66 AN ACT
77 relating to the creation of the Guadalupe County Municipal Utility
88 District No. 3; providing authority to impose a tax and issue bonds;
99 granting a limited power of eminent domain.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1212 Code, is amended by adding Chapter 8358 to read as follows:
1313 CHAPTER 8358. GUADALUPE COUNTY MUNICIPAL UTILITY DISTRICT NO. 3
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8358.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the district's board of directors.
1717 (2) "Director" means a board member.
1818 (3) "District" means the Guadalupe County Municipal
1919 Utility District No. 3.
2020 Sec. 8358.002. NATURE OF DISTRICT. The district is a
2121 municipal utility district created under Section 59, Article XVI,
2222 Texas Constitution.
2323 Sec. 8358.003. CONFIRMATION AND DIRECTORS' ELECTION
2424 REQUIRED. The temporary directors shall hold an election to
2525 confirm the creation of the district and to elect five permanent
2626 directors as provided by Section 49.102, Water Code.
2727 Sec. 8358.004. CONSENT OF MUNICIPALITY REQUIRED. The
2828 temporary directors may not hold an election under Section 8358.003
2929 until each municipality in whose corporate limits or
3030 extraterritorial jurisdiction the district is located has:
3131 (1) consented by ordinance or resolution to the
3232 creation of the district and to the inclusion of land in the
3333 district subsequent to the effective date of the Act creating this
3434 chapter; and
3535 (2) approved and entered into a development agreement
3636 with the owners of land within the district under Section 212.172,
3737 Local Government Code.
3838 Sec. 8358.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
3939 The district is created to serve a public purpose and benefit.
4040 (b) The district is created to accomplish the purposes of:
4141 (1) a municipal utility district as provided by
4242 general law and Section 59, Article XVI, Texas Constitution; and
4343 (2) Section 52, Article III, Texas Constitution, that
4444 relate to the construction, acquisition, improvement, operation,
4545 or maintenance of macadamized, graveled, or paved roads, or
4646 improvements, including storm drainage, in aid of those roads.
4747 Sec. 8358.006. INITIAL DISTRICT TERRITORY. (a) The
4848 district is initially composed of the territory described by
4949 Section 2 of the Act creating this chapter.
5050 (b) The boundaries and field notes contained in Section 2 of
5151 the Act creating this chapter form a closure. A mistake made in the
5252 field notes or in copying the field notes in the legislative process
5353 does not affect the district's:
5454 (1) organization, existence, or validity;
5555 (2) right to issue any type of bond for the purposes
5656 for which the district is created or to pay the principal of and
5757 interest on a bond;
5858 (3) right to impose a tax; or
5959 (4) legality or operation.

6161 SUBCHAPTER B. BOARD OF DIRECTORS
6262 Sec. 8358.051. GOVERNING BODY; TERMS. (a) The district is
6363 governed by a board of five elected directors.
6464 (b) Except as provided by Section 8358.052, directors serve
6565 staggered four-year terms.
6666 Sec. 8358.052. TEMPORARY DIRECTORS. (a) On or after the
6767 effective date of the Act creating this chapter, the owner or owners
6868 of a majority of the assessed value of the real property in the
6969 district may submit a petition to the Texas Commission on
7070 Environmental Quality requesting that the commission appoint as
7171 temporary directors the five persons named in the petition. The
7272 commission shall appoint as temporary directors the five persons
7373 named in the petition.
7474 (b) Temporary directors serve until the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8358.003; or
7777 (2) the fourth anniversary of the effective date of
7878 the Act creating this chapter.
7979 (c) If permanent directors have not been elected under
8080 Section 8358.003 and the terms of the temporary directors have
8181 expired, successor temporary directors shall be appointed or
8282 reappointed as provided by Subsection (d) to serve terms that
8383 expire on the earlier of:
8484 (1) the date permanent directors are elected under
8585 Section 8358.003; or
8686 (2) the fourth anniversary of the date of the
8787 appointment or reappointment.
8888 (d) If Subsection (c) applies, the owner or owners of a
8989 majority of the assessed value of the real property in the district
9090 may submit a petition to the Texas Commission on Environmental
9191 Quality requesting that the commission appoint as successor
9292 temporary directors the five persons named in the petition. The
9393 commission shall appoint as successor temporary directors the five
9494 persons named in the petition.

9696 SUBCHAPTER C. POWERS AND DUTIES
9797 Sec. 8358.101. GENERAL POWERS AND DUTIES. The district has
9898 the powers and duties necessary to accomplish the purposes for
9999 which the district is created.
100100 Sec. 8358.102. MUNICIPAL UTILITY DISTRICT POWERS AND
101101 DUTIES. The district has the powers and duties provided by the
102102 general law of this state, including Chapters 49 and 54, Water Code,
103103 applicable to municipal utility districts created under Section 59,
104104 Article XVI, Texas Constitution.
105105 Sec. 8358.103. AUTHORITY FOR ROAD PROJECTS. Under Section
106106 52, Article III, Texas Constitution, the district may design,
107107 acquire, construct, finance, issue bonds for, improve, operate,
108108 maintain, and convey to this state, a county, or a municipality for
109109 operation and maintenance macadamized, graveled, or paved roads, or
110110 improvements, including storm drainage, in aid of those roads.
111111 Sec. 8358.104. APPROVAL OF ROAD PROJECT. (a) The district
112112 may not undertake a road project authorized by Section 8358.103
113113 unless:
114114 (1) each municipality or county that will operate and
115115 maintain the road has approved the plans and specifications of the
116116 road project; or
117117 (2) the Texas Transportation Commission approves the
118118 plans and specifications of the road project, if the state will
119119 operate and maintain the road.
120120 (b) Except as provided by Subsection (a), the district is
121121 not required to obtain approval from the Texas Transportation
122122 Commission to design, acquire, construct, finance, issue bonds for,
123123 improve, or convey a road project.
124124 Sec. 8358.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
125125 OR RESOLUTION. (a) The district shall comply with all applicable
126126 requirements of any ordinance or resolution that is adopted under
127127 Section 54.016 or 54.0165, Water Code, and that consents to the
128128 creation of the district or to the inclusion of land in the
129129 district.
130130 (b) For purposes of Section 54.016, Water Code, the district
131131 is a city service district for the limited purpose of establishing
132132 consent conditions.
133133 Sec. 8358.106. LIMITATION ON USE OF EMINENT DOMAIN. The
134134 district may not exercise the power of eminent domain outside the
135135 district to acquire a site or easement for:
136136 (1) a road project authorized by Section 8358.103; or
137137 (2) a recreational facility as defined by Section
138138 49.462, Water Code.

141141 Sec. 8358.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
142142 district may issue, without an election, bonds and other
143143 obligations secured by:
144144 (1) revenue other than ad valorem taxes; or
145145 (2) contract payments described by Section 8358.153.
146146 (b) The district must hold an election in the manner
147147 provided by Chapters 49 and 54, Water Code, to obtain voter approval
148148 before the district may impose an ad valorem tax or issue bonds
149149 payable from ad valorem taxes.
150150 (c) The district may not issue bonds payable from ad valorem
151151 taxes to finance a road project unless the issuance is approved by a
152152 vote of a two-thirds majority of the district voters voting at an
153153 election held for that purpose.
154154 Sec. 8358.152. OPERATION AND MAINTENANCE TAX. (a) If
155155 authorized at an election held under Section 8358.151, the district
156156 may impose an operation and maintenance tax on taxable property in
157157 the district in accordance with Section 49.107, Water Code.
158158 (b) The board shall determine the tax rate. The rate may not
159159 exceed the rate approved at the election.
160160 Sec. 8358.153. CONTRACT TAXES. (a) In accordance with
161161 Section 49.108, Water Code, the district may impose a tax other than
162162 an operation and maintenance tax and use the revenue derived from
163163 the tax to make payments under a contract after the provisions of
164164 the contract have been approved by a majority of the district voters
165165 voting at an election held for that purpose.
166166 (b) A contract approved by the district voters may contain a
167167 provision stating that the contract may be modified or amended by
168168 the board without further voter approval.
169169 Sec. 8358.154. ALLOCATION OF TAXES. Section 54.016(f),
170170 Water Code, does not apply to the district.

172172 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
173173 Sec. 8358.201. AUTHORITY TO ISSUE BONDS AND OTHER
174174 OBLIGATIONS. The district may issue bonds or other obligations
175175 payable wholly or partly from ad valorem taxes, impact fees,
176176 revenue, contract payments, grants, or other district money, or any
177177 combination of those sources, to pay for any authorized district
178178 purpose.
179179 Sec. 8358.202. TAXES FOR BONDS. At the time the district
180180 issues bonds payable wholly or partly from ad valorem taxes, the
181181 board shall provide for the annual imposition of a continuing
182182 direct ad valorem tax, without limit as to rate or amount, while all
183183 or part of the bonds are outstanding as required and in the manner
184184 provided by Sections 54.601 and 54.602, Water Code.
185185 Sec. 8358.203. BONDS FOR ROAD PROJECTS. At the time of
186186 issuance, the total principal amount of bonds or other obligations
187187 issued or incurred to finance road projects and payable from ad
188188 valorem taxes may not exceed one-fourth of the assessed value of the
189189 real property in the district.
190190 SECTION 2. The Guadalupe County Municipal Utility District
191191 No. 3 initially includes all the territory contained in the
192192 following area:
193193 A FIELD NOTE DESCRIPTION of 539.0054 acres (23,479,075 square
194194 feet) of land in the J.D. Clements Survey, Abstract No. 11,
195195 Guadalupe County, Texas; said 539.0054 acre tract being all of Lots
196196 1-3, Block 1 of the Project Green Subdivision, according to the map
197197 or plat recorded in Volume 7, Pages 263-264 of the Guadalupe County
198198 Map Records and all of an 87.9012 acre tract, conveyed to A-L 97 IH
199199 10-SH 46, L.P., as recorded in Guadalupe County Clerk's File Nos.
200200 07-22168, 07-022173 & 08-013115; said tract being more particularly
201201 described by metes and bounds as follows with the bearings being
202202 based on the Texas State Plane Coordinate System, South Central
203203 Zone using National Geodetic Survey Continuously Operating
204204 Reference Stations:
205205 BEGINNING at a smooth 5/8-inch iron rod found in the
206206 northwest right-of-way line of Interstate Highway 10 (right-of-way
207207 varies) for the southwest corner of said Lot 3 and for an angle
208208 point of this tract;
209209 THENCE; South 68 42' 28" West - 710.50 feet with the
210210 northwest right-of-way line of said Interstate Highway 10 to a 60d
211211 nail in concrete found for an angle point of this tract;
212212 THENCE; South 58 05' 50" West- 215.79 feet with the northwest
213213 right-of-way line of said Interstate Highway 10 to a 1/2-inch iron
214214 rod with cap stamped 'B&A' found for the most southerly southwest

218218 recorded in Volume 1528, Page 234 of Guadalupe County Deed Records

221221 of said 40 acre tract to a 1/2-inch iron pipe found for an angle

342342 3/4-inch square bar found for an angle point of this tract;
343343 THENCE; South 61 55' 18" West - 999.03 feet with the
344344 northwest right-of-way line of said Interstate Highway 10 to a
345345 1/2-inch iron rod with cap stamped 'Kling' found for an angle point
346346 of this tract;
347347 THENCE; South 69 00' 37" West - 561.36 feet with the
348348 northwest right-of-way line of said Interstate Highway 10 to the
349349 POINT OF BEGINNING and containing 539.0054 acres (23,479,075 square
350350 feet) of land.
351351 SECTION 3. (a) The legal notice of the intention to
352352 introduce this Act, setting forth the general substance of this
353353 Act, has been published as provided by law, and the notice and a
354354 copy of this Act have been furnished to all persons, agencies,
355355 officials, or entities to which they are required to be furnished
356356 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
357357 Government Code.
358358 (b) The governor, one of the required recipients, has
359359 submitted the notice and Act to the Texas Commission on
360360 Environmental Quality.
361361 (c) The Texas Commission on Environmental Quality has filed
362362 its recommendations relating to this Act with the governor, the
363363 lieutenant governor, and the speaker of the house of
364364 representatives within the required time.
365365 (d) All requirements of the constitution and laws of this
366366 state and the rules and procedures of the legislature with respect
367367 to the notice, introduction, and passage of this Act are fulfilled
368368 and accomplished.
369369 SECTION 4. This Act takes effect immediately if it receives
370370 a vote of two-thirds of all the members elected to each house, as
371371 provided by Section 39, Article III, Texas Constitution. If this
372372 Act does not receive the vote necessary for immediate effect, this
373373 Act takes effect September 1, 2009.
