters 49 and 54, Water Code, to obtain voter approval
210210 before the district may impose an ad valorem tax or issue bonds
211211 payable from ad valorem taxes.
212212 (c) The district may not issue bonds payable from ad valorem
213213 taxes to finance a road project unless the issuance is approved by a
214214 vote of a two-thirds majority of the district voters voting at an
215215 election held for that purpose.
216216 Sec. 3870.152. OPERATION AND MAINTENANCE TAX. (a) If
217217 authorized at an election held under Section 3870.151, the district
218218 may impose an operation and maintenance tax on taxable property in
219219 the district as provided by Section 49.107, Water Code.
220220 (b) The board shall determine the tax rate. The rate may not
221221 exceed the rate approved at the election.
222222 Sec. 3870.153. CONTRACT TAXES. (a) As provided by Section
223223 49.108, Water Code, the district may impose a tax other than an
224224 operation and maintenance tax and use the revenue derived from the
225225 tax to make payments under a contract after the provisions of the
226226 contract have been approved by a majority of the district voters
227227 voting at an election held for that purpose.
228228 (b) A contract approved by the district voters may contain a
229229 provision stating that the contract may be modified or amended by
230230 the board without further voter approval.
231231 Sec. 3870.154. POWERS OF COUNTY DEVELOPMENT DISTRICT. The
232232 district has the powers of a county development district provided
233233 by Chapter 383, Local Government Code.
234234 Sec. 3870.155. SALES AND USE TAX; ELECTION. (a) The
235235 district may adopt a sales and use tax as provided by Chapter 383,
236236 Local Government Code, after an election in which the majority of
237237 the voters of the district voting in the election authorize the
238238 adoption of the tax.
239239 (b) The board by order may call an election to authorize a
240240 sales and use tax. The election may be held with any other district
241241 election.
242242 (c) The district shall provide notice of the election and
243243 shall hold the election in the manner prescribed by Section
244244 3870.151.
245245 Sec. 3870.156. SALES AND USE TAX RATE. (a) On adoption of
246246 the tax authorized by Section 3870.155, there is imposed a tax on
247247 the receipts from the sale at retail of taxable items within the
248248 district, and an excise tax on the use, storage, or other
249249 consumption in the district of taxable items purchased, leased, or
250250 rented from a retailer in the district during the period after the
251251 tax is in effect.
252252 (b) The board shall determine the rate of the tax, which may
253253 be in one-eighth of one percent increments not to exceed the maximum
254254 rate authorized by the district voters at the election. The board
255255 may lower the tax rate to the extent it does not impair any
256256 outstanding debt or obligations payable from the tax.
257257 Sec. 3870.157. HOTEL OCCUPANCY TAX. (a) In this section,
258258 "hotel" has the meaning assigned by Section 156.001, Tax Code.
259259 (b) For purposes of this section, a reference in Subchapter
260260 A, Chapter 352, Tax Code, to a county is a reference to the district
261261 and a reference in Subchapter A, Chapter 352, Tax Code, to the
262262 county's officers or governing body is a reference to the board.
263263 (c) Except as inconsistent with this section, Subchapter A,
264264 Chapter 352, Tax Code, governs a hotel occupancy tax authorized by
265265 this section, including the collection of the tax, subject to the
266266 limitations prescribed by Sections 352.002(b) and (c), Tax Code.
267267 (d) The district may impose a hotel occupancy tax for any
268268 district purpose, including to:
269269 (1) maintain and operate the district;
270270 (2) construct or acquire improvements; and
271271 (3) provide a service.
272272 (e) The district may examine and receive information
273273 related to the imposition of hotel occupancy taxes to the same
274274 extent as if the district were a county.

276276 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
277277 Sec. 3870.201. AUTHORITY TO ISSUE BONDS AND OTHER
278278 OBLIGATIONS. The district may issue bonds or other obligations
279279 payable wholly or partly from ad valorem taxes, impact fees,
280280 revenue, contract payments, grants, or other district money, or any
281281 combination of those sources, to pay for any authorized district
282282 purpose.
283283 Sec. 3870.202. TAXES FOR BONDS. At the time the district
284284 issues bonds payable wholly or partly from ad valorem taxes, the
285285 board shall provide for the annual imposition of a continuing
286286 direct ad valorem tax, without limit as to rate or amount, while all
287287 or part of the bonds are outstanding as required and in the manner
288288 provided by Sections 54.601 and 54.602, Water Code.
289289 Sec. 3870.203. BONDS FOR ROAD PROJECTS. At the time of
290290 issuance, the total principal amount of bonds or other obligations
291291 issued or incurred to finance road projects and payable from ad
292292 valorem taxes may not exceed one-fourth of the assessed value of the
293293 real property in the district.
294294 SECTION 2. The Maverick Improvement District of Palo Pinto
295295 County initially includes all the territory contained in the
