6	6	AN ACT
7	7	relating to the creation of the Trinity River West Municipal
8	8	Management District; providing the authority to impose an
9	9	assessment, impose a tax, and issue bonds.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subtitle C, Title 4, Special District Local Laws
12	12	Code, is amended by adding Chapter 3871 to read as follows:
13	13	CHAPTER 3871. TRINITY RIVER WEST MUNICIPAL MANAGEMENT DISTRICT
14	14	SUBCHAPTER A. GENERAL PROVISIONS
15	15	Sec. 3871.001. DEFINITIONS. In this chapter:
16	16	(1) "Board" means the district's board of directors.
17	17	(2) "City" means the City of Dallas.
18	18	(3) "District" means the Trinity River West Municipal
19	19	Management District.
20	20	(4) "Improvement project" means a project authorized
21	21	by Section 3871.102:
22	22	(A) inside the boundaries of the district; and
23	23	(B) in areas outside but adjacent to the
24	24	boundaries of the district if the project is for the purpose of
25	25	extending public infrastructure improvements beyond the district's
26	26	boundaries to a logical terminus.
27	27	Sec. 3871.002. CREATION AND NATURE OF DISTRICT. The
28	28	district is a special district created under Section 59, Article
29	29	XVI, Texas Constitution.
30	30	Sec. 3871.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The
31	31	creation of the district is essential to accomplish the purposes of
32	32	Sections 52 and 52-a, Article III, and Section 59, Article XVI,
33	33	Texas Constitution, and other public purposes stated in this
34	34	chapter. By creating the district and in authorizing the city and
35	35	other political subdivisions to contract with the district, the
36	36	legislature has established a program to accomplish the public
37	37	purposes set out in Section 52-a, Article III, Texas Constitution.
38	38	(b) The creation of the district is necessary to promote,
39	39	develop, encourage, and maintain employment, commerce,
40	40	transportation, housing, tourism, recreation, the arts,
41	41	entertainment, economic development, safety, and the public
42	42	welfare in the district.
43	43	(c) The district is created to supplement and not to
44	44	supplant city services provided in the district.
45	45	Sec. 3871.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
46	46	The district is created to serve a public use and benefit.
47	47	(b) All land and other property included in the district
48	48	will benefit from the improvements and services to be provided by
49	49	the district under powers conferred by Sections 52 and 52-a,
50	50	Article III, and Section 59, Article XVI, Texas Constitution, and
51	51	other powers granted under this chapter.
52	52	(c) The creation of the district is in the public interest
53	53	and is essential to further the public purposes of:
54	54	(1) developing and diversifying the economy of the
55	55	state;
56	56	(2) eliminating unemployment and underemployment;
57	57	(3) developing or expanding transportation and
58	58	commerce; and
59	59	(4) providing quality residential housing.
60	60	(d) The district will:
61	61	(1) promote the health, safety, and general welfare of
62	62	residents, employers, potential employees, employees, visitors,
63	63	and consumers in the district, and of the public;
64	64	(2) provide needed funding for the district to
65	65	preserve, maintain, and enhance the economic health and vitality of
66	66	the district territory as a residential community and business
67	67	center; and
68	68	(3) promote the health, safety, welfare, and enjoyment
69	69	of the public by providing pedestrian ways and by landscaping and
70	70	developing certain areas in the district, which are necessary for
71	71	the restoration, preservation, and enhancement of scenic beauty.
72	72	(e) Pedestrian ways along or across a street, whether at
73	73	grade or above or below the surface, and street lighting, street
74	74	landscaping, vehicle parking, and street art objects are parts of
75	75	and necessary components of a street and are considered to be an
76	76	improvement project that includes a street or road improvement.
77	77	(f) The district will not act as the agent or
78	78	instrumentality of any private interest even though the district
79	79	will benefit many private interests as well as the public.
80	80	Sec. 3871.005. DISTRICT TERRITORY. (a) The district is
81	81	composed of the territory described by Section 2 of the Act enacting
82	82	this chapter, as that territory may have been modified under:
83	83	(1) Section 3871.106; or
84	84	(2) other law.
85	85	(b) A mistake in the field notes of the district contained
86	86	in Section 2 of the Act enacting this chapter or in copying the
87	87	field notes in the legislative process does not in any way affect:
88	88	(1) the district's organization, existence, or
89	89	validity;
90	90	(2) the district's right to contract, including the
91	91	right to issue any type of bond or other obligation for a purpose
92	92	for which the district is created;
93	93	(3) the district's right to impose or collect an
94	94	assessment, tax, or any other revenue; or
95	95	(4) the legality or operation of the board.
96	96	Sec. 3871.006. ELIGIBILITY FOR INCLUSION IN SPECIAL ZONES.
97	97	(a) All or any part of the area of the district is eligible to be
98	98	included in:
99	99	(1) a tax increment reinvestment zone created by the
100	100	city under Chapter 311, Tax Code;
101	101	(2) a tax abatement reinvestment zone created by the
102	102	city under Chapter 312, Tax Code; or
103	103	(3) an enterprise zone created by the city under
104	104	Chapter 2303, Government Code.
105	105	(b) If the city creates a tax increment reinvestment zone
106	106	described by Subsection (a), the city and the board of directors of
107	107	the zone, by contract with the district, may grant money deposited
108	108	in the tax increment fund to the district to be used by the district
109	109	for the purposes permitted for money granted to a corporation under
110	110	Section 380.002(b), Local Government Code, including the right to
111	111	pledge the money as security for any bonds issued by the district
112	112	for an improvement project. A project may not receive public funds
113	113	under Section 380.002(b), Local Government Code, unless the project
114	114	has been approved by the governing body of the city by the adoption
115	115	of a resolution.
116	116	(c) A tax increment reinvestment zone created by the city in
117	117	the district is not subject to the limitations provided by Section
118	118	311.006(b), Tax Code.

120	120	SUBCHAPTER B. BOARD OF DIRECTORS
121	121	Sec. 3871.051. GOVERNING BODY; TERMS. (a) The district is
122	122	governed by a board of nine directors composed of:
123	123	(1) six directors appointed by the governing body of
124	124	the city; and
125	125	(2) three city employees appointed by the governing
126	126	body of the city.
127	127	(b) Before the term of each director expires as provided by
128	128	Subsection (d), the owner or owners of a majority of the appraised
129	129	value of the real property in the district, or the majority of the
130	130	record owners of real property in the district subject to taxation,
131	131	may submit a petition to the governing body of the city requesting
132	132	that the governing body appoint as successor directors the persons
133	133	named in the petition. If the persons named in the petition meet
134	134	the qualifications prescribed by Sections 3871.052 and 3871.053,
135	135	the governing body shall appoint those persons as successor
136	136	directors.
137	137	(c) If a petition is not submitted under Subsection (b), the
138	138	governing body of the city shall appoint as successor directors
139	139	persons who meet the qualifications prescribed by Sections 3871.052
140	140	and 3871.053.
141	141	(d) Directors serve staggered terms of four years, with four
142	142	or five directors' terms expiring July 1 of each odd-numbered year.
143	143	Sec. 3871.052. APPOINTMENT OF DIRECTORS: BOARD MEETINGS.
144	144	(a) Directors appointed under Section 3871.051(a)(1) must meet at
145	145	least one of the qualifications prescribed by Section 3871.053.
146	146	(b) A person may not be appointed to the board if the
147	147	appointment of that person would result in fewer than:
148	148	(1) four of the directors being residents of the city
149	149	and meeting the qualifications prescribed by Section
150	150	3871.053(a)(2), (3), (4), or (5); and
151	151	(2) two of the directors meeting the qualifications
152	152	prescribed by Section 3871.053(a)(1).
153	153	(c) The governing body of the city may remove a member of the
154	154	board with or without cause at any time by a majority vote.
155	155	(d) The board shall hold meetings at a place accessible to
156	156	the public. The board shall file a copy of the notice of a meeting
157	157	with the city's secretary. The city's secretary shall post the
158	158	notice at Dallas City Hall.
159	159	(e) The board may not create an executive committee to
160	160	exercise the powers of the board.
161	161	Sec. 3871.053. QUALIFICATIONS OF DIRECTORS. (a) To be
162	162	qualified to serve as a director appointed under Section
163	163	3871.051(a)(1), a person must be at least 18 years old and must be:
164	164	(1) a resident of the district who is also a registered
165	165	voter of the district or a registered voter who lives within a
166	166	two-mile radius of the district;
167	167	(2) an owner of property in the district;
168	168	(3) an owner of stock, whether beneficial or
169	169	otherwise, of a corporate owner of property in the district;
170	170	(4) an owner of a beneficial interest in a trust that
171	171	owns property in the district; or
172	172	(5) an agent, employee, or tenant of a person covered
173	173	by Subdivision (2), (3), or (4).
174	174	(b) Section 49.052, Water Code, does not apply to the
175	175	district.
176	176	Sec. 3871.054. VACANCY. The governing body of the city
177	177	shall fill a vacancy on the board by appointing a person who meets
178	178	the qualifications prescribed by Section 3871.051(a) or 3871.053 to
179	179	serve for the remainder of the unexpired term.
180	180	Sec. 3871.055. DIRECTOR'S OATH OR AFFIRMATION. A
181	181	director's oath or affirmation of office shall be filed with the
182	182	district and the district shall retain the oath or affirmation in
183	183	the district records. A copy of each director's oath or affirmation
184	184	of office shall be filed with the city's secretary.
185	185	Sec. 3871.056. OFFICERS. The board shall elect from among
186	186	the directors a chair, a vice chair, and a secretary. The offices
187	187	of chair and secretary may not be held by the same person
188	188	concurrently.
189	189	Sec. 3871.057. COMPENSATION; EXPENSES; LIABILITY INSURANCE
190	190	FOR DIRECTORS. (a) The district may compensate each director in an
191	191	amount not to exceed $50 for each board meeting. The total amount
192	192	of compensation for each director in one year may not exceed $2,000.
193	193	(b) Directors are entitled to reimbursement for necessary
194	194	and reasonable expenses incurred in carrying out the duties and
195	195	responsibilities of the board.
196	196	(c) The district may obtain and pay for comprehensive
197	197	general liability insurance coverage from a commercial insurance
198	198	company or other source that protects and insures a director
199	199	against personal liability and from any and all claims relating to:
200	200	(1) actions taken by the director in the director's
201	201	capacity as a member of the board;
202	202	(2) actions and activities taken by the district; or
203	203	(3) the actions of others acting on behalf of the
204	204	district.
205	205	Sec. 3871.058. CONFLICTS OF INTEREST. (a) A director,
206	206	including a director who qualifies under Section 3871.053(a)(2),
207	207	(3), (4), or (5), may participate in all board votes and decisions
208	208	if the director complies with the requirements of Subsection (b).
209	209	(b) A director shall comply with Section 171.004, Local
210	210	Government Code, including the disclosure and abstention
211	211	requirements of that section. A director must file a copy of the
212	212	director's disclosure affidavit required by Section 171.004, Local
213	213	Government Code, with the city's secretary before participating in
214	214	a board discussion or vote.
215	215	Sec. 3871.059. INITIAL DIRECTORS. (a) The initial board
216	216	consists of the following directors:
217	217	(1) Place 1: a director who qualifies under Section
218	218	3871.053(a)(2), (3), (4), or (5);
219	219	(2) Place 2: a director who qualifies under Section
220	220	3871.053(a)(2), (3), (4), or (5);
221	221	(3) Place 3: a director who qualifies under Section
222	222	3871.053(a)(2), (3), (4), or (5);
223	223	(4) Place 4: a director who qualifies under Section
224	224	3871.053(a)(1);
225	225	(5) Place 5: a director who qualifies under Section
226	226	3871.053(a)(1);
227	227	(6) Place 6: a director who qualifies under Section
228	228	3871.053(a)(2), (3), (4), or (5);
229	229	(7) Place 7: a city employee;
230	230	(8) Place 8: a city employee; and
231	231	(9) Place 9: a city employee.
232	232	(b) Of the initial directors, the terms of directors
233	233	appointed for Places 1, 2, 3, and 4 expire July 1, 2011, and the
234	234	terms of directors appointed for Places 5, 6, 7, 8, and 9 expire
235	235	July 1, 2013.
236	236	(c) This section expires September 1, 2013.

238	238	SUBCHAPTER C. POWERS AND DUTIES
239	239	Sec. 3871.101. GENERAL POWERS AND DUTIES. The district has
240	240	the powers and duties provided by this chapter and by:
241	241	(1) the general laws relating to conservation and
242	242	reclamation districts created under Section 59, Article XVI, Texas
243	243	Constitution, including Chapters 49 and 54, Water Code, except that
244	244	the district's bonds and other securities are not subject to the
245	245	jurisdiction or supervision of the Texas Commission on
246	246	Environmental Quality under Chapter 49, Water Code, or other law;
247	247	(2) the general laws relating to road districts and
248	248	road utility districts created under Section 52(b), Article III,
249	249	Texas Constitution, including Chapter 441, Transportation Code,
250	250	except that the district may exercise any power granted by this
251	251	chapter without regard to any provision or requirement of or
252	252	procedure prescribed by Chapter 441, Transportation Code;
253	253	(3) Subchapter A, Chapter 372, Local Government Code,
254	254	in the same manner as a municipality or a county;
255	255	(4) Chapter 1371, Government Code;
256	256	(5) Chapter 375, Local Government Code; and
257	257	(6) Chapter 311, Tax Code.
258	258	Sec. 3871.102. IMPROVEMENT PROJECTS. (a) The district may
259	259	provide, or it may enter into contracts with a governmental or
260	260	private entity to provide, the following types of improvement
261	261	projects located in the district or activities in support of or
262	262	incidental to those projects:
263	263	(1) a supply and distribution facility or system to
264	264	provide potable and nonpotable water to the residents and
265	265	businesses of the district, including a wastewater collection
266	266	facility;
267	267	(2) a paved, macadamized, or graveled road, street, or
268	268	turnpike, inside and outside the district, to the full extent
269	269	authorized by Section 52, Article III, Texas Constitution;
270	270	(3) the planning, design, construction, improvement,
271	271	and maintenance of:
272	272	(A) landscaping;
273	273	(B) highway right-of-way or transit corridor
274	274	beautification and improvement;
275	275	(C) lighting, banners, and signs;
276	276	(D) a street or sidewalk;
277	277	(E) a hiking and cycling path or trail;
278	278	(F) a pedestrian walkway, skywalk, crosswalk, or
279	279	tunnel;
280	280	(G) a park, lake, garden, recreational facility,
281	281	community activities center, dock, wharf, sports facility, open
282	282	space, scenic area, or related exhibit or preserve;
283	283	(H) a fountain, plaza, or pedestrian mall; or
284	284	(I) a drainage or storm-water detention
285	285	improvement;
286	286	(4) protection and improvement of the quality of storm
287	287	water that flows through the district;
288	288	(5) the planning, design, construction, improvement,
289	289	maintenance, and operation of:
290	290	(A) a water or sewer facility; or
291	291	(B) an off-street parking facility or heliport;
292	292	(6) the planning and acquisition of:
293	293	(A) public art and sculpture and related exhibits
294	294	and facilities; or
295	295	(B) an educational facility, and a cultural
296	296	exhibit or facility;
297	297	(7) the planning, design, construction, acquisition,
298	298	lease, rental, improvement, maintenance, installation, and
299	299	management of and provision of furnishings for a facility for:
300	300	(A) a conference, convention, or exhibition;
301	301	(B) a manufacturer, consumer, or trade show;
302	302	(C) a civic, community, or institutional event;
303	303	or
304	304	(D) an exhibit, display, attraction, special
305	305	event, or seasonal or cultural celebration or holiday;
306	306	(8) the removal, razing, demolition, or clearing of
307	307	land or improvements in connection with improvement projects;
308	308	(9) the acquisition and improvement of land or other
309	309	property for the mitigation of the environmental effects of an
310	310	improvement project if those costs are incurred in accordance with
311	311	a development agreement and reimbursement of those costs is
312	312	conditioned on the completion of substantial vertical development,
313	313	or the costs are related to a transit or mobility project;
314	314	(10) the acquisition of property or an interest in
315	315	property in connection with one or more authorized improvement
316	316	projects, including a project authorized by Subchapter A, Chapter
317	317	372, Local Government Code;
318	318	(11) a special or supplemental service for the
319	319	improvement and promotion of the district or an area adjacent to the
320	320	district or for the protection of public health and safety in or
321	321	adjacent to the district, including:
322	322	(A) advertising;
323	323	(B) promotion;
324	324	(C) tourism;
325	325	(D) health and sanitation;
326	326	(E) public safety;
327	327	(F) security;
328	328	(G) fire protection or emergency medical
329	329	services;
330	330	(H) business recruitment;
331	331	(I) elimination of traffic congestion, including
332	332	by use of rail services; and
333	333	(J) recreational, educational, or cultural
334	334	improvements, enhancements, and services; or
335	335	(12) any similar public improvement, facility, or
336	336	service.
337	337	(b) The district may not undertake an improvement project
338	338	under this section unless the board determines the project to be
339	339	necessary to accomplish a public purpose of the district and has
340	340	received the approval of the city under Section 3871.160.
341	341	(c) An improvement project must comply with any applicable
342	342	codes and ordinances of the city.
343	343	(d) The district may not provide, conduct, or authorize an
344	344	improvement project on the city streets, highways, rights-of-way,
345	345	or easements without the consent of the governing body of the city.
346	346	(e) Subject to an agreement between the district and the
347	347	city, the city may:
348	348	(1) by ordinance, order, or resolution require that
349	349	title to all or any portion of an improvement project vest in the
350	350	city; or
351	351	(2) unless prohibited by Subsection (h), by ordinance,
352	352	order, resolution, or other directive, authorize the district to
353	353	own, encumber, maintain, and operate an improvement project,
354	354	subject to the right of the city to order a conveyance of the
355	355	improvement project to the city on a date determined by the city.
356	356	(f) The district shall immediately comply with any city
357	357	ordinance, order, or resolution adopted under Subsection (e).
358	358	(g) For the purposes of this section, planning, design,
359	359	construction, improvement, and maintenance of a lake includes work
360	360	done for drainage, reclamation, or recreation.
361	361	(h) Waterworks and sanitary sewer improvements may be
362	362	undertaken by the district inside or outside the boundaries of the
363	363	district, subject to the following conditions:
364	364	(1) the city shall request that waterworks or sanitary
365	365	sewer improvements be funded by the district;
366	366	(2) the city shall construct, own, operate, and
367	367	maintain the improvements; and
368	368	(3) the district shall comply with Sections 3871.152,
369	369	3871.157, and 3871.160 as a condition for the district to fund the
370	370	improvements.
371	371	Sec. 3871.103. GENERAL POWERS REGARDING CONTRACTS. (a)
372	372	The district may:
373	373	(1) contract with any person to accomplish any
374	374	district purpose, including a contract for:
375	375	(A) the payment, repayment, or reimbursement of
376	376	costs incurred by that person on behalf of the district, including
377	377	all or part of the costs of any improvement project and interest on
378	378	the reimbursed cost; or
379	379	(B) the use, occupancy, lease, rental,
380	380	operation, maintenance, or management of all or part of a proposed
381	381	or existing improvement project; and
382	382	(2) apply for and contract with any person to receive,
383	383	administer, and perform a duty or obligation of the district under a
384	384	federal, state, local, or private gift, grant, loan, conveyance,
385	385	transfer, bequest, or other financial assistance arrangement
386	386	relating to the investigation, planning, analysis, study, design,
387	387	acquisition, construction, improvement, completion,
388	388	implementation, or operation by the district or others of a
389	389	proposed or existing improvement project.
390	390	(b) A contract the district enters into to carry out a
391	391	purpose of this chapter may be on any terms and for any period the
392	392	board determines, including a negotiable or nonnegotiable note or
393	393	warrant payable to the city, Dallas County, or any other person.
394	394	(c) Any person may contract with the district to carry out
395	395	the purposes of this chapter without further statutory or other
396	396	authorization.
397	397	Sec. 3871.104. RULES; ENFORCEMENT. (a) The district may
398	398	adopt rules:
399	399	(1) to administer or operate the district;
400	400	(2) for the use, enjoyment, availability, protection,
401	401	security, and maintenance of the district's property and
402	402	facilities; or
403	403	(3) to provide for public safety and security in the
404	404	district.
405	405	(b) The district may enforce its rules by injunctive relief.
406	406	(c) To the extent a district rule conflicts with a city
407	407	rule, order, or regulation, the city rule, order, or regulation
408	408	controls.
409	409	(d) The district shall provide the city with written notice
410	410	not later than the 30th day before the date of a meeting at which the
411	411	board will adopt rules. The district may not adopt a rule affecting
412	412	the use of a municipally owned asset, such as a public park, street,
413	413	sidewalk, transit facility, or public right-of-way, unless the
414	414	governing body of the city has approved the rule by ordinance,
415	415	order, or resolution.
416	416	Sec. 3871.105. NAME CHANGE. The board by resolution may
417	417	change the district's name. The board shall give written notice of
418	418	the change to the city.
419	419	Sec. 3871.106. ADDING OR REMOVING TERRITORY. The board may
420	420	add or remove territory under Subchapter J, Chapter 49, Water Code,
421	421	and Section 54.016, Water Code, except that:
422	422	(1) the addition or removal of the territory must be
423	423	approved by:
424	424	(A) the governing body of the city by ordinance,
425	425	order, or resolution; and
426	426	(B) the owners of the territory being added or
427	427	removed;
428	428	(2) a reference to a tax in Subchapter J, Chapter 49,
429	429	Water Code, or Section 54.016, Water Code, means an ad valorem tax;
430	430	and
431	431	(3) territory may not be removed from the district if
432	432	bonds or other obligations of the district payable wholly or partly
433	433	from ad valorem taxes or assessments levied or assessed on the
434	434	territory are outstanding.
435	435	Sec. 3871.107. ECONOMIC DEVELOPMENT. (a) The district may
436	436	create economic development and other programs under Section 52-a,
437	437	Article III, Texas Constitution, and may impose and collect ad
438	438	valorem taxes for those purposes. The district has the economic
439	439	development powers that Chapter 380, Local Government Code,
440	440	provides to a municipality with a population of more than 100,000.
441	441	Each economic development program and each project that will
442	442	receive public funds under an economic development program must be
443	443	approved by the governing body of the city by ordinance, order, or
444	444	resolution.
445	445	(b) The district shall provide the city written notice not
446	446	later than the 30th day before the date of a meeting at which the
447	447	board will adopt terms of an economic development program. The
448	448	district may not adopt an economic development program or
449	449	improvement project to be funded under an economic development
450	450	program unless the governing body of the city has approved the
451	451	program or improvement project by ordinance, order, or resolution.
452	452	Sec. 3871.108. NO EMINENT DOMAIN POWER. The district may
453	453	not exercise the power of eminent domain.
454	454	Sec. 3871.109. TERMS OF EMPLOYMENT; COMPENSATION. The
455	455	board may employ and establish the terms of employment and
456	456	compensation of an executive director or general manager and any
457	457	other district employees the board considers necessary. An
458	458	employee may not receive annual compensation of more than $150,000
459	459	from public funds of the district.
460	460	Sec. 3871.110. NOTICE TO PROPERTY OWNERS. (a) The board
461	461	shall annually provide owners of real property in the district
462	462	written notice that specifies the tax of the district for the
463	463	district's next fiscal year in sufficient clarity to describe the
464	464	tax rate for the operation and maintenance of the district and the
465	465	tax rate for the payment of debt service of obligations issued or
466	466	incurred by the district. The written notice must be sent by first
467	467	class United States mail, postage prepaid, to the current address
468	468	of the property owner as reflected on the tax rolls of the appraisal
469	469	district.
470	470	(b) The notice must clearly state that the tax rates on real
471	471	property imposed in the district are in addition to the ad valorem
472	472	taxes imposed by other taxing units that tax real property in the
473	473	boundaries of the district.
474	474	(c) The district shall generate and implement a program to
475	475	provide notification to a prospective purchaser of property in the
476	476	district of the rates of tax and assessments that have been approved
477	477	and are imposed by the district.

479	479	SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
480	480	Sec. 3871.151. GENERAL POWERS REGARDING FINANCIAL MATTERS.
481	481	(a) Except as provided by Section 3871.160, the district may:
482	482	(1) impose an ad valorem tax on all taxable industrial
483	483	and commercial property in the district to pay for any improvement
484	484	projects of the types authorized by Section 52(b), Article III, and
485	485	Section 59, Article XVI, Texas Constitution, and to secure the
486	486	payment of bonds issued for those purposes;
487	487	(2) impose an assessment on property in the district
488	488	to pay the cost of any authorized improvement project and the cost
489	489	of the maintenance of the project in the manner provided for:
490	490	(A) a district under Subchapters A, E, and F,
491	491	Chapter 375, Local Government Code; or
492	492	(B) a municipality or county under Subchapter A,
493	493	Chapter 372, Local Government Code;
494	494	(3) provide or secure the payment or repayment of any
495	495	bond, note, or other temporary or permanent obligation or
496	496	reimbursement or other contract with any person, the costs and
497	497	expenses of the establishment, administration, and operation of the
498	498	district, and the district's costs or share of the costs or revenue
499	499	of an improvement project or district contractual obligation or
500	500	indebtedness by or through:
501	501	(A) the imposition of an ad valorem tax,
502	502	assessment, user fee, concession fee, or rental charge; and
503	503	(B) any other revenue or resources of the
504	504	district, or other revenue authorized by the city, including
505	505	revenue from a tax increment reinvestment zone created by the city
506	506	under applicable law;
507	507	(4) establish user charges related to the operation of
508	508	storm-water facilities, including the regulation of storm water for
509	509	the protection of water quality in the district;
510	510	(5) establish user charges for the use of nonpotable
511	511	water for irrigation purposes, subject to the approval of the
512	512	governing body of the city;
513	513	(6) undertake separately or jointly with other
514	514	persons, including the city or Dallas County, all or part of the
515	515	cost of any improvement project, including an improvement project:
516	516	(A) for improving, enhancing, and supporting
517	517	public safety and security, fire protection and emergency medical
518	518	services, and law enforcement in and adjacent to the district; or
519	519	(B) that confers a general benefit on the entire
520	520	district or a special benefit on a definable part of the district;
521	521	and
522	522	(7) enter into a tax abatement agreement in accordance
523	523	with the general laws of this state authorizing and applicable to
524	524	tax abatement agreements by municipalities.
525	525	(b) The district may not impose an ad valorem tax to pay for
526	526	an improvement project under this chapter unless the imposition is
527	527	approved by the voters of the district voting at an election held
528	528	for that purpose. The board may call an election to approve the
529	529	imposition of an ad valorem tax to pay for an improvement project
530	530	under this chapter only if the board receives a petition requesting
531	531	the election signed by:
532	532	(1) more than 65 percent of the record owners of real
533	533	property in the district subject to taxation; or
534	534	(2) owners representing more than 65 percent of the
535	535	appraised value of real property in the district subject to
536	536	taxation, as determined by the tax rolls of the appraisal district.
537	537	Sec. 3871.152. BORROWING MONEY. (a) The district may
538	538	borrow money for a district purpose by issuing or executing bonds,
539	539	notes, credit agreements, or other obligations of any kind found by
540	540	the board to be necessary or appropriate for any district purpose.
541	541	The bond, note, credit agreement, or other obligation may be
542	542	secured by and payable from ad valorem taxes, assessments, a
543	543	combination of ad valorem taxes and assessments, or other district
544	544	revenue. The governing body of the city must approve the issuance
545	545	of bonds, notes, credit agreements, or other obligations of the
546	546	district, in general terms before the preparation of preliminary
547	547	official statements or loan closing documents, as provided by the
548	548	development and operating agreement approved by the city in
549	549	accordance with Section 3871.160, or by separate action.
550	550	(b) The governing body of the city must approve the final
551	551	terms of the bond issuance, note, or credit facility, including the
552	552	principal amount, note amount, interest rate or rates, redemption
553	553	provisions, and other terms and conditions relating to the
554	554	issuance.
555	555	(c) The district shall file annual audited financial
556	556	statements with the city's secretary.
557	557	Sec. 3871.153. ASSESSMENTS; EXEMPTION. (a) The district
558	558	may impose an assessment on property in the district, including an
559	559	assessment on commercial, industrial, or office property, only in
560	560	the manner provided by Subchapter A, Chapter 372, Local Government
561	561	Code, or Subchapter F, Chapter 375, Local Government Code, for a
562	562	municipality, county, or public improvement district, according to
563	563	the benefit received by the property.
564	564	(b) An assessment on property must be for the limited
565	565	purpose of providing capital funding for:
566	566	(1) public water and wastewater facilities;
567	567	(2) drainage and storm-water facilities;
568	568	(3) streets and alleys; and
569	569	(4) any authorized purpose under Chapter 372, Local
570	570	Government Code.
571	571	(c) An assessment, a reassessment, or an assessment
572	572	resulting from an addition to or correction of the assessment roll
573	573	by the district, penalties and interest on an assessment or
574	574	reassessment, an expense of collection, and reasonable attorney's
575	575	fees incurred by the district:
576	576	(1) are a first and prior lien against the property
577	577	assessed; and
578	578	(2) are superior to any other lien or claim other than
579	579	a lien or claim for county, school district, or municipal ad valorem
580	580	taxes.
581	581	(d) A lien of an assessment against property under this
582	582	chapter runs with the land, and the portion of an assessment payment
583	583	obligation that has not yet come due is not eliminated by the
584	584	foreclosure of an ad valorem tax lien. Any purchaser of property in
585	585	a foreclosure of an ad valorem tax lien takes the property subject
586	586	to the assessment payment obligations that have not yet come due and
587	587	to the lien and terms of payment under the applicable assessment
588	588	ordinance or order.
589	589	(e) The board may make a correction to or deletion from the
590	590	assessment roll that does not increase the amount of assessment of
591	591	any parcel of land without providing notice and holding a hearing in
592	592	the manner required for additional assessments.
593	593	(f) The district shall file notice of any tax or assessment
594	594	imposed by the district with the county clerk of Dallas County and
595	595	post the notice on the district's Internet website.
596	596	Sec. 3871.154. RESIDENTIAL PROPERTY EXEMPT. The district
597	597	may not impose taxes, assessments, fees, or any other requirement
598	598	for payment, construction, alteration, or dedication on
599	599	single-family detached residential property, residential
600	600	condominiums, duplexes, triplexes, and quadruplexes.
601	601	Sec. 3871.155. MAINTENANCE AND OPERATION TAX; ELECTION.
602	602	(a) The district may impose a tax for maintenance and operation
603	603	purposes, including for:
604	604	(1) planning, constructing, acquiring, maintaining,
605	605	repairing, and operating all improvement projects, including land,
606	606	plants, works, facilities, improvements, appliances, and equipment
607	607	of the district; and
608	608	(2) paying costs of services, engineering and legal
609	609	fees, and organization and administrative expenses, including
610	610	expenses of the city payable under the terms of the project
611	611	development agreement described by Section 3871.160.
612	612	(b) The district may not impose a maintenance and operation
613	613	tax for improvement projects under this chapter unless the
614	614	imposition of the tax is approved by the voters of the district
615	615	voting at an election held for that purpose. An election may be
616	616	called only on receipt of a petition as provided by Section
617	617	3871.151(b).
618	618	(c) A maintenance and operation tax election may be held at
619	619	the same time and in conjunction with any other district election.
620	620	The election may be called by a separate election order or as part
621	621	of any other election order.
622	622	Sec. 3871.156. USE OF SURPLUS MAINTENANCE AND OPERATION
623	623	MONEY. If the district has surplus maintenance and operation tax
624	624	money that is not needed for the purposes for which it was
625	625	collected, the money may be used for any authorized purpose.
626	626	Sec. 3871.157. BONDS AND OTHER OBLIGATIONS. (a) Subject to
627	627	the requirements of Sections 3871.159 and 3871.160, the district
628	628	may issue by public or private sale bonds, notes, or other
629	629	obligations payable wholly or partly from ad valorem taxes, or by
630	630	assessments in the manner provided by Subchapter A, Chapter 372,
631	631	Local Government Code, or Subchapter J, Chapter 375, Local
632	632	Government Code.
633	633	(b) In exercising the district's borrowing power, the
634	634	district may issue a bond or other obligation in the form of a bond,
635	635	note, certificate of participation or other instrument evidencing a
636	636	proportionate interest in payments to be made by the district, or
637	637	any other type of obligation.
638	638	(c) In addition to the sources of money described by
639	639	Subchapter A, Chapter 372, Local Government Code, and Subchapter J,
640	640	Chapter 375, Local Government Code, district bonds may be secured
641	641	and made payable wholly or partly by a pledge of any part of the
642	642	money the district receives from system or improvement project
643	643	revenue or from any other source.
644	644	Sec. 3871.158. BOND MATURITY. Bonds may mature not more
645	645	than 40 years from their date of issue.
646	646	Sec. 3871.159. TAXES FOR BONDS AND OTHER OBLIGATIONS. At
647	647	the time bonds or other obligations payable wholly or partly from ad
648	648	valorem taxes are issued:
649	649	(1) the board shall impose a continuing direct annual
650	650	ad valorem tax for each year that all or part of the bonds are
651	651	outstanding; and
652	652	(2) the district annually shall impose an ad valorem
653	653	tax on all taxable property in the district in an amount sufficient
654	654	to:
655	655	(A) pay the interest on the bonds or other
656	656	obligations as the interest becomes due; and
657	657	(B) create a sinking fund for the payment of the
658	658	principal of the bonds or other obligations when due or the
659	659	redemption price at any earlier required redemption date.
660	660	Sec. 3871.160. DEVELOPMENT AND OPERATING AGREEMENT
661	661	REQUIRED. (a) After the district's board is organized, but before
662	662	the district may undertake any improvement project, issue bonds,
663	663	impose taxes, levy assessments or fees, or borrow money, the
664	664	district and the city must negotiate and execute a mutually
665	665	approved and accepted development and operating agreement,
666	666	including any limitations imposed by the city, regarding the plans
667	667	and rules for:
668	668	(1) the exercise of the powers granted to the district
669	669	under this chapter, including the organization, development, and
670	670	operation of the district;
671	671	(2) the selection and description of improvement
672	672	projects that may be undertaken and financed by the district and the
673	673	ownership, operation, and maintenance of those projects;
674	674	(3) the terms, conditions, methods, means, and amounts
675	675	of financing authorized by this chapter that the district may use in
676	676	providing improvement projects; and
677	677	(4) the amounts, methods, and times of reimbursement
678	678	to the city for costs and expenses, if any, incurred by the city
679	679	with respect to the development and operation of the district and
680	680	the financing of improvement projects by the district.
681	681	(b) An agreement authorized by this section is not effective
682	682	until its terms and execution are approved by the board and the
683	683	governing body of the city by resolution.

685	685	SUBCHAPTER E. DISSOLUTION
686	686	Sec. 3871.251. DISSOLUTION BY CITY ORDINANCE. (a) The city
687	687	by ordinance may dissolve the district.
688	688	(b) The city may not dissolve the district until the
689	689	district's outstanding indebtedness or contractual obligations
690	690	that are payable from ad valorem taxes have been repaid or
691	691	discharged, or the city has affirmatively assumed the obligation to
692	692	pay the outstanding indebtedness from the city's lawfully available
693	693	revenue.
694	694	(c) The city may not dissolve the district until the
695	695	agreement under Section 3871.160 has been executed and the
696	696	district's performance under the agreement has been fulfilled,
697	697	including any right or obligation the district has to reimburse a
698	698	developer or owner for the costs of improvement projects.
699	699	Sec. 3871.252. COLLECTION OF ASSESSMENTS AND OTHER REVENUE.
700	700	(a) If the dissolved district has bonds or other obligations
701	701	outstanding secured by and payable from assessments or other
702	702	revenue, other than ad valorem taxes, the city shall succeed to the
703	703	rights and obligations of the district regarding enforcement and
704	704	collection of the assessments or other revenue.
705	705	(b) The city shall have and exercise all district powers to
706	706	enforce and collect the assessments or other revenue to pay:
707	707	(1) the bonds or other obligations when due and
708	708	payable according to their terms; or
709	709	(2) special revenue or assessment bonds or other
710	710	obligations issued by the city to refund the outstanding bonds or
711	711	obligations.
712	712	Sec. 3871.253. CONCURRENCE ON ADDITIONAL POWERS. If the
713	713	legislature grants the district a power that is in addition to the
714	714	powers approved by the initial resolution of the governing body of
715	715	the city consenting to the creation of the district, the district
716	716	may not exercise that power unless the governing body of the city
717	717	consents to that change by resolution.
718	718	Sec. 3871.254. ASSUMPTION OF ASSETS AND LIABILITIES. (a)
719	719	After the city dissolves the district, the city assumes, subject to
720	720	the appropriation and availability of funds, the obligations of the
721	721	district, including any bonds or other indebtedness payable from
722	722	assessments or other district revenue.
723	723	(b) If the city dissolves the district, the board shall
724	724	transfer ownership of all district property to the city.
725	725	SECTION 2. The district shall include the land described in
726	726	Subsections (a) and (b), below:
727	727	(a) A 192 acre tract of land situated west of the Dallas
728	728	Central Business District along the western bank of the Trinity
729	729	River Floodway in Dallas County, Texas, with said tract of land
730	730	being more particularly described (in a clockwise manner around the
731	731	boundary) by the following:
732	732	The POINT OF BEGINNING being the northernmost point of the
733	733	District on the northern right of way of Continental Avenue,
734	734	eastern bank of the Trinity River Floodway and the Union Pacific

1331	1331	SECTION 3. (a) The legal notice of the intention to
1332	1332	introduce this Act, setting forth the general substance of this
1333	1333	Act, has been published as provided by law, and the notice and a
1334	1334	copy of this Act have been furnished to all persons, agencies,
1335	1335	officials, or entities to which they are required to be furnished
1336	1336	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
1337	1337	Government Code.
1338	1338	(b) The governor, one of the required recipients, has
1339	1339	submitted the notice and Act to the Texas Commission on
1340	1340	Environmental Quality.
1341	1341	(c) The Texas Commission on Environmental Quality has filed
1342	1342	its recommendations relating to this Act with the governor, the
1343	1343	lieutenant governor, and the speaker of the house of
1344	1344	representatives within the required time.
1345	1345	(d) All requirements of the constitution and laws of this
1346	1346	state and the rules and procedures of the legislature with respect
1347	1347	to the notice, introduction, and passage of this Act are fulfilled
1348	1348	and accomplished.
1349	1349	SECTION 4. This Act takes effect immediately if it receives
1350	1350	a vote of two-thirds of all the members elected to each house, as
1351	1351	provided by Section 39, Article III, Texas Constitution. If this
1352	1352	Act does not receive the vote necessary for immediate effect, this
1353	1353	Act takes effect September 1, 2009.
