| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Subtitle A, Title 5, Special District Local Laws |
|---|
| 9 | 9 | | Code, is amended by adding Chapter 5006 to read as follows: |
|---|
| 10 | 10 | | CHAPTER 5006. MATAGORDA COUNTY NAVIGATION DISTRICT NO. 1 |
|---|
| 11 | 11 | | SUBCHAPTER A. GENERAL PROVISIONS |
|---|
| 12 | 12 | | Sec. 5006.001. DEFINITIONS. In this chapter: |
|---|
| 13 | 13 | | (1) "Board" means the board of navigation and canal |
|---|
| 14 | 14 | | commissioners of the district. |
|---|
| 15 | 15 | | (2) "Commissioner" means a member of the board. |
|---|
| 16 | 16 | | (3) "District" means the Matagorda County Navigation |
|---|
| 17 | 17 | | District No. 1. |

| 18 | 18 | | [Sections 5006.002-5006.050 reserved for expansion] |

| 19 | 19 | | SUBCHAPTER B. DISTRICT ADMINISTRATION |
|---|
| 20 | 20 | | Sec. 5006.051. BOARD OF COMMISSIONERS; TERM; ELECTION. |
|---|
| 21 | 21 | | (a) The district is governed by a board consisting of five |
|---|
| 22 | 22 | | commissioners elected at large. |
|---|
| 23 | 23 | | (b) Commissioners serve staggered six-year terms, with the |
|---|
| 24 | 24 | | terms of one or two commissioners expiring on November 30 of each |
|---|
| 25 | 25 | | even-numbered year. |
|---|
| 26 | 26 | | (c) An election shall be held in the district every two |
|---|
| 27 | 27 | | years on the uniform election date in November to elect one or two |
|---|
| 28 | 28 | | commissioners. |
|---|
| 29 | 29 | | SECTION 2. (a) Notwithstanding Section 5006.051, Special |
|---|
| 30 | 30 | | District Local Laws Code, as added by this Act, on the uniform |
|---|
| 31 | 31 | | election date in November 2010, the board of navigation and canal |
|---|
| 32 | 32 | | commissioners of the Matagorda County Navigation District No. 1 |
|---|
| 33 | 33 | | shall hold an election to elect: |
|---|
| 34 | 34 | | (1) one commissioner to serve a term expiring |
|---|
| 35 | 35 | | November 30, 2014; and |
|---|
| 36 | 36 | | (2) two commissioners to serve terms expiring |
|---|
| 37 | 37 | | November 30, 2016. |
|---|
| 38 | 38 | | (b) On the uniform election date in November of each |
|---|
| 39 | 39 | | even-numbered year after 2010, the board of navigation and canal |
|---|
| 40 | 40 | | commissioners of the Matagorda County Navigation District No. 1 |
|---|
| 41 | 41 | | shall hold an election to elect the appropriate number of |
|---|
| 42 | 42 | | commissioners to serve six-year terms. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 44 | 44 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 45 | 45 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 46 | 46 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 47 | 47 | | Act takes effect September 1, 2009. |
