99 AN ACT
1010 relating to the creation of the Bastrop County Municipal Utility
1111 District No. 2; providing authority to impose a tax and issue bonds;
1212 granting a limited power of eminent domain.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 8335 to read as follows:
1616 CHAPTER 8335. BASTROP COUNTY MUNICIPAL UTILITY DISTRICT NO. 2
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8335.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the district's board of directors.
2020 (2) "Director" means a board member.
2121 (3) "District" means the Bastrop County Municipal
2222 Utility District No. 2.
2323 Sec. 8335.002. NATURE OF DISTRICT. The district is a
2424 municipal utility district created under Section 59, Article XVI,
2525 Texas Constitution.
2626 Sec. 8335.003. CONFIRMATION AND DIRECTORS' ELECTION
2727 REQUIRED. The temporary directors shall hold an election to
2828 confirm the creation of the district and to elect five permanent
2929 directors as provided by Section 49.102, Water Code.
3030 Sec. 8335.004. CONSENT OF MUNICIPALITY REQUIRED. The
3131 temporary directors may not hold an election under Section 8335.003
3232 until each municipality in whose corporate limits or
3333 extraterritorial jurisdiction the district is located has
3434 consented by ordinance or resolution to the creation of the
3535 district and to the inclusion of land in the district.
3636 Sec. 8335.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3737 (a) The district is created to serve a public purpose and benefit.
3838 (b) The district is created to accomplish the purposes of:
3939 (1) a municipal utility district as provided by
4040 general law and Section 59, Article XVI, Texas Constitution; and
4141 (2) Section 52, Article III, Texas Constitution, that
4242 relate to the construction, acquisition, improvement, operation,
4343 or maintenance of macadamized, graveled, or paved roads, or
4444 improvements, including storm drainage, in aid of those roads.
4545 Sec. 8335.006. INITIAL DISTRICT TERRITORY. (a) The
4646 district is initially composed of the territory described by
4747 Section 2 of the Act creating this chapter.
4848 (b) The boundaries and field notes contained in Section 2 of
4949 the Act creating this chapter form a closure. A mistake made in the
5050 field notes or in copying the field notes in the legislative process
5151 does not affect the district's:
5252 (1) organization, existence, or validity;
5353 (2) right to issue any type of bond for the purposes
5454 for which the district is created or to pay the principal of and
5555 interest on a bond;
5656 (3) right to impose a tax; or
5757 (4) legality or operation.

5959 SUBCHAPTER B. BOARD OF DIRECTORS
6060 Sec. 8335.051. GOVERNING BODY; TERMS. (a) The district is
6161 governed by a board of five elected directors.
6262 (b) Except as provided by Section 8335.052, directors serve
6363 staggered four-year terms.
6464 Sec. 8335.052. TEMPORARY DIRECTORS. (a) The temporary
6565 board consists of:
6666 (1) William Strawn;
6767 (2) Michael Lamendola;
6868 (3) David Bowen;
6969 (4) Sean Mills; and
7070 (5) Ann Schneider.
7171 (b) Temporary directors serve until the earlier of:
7272 (1) the date permanent directors are elected under
7373 Section 8335.003; or
7474 (2) the fourth anniversary of the effective date of
7575 the Act creating this chapter.
7676 (c) If permanent directors have not been elected under
7777 Section 8335.003 and the terms of the temporary directors have
7878 expired, successor temporary directors shall be appointed or
7979 reappointed as provided by Subsection (d) to serve terms that
8080 expire on the earlier of:
8181 (1) the date permanent directors are elected under
8282 Section 8335.003; or
8383 (2) the fourth anniversary of the date of the
8484 appointment or reappointment.
8585 (d) If Subsection (c) applies, the owner or owners of a
8686 majority of the assessed value of the real property in the district
8787 may submit a petition to the Texas Commission on Environmental
8888 Quality requesting that the commission appoint as successor
8989 temporary directors the five persons named in the petition. The
9090 commission shall appoint as successor temporary directors the five
9191 persons named in the petition.

9393 SUBCHAPTER C. POWERS AND DUTIES
9494 Sec. 8335.101. GENERAL POWERS AND DUTIES. The district has
9595 the powers and duties necessary to accomplish the purposes for
9696 which the district is created.
9797 Sec. 8335.102. MUNICIPAL UTILITY DISTRICT POWERS AND
9898 DUTIES. The district has the powers and duties provided by the
9999 general law of this state, including Chapters 49 and 54, Water Code,
100100 applicable to municipal utility districts created under Section 59,
101101 Article XVI, Texas Constitution.
102102 Sec. 8335.103. AUTHORITY FOR ROAD PROJECTS. Under Section
103103 52, Article III, Texas Constitution, the district may design,
104104 acquire, construct, finance, issue bonds for, improve, operate,
105105 maintain, and convey to this state, a county, or a municipality for
106106 operation and maintenance macadamized, graveled, or paved roads, or
107107 improvements, including storm drainage, in aid of those roads.
108108 Sec. 8335.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
109109 road project must meet all applicable construction standards,
110110 zoning and subdivision requirements, and regulations of each
111111 municipality in whose corporate limits or extraterritorial
112112 jurisdiction the road project is located.
113113 (b) If a road project is not located in the corporate limits
114114 or extraterritorial jurisdiction of a municipality, the road
115115 project must meet all applicable construction standards,
116116 subdivision requirements, and regulations of each county in which
117117 the road project is located.
118118 (c) If the state will maintain and operate the road, the
119119 Texas Transportation Commission must approve the plans and
120120 specifications of the road project.
121121 Sec. 8335.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
122122 OR RESOLUTION. The district shall comply with all applicable
123123 requirements of any ordinance or resolution that is adopted under
124124 Section 54.016 or 54.0165, Water Code, and that consents to the
125125 creation of the district or to the inclusion of land in the
126126 district.
127127 Sec. 8335.106. CONTRACT WITH CERTAIN MUNICIPALITIES
128128 REQUIRED. (a) In order to exercise the powers and duties of a
129129 municipal utility district granted by this chapter, the district
130130 shall enter into a written contract with any municipality within
131131 whose extraterritorial jurisdiction the district is wholly or
132132 partly located:
133133 (1) regulating the continuation of the
134134 extraterritorial status of the district and its annexation by the
135135 municipality;
136136 (2) regulating the development within the boundaries
137137 of the district in a manner that the parties agree will further the
138138 health, safety, and welfare of the residents of the district; and
139139 (3) containing other terms and consideration that the
140140 municipality determines to be reasonable and appropriate.
141141 (b) A contract under this section may be renewed or extended
142142 for successive periods not to exceed 15 years.
143143 Sec. 8335.107. LIMITATION ON USE OF EMINENT DOMAIN. The
144144 district may not exercise the power of eminent domain outside the
145145 district to acquire a site or easement for:
146146 (1) a road project authorized by Section 8335.103; or
147147 (2) a recreational facility as defined by Section
148148 49.462, Water Code.

150150 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
151151 Sec. 8335.151. ELECTIONS REGARDING TAXES OR BONDS.
152152 (a) The district may issue, without an election, bonds and other
153153 obligations secured by:
154154 (1) revenue other than ad valorem taxes; or
155155 (2) contract payments described by Section 8335.153.
156156 (b) The district must hold an election in the manner
157157 provided by Chapters 49 and 54, Water Code, to obtain voter approval
158158 before the district may impose an ad valorem tax or issue bonds
159159 payable from ad valorem taxes.
160160 (c) The district may not issue bonds payable from ad valorem
161161 taxes to finance a road project unless the issuance is approved by a
162162 vote of a two-thirds majority of the district voters voting at an
163163 election held for that purpose.
164164 Sec. 8335.152. OPERATION AND MAINTENANCE TAX. (a) If
165165 authorized at an election held under Section 8335.151, the district
166166 may impose an operation and maintenance tax on taxable property in
167167 the district in accordance with Section 49.107, Water Code.
168168 (b) The board shall determine the tax rate. The rate may not
169169 exceed the rate approved at the election.
170170 Sec. 8335.153. CONTRACT TAXES. (a) In accordance with
171171 Section 49.108, Water Code, the district may impose a tax other than
172172 an operation and maintenance tax and use the revenue derived from
173173 the tax to make payments under a contract after the provisions of
174174 the contract have been approved by a majority of the district voters
175175 voting at an election held for that purpose.
176176 (b) A contract approved by the district voters may contain a
177177 provision stating that the contract may be modified or amended by
178178 the board without further voter approval.

180180 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
181181 Sec. 8335.201. AUTHORITY TO ISSUE BONDS AND OTHER
182182 OBLIGATIONS. The district may issue bonds or other obligations
183183 payable wholly or partly from ad valorem taxes, impact fees,
184184 revenue, contract payments, grants, or other district money, or any
185185 combination of those sources, to pay for any authorized district
186186 purpose.
187187 Sec. 8335.202. TAXES FOR BONDS. At the time the district
188188 issues bonds payable wholly or partly from ad valorem taxes, the
189189 board shall provide for the annual imposition of a continuing
190190 direct ad valorem tax, without limit as to rate or amount, while all
191191 or part of the bonds are outstanding as required and in the manner
192192 provided by Sections 54.601 and 54.602, Water Code.
193193 Sec. 8335.203. BONDS FOR ROAD PROJECTS. At the time of
194194 issuance, the total principal amount of bonds or other obligations
195195 issued or incurred to finance road projects and payable from ad
196196 valorem taxes may not exceed one-fourth of the assessed value of the
197197 real property in the district.
198198 SECTION 2. The Bastrop County Municipal Utility District
199199 No. 2 initially includes all the territory contained in the
200200 following area:
201201 BEING A PART OF THAT CERTAIN TRACT OF LAND OUT OF AND A PART OF

550550 (b) The governor, one of the required recipients, has

554554 its recommendations relating to this Act with the governor, the

562562 a vote of two-thirds of all the members elected to each house, as
