55 relating to the authority of the Harris-Montgomery Counties
66 Municipal Utility District No. 386, formerly known as Harris County
77 Municipal Utility District No. 386, to issue bonds supported by ad
88 valorem taxes to finance recreational facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 6, Chapter 1381, Acts of the 77th
1111 Legislature, Regular Session, 2001, is amended by adding Subsection
1212 (d) to read as follows:
1313 (d) Section 49.4645(f), Water Code, does not apply to the
1414 district.
1515 SECTION 2. The Harris-Montgomery Counties Municipal
1616 Utility District No. 386, formerly known as Harris County Municipal
1717 Utility District No. 386, retains all the rights, powers,
1818 privileges, authority, duties, and functions that it had before the
1919 effective date of this Act.
2020 SECTION 3. (a) The legal notice of the intention to
2121 introduce this Act, setting forth the general substance of this
2222 Act, has been published as provided by law, and the notice and a
2323 copy of this Act have been furnished to all persons, agencies,
2424 officials, or entities to which they are required to be furnished
2525 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
2626 Government Code.
2727 (b) The governor, one of the required recipients, has
2828 submitted the notice and Act to the Texas Commission on
2929 Environmental Quality.
3030 (c) The Texas Commission on Environmental Quality has filed
3131 its recommendations relating to this Act with the governor, the
3232 lieutenant governor, and the speaker of the house of
3333 representatives within the required time.
3434 (d) All requirements of the constitution and laws of this
3535 state and the rules and procedures of the legislature with respect
3636 to the notice, introduction, and passage of this Act are fulfilled
3737 and accomplished.
3838 SECTION 4. This Act takes effect immediately if it receives
3939 a vote of two-thirds of all the members elected to each house, as
4040 provided by Section 39, Article III, Texas Constitution. If this
4141 Act does not receive the vote necessary for immediate effect, this
4242 Act takes effect September 1, 2009.
