9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 545.356(b-1), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (b-1) Except as provided by Subsection (b-2), the governing | |
13 | 13 | body of a municipality, for a highway or a part of a highway in an | |
14 | 14 | urban district in the municipality that is not an officially | |
15 | 15 | designated or marked highway or road of the state highway system and | |
16 | 16 | that [,] is 35 feet or less in width, [and along which vehicular | |
17 | 17 | parking is not prohibited on one or both sides of the highway,] may | |
18 | 18 | declare a lower speed limit of not less than 25 miles per hour, if | |
19 | 19 | the governing body determines that the prima facie speed limit on | |
20 | 20 | the highway is unreasonable or unsafe. | |
21 | 21 | SECTION 2. This Act takes effect September 1, 2009. |
