| 10 | 10 | SECTION 1. Chapter 75, Acts of the 57th Legislature, | |
| 11 | 11 | Regular Session, 1961, is amended by adding Section 5A to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | Sec. 5A. (a) The District has the powers and duties | |
| 14 | 14 | provided by the general laws of this state, including Chapters 49 | |
| 15 | 15 | and 51, Water Code, applicable to a water control and improvement | |
| 16 | 16 | district and the powers and duties provided by the general laws of | |
| 17 | 17 | this state, including Chapter 36, Water Code, applicable to a | |
| 18 | 18 | groundwater conservation district. | |
| 19 | 19 | (b) Notwithstanding Section 49.002(b), Water Code, in case | |
| 20 | 20 | of any conflict between provisions of Chapters 36 and 49, Water | |
| 21 | 21 | Code, applicable to the District, Chapter 49, Water Code, controls. | |
| 22 | 22 | SECTION 2. This Act takes effect September 1, 2009. |
