| 6 | 6 | | relating to the transfer of certain state property from the Texas |
|---|
| 7 | 7 | | Department of Transportation to the Parks and Wildlife Department. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. (a) Not later than December 31, 2009, the Texas |
|---|
| 10 | 10 | | Department of Transportation shall transfer to the Parks and |
|---|
| 11 | 11 | | Wildlife Department the real property described by Subsection (d) |
|---|
| 12 | 12 | | of this section. |
|---|
| 13 | 13 | | (b) The consideration for the transfer authorized by |
|---|
| 14 | 14 | | Subsection (a) of this section is the requirement that the Parks and |
|---|
| 15 | 15 | | Wildlife Department use the property transferred only for a public |
|---|
| 16 | 16 | | park, a purpose that benefits the public interest of the state. If |
|---|
| 17 | 17 | | the Parks and Wildlife Department no longer uses the property for a |
|---|
| 18 | 18 | | public park, ownership of the property automatically reverts to the |
|---|
| 19 | 19 | | Texas Department of Transportation. |
|---|
| 20 | 20 | | (c) The Texas Department of Transportation shall transfer |
|---|
| 21 | 21 | | the property by an appropriate instrument of transfer, executed on |
|---|
| 22 | 22 | | its behalf by the Commissioner of the General Land Office. The |
|---|
| 23 | 23 | | instrument of transfer must: |
|---|
| 24 | 24 | | (1) include a provision that: |
|---|
| 25 | 25 | | (A) requires the Parks and Wildlife Department to |
|---|
| 26 | 26 | | use the property for a public park, a purpose that benefits the |
|---|
| 27 | 27 | | public interest of the state; |
|---|
| 28 | 28 | | (B) allows the Parks and Wildlife Department to |
|---|
| 29 | 29 | | lease the property described by Subsection (d) of this section to |
|---|
| 30 | 30 | | the Williamson County Parks and Recreation Department for use as a |
|---|
| 31 | 31 | | public park; and |
|---|
| 32 | 32 | | (C) indicates that ownership of the property |
|---|
| 33 | 33 | | automatically reverts to the Texas Department of Transportation if |
|---|
| 34 | 34 | | the Parks and Wildlife Department no longer uses the property for a |
|---|
| 35 | 35 | | public park; and |
|---|
| 36 | 36 | | (2) describe the property to be transferred by metes |
|---|
| 37 | 37 | | and bounds. |
|---|
| 38 | 38 | | (d) The real property to which Subsection (a) of this |
|---|
| 39 | 39 | | section refers is described as follows: |
|---|
| 40 | 40 | | A tract of land situated in the Damon Survey, Abstract No. 170, in |
|---|
| 41 | 41 | | Williamson County, Texas, being all of that called 6.180 acre tract |
|---|
| 42 | 42 | | of land (Tract 7), as shown on that unrecorded plat prepared by KC |
|---|
| 43 | 43 | | Engineering dated July 18, 1994, on ten (10) tracts of land out of |
|---|
| 44 | 44 | | that called 780.508 acre tract of land conveyed to the State of |
|---|
| 45 | 45 | | Texas, State Department of Highways and Public Transportation, by |
|---|
| 46 | 46 | | instrument recorded in Volume 1723, Page 855, of the Official |
|---|
| 47 | 47 | | Records of Williamson County, Texas. |
|---|
| 48 | 48 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 49 | 49 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 50 | 50 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 51 | 51 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 52 | 52 | | Act takes effect September 1, 2009. |
