66 AN ACT
77 relating to the authority of a municipality to lower the speed limit
88 on certain highways in the municipality.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 545.356(b-1), Transportation Code, is
1111 amended to read as follows:
1212 (b-1) Except as provided by Subsection (b-2), the governing
1313 body of a municipality, for a highway or a part of a highway in an
1414 urban district in the municipality that is not an officially
1515 designated or marked highway or road of the state highway system and
1616 that [,] is 35 feet or less in width, [and along which vehicular
1717 parking is not prohibited on one or both sides of the highway,] may
1818 declare a lower speed limit of not less than 25 miles per hour, if
1919 the governing body determines that the prima facie speed limit on
2020 the highway is unreasonable or unsafe.
2121 SECTION 2. This Act takes effect September 1, 2009.
