55 relating to the creation of the Montgomery County Water Control and
66 Improvement District No. 2; providing authority to impose a tax and
77 issue bonds; granting a limited power of eminent domain.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle I, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 9041 to read as follows:
1111 CHAPTER 9041. MONTGOMERY COUNTY WATER CONTROL AND IMPROVEMENT
1212 DISTRICT NO. 2
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 9041.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "Director" means a board member.
1717 (3) "District" means the Montgomery County Water
1818 Control and Improvement District No. 2.
1919 Sec. 9041.002. NATURE OF DISTRICT. The district is a water
2020 control and improvement district created under Section 59, Article
2121 XVI, Texas Constitution.
2222 Sec. 9041.003. CONFIRMATION AND DIRECTORS' ELECTION
2323 REQUIRED. The temporary directors shall hold an election to
2424 confirm the creation of the district and to elect five permanent
2525 directors as provided by Section 49.102, Water Code.
2626 Sec. 9041.004. CONSENT OF MUNICIPALITY REQUIRED. The
2727 temporary directors may not hold an election under Section 9041.003
2828 until each municipality in whose corporate limits or
2929 extraterritorial jurisdiction the district is located has
3030 consented by ordinance or resolution to the creation of the
3131 district and to the inclusion of land in the district.
3232 Sec. 9041.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3333 (a) The district is created to serve a public purpose and benefit.
3434 (b) The district is created to accomplish the purposes of a
3535 water control and improvement district as provided by general law
3636 and Section 59, Article XVI, Texas Constitution.
3737 Sec. 9041.006. INITIAL DISTRICT TERRITORY. (a) The
3838 district is initially composed of the territory described by
3939 Section 2 of the Act creating this chapter.
4040 (b) The boundaries and field notes contained in Section 2 of
4141 the Act creating this chapter form a closure. A mistake made in the
4242 field notes or in copying the field notes in the legislative process
4343 does not affect the district's:
4444 (1) organization, existence, or validity;
4545 (2) right to issue any type of bond for the purposes
4646 for which the district is created or to pay the principal of and
4747 interest on a bond;
4848 (3) right to impose a tax; or
4949 (4) legality or operation.

5151 SUBCHAPTER B. BOARD OF DIRECTORS
5252 Sec. 9041.051. GOVERNING BODY; TERMS. (a) The district is
5353 governed by a board of five elected directors.
5454 (b) Except as provided by Section 9041.052, directors serve
5555 staggered four-year terms.
5656 Sec. 9041.052. TEMPORARY DIRECTORS. (a) On or after the
5757 effective date of the Act creating this chapter, the owner or owners
5858 of a majority of the assessed value of the real property in the
5959 district may submit a petition to the Texas Commission on
6060 Environmental Quality requesting that the commission appoint as
6161 temporary directors the five persons named in the petition. The
6262 commission shall appoint as temporary directors the five persons
6363 named in the petition.
6464 (b) Temporary directors serve until the earlier of:
6565 (1) the date permanent directors are elected under
6666 Section 9041.003; or
6767 (2) the fourth anniversary of the effective date of
6868 the Act creating this chapter.
6969 (c) If permanent directors have not been elected under
7070 Section 9041.003 and the terms of the temporary directors have
7171 expired, successor temporary directors shall be appointed or
7272 reappointed as provided by Subsection (d) to serve terms that
7373 expire on the earlier of:
7474 (1) the date permanent directors are elected under
7575 Section 9041.003; or
7676 (2) the fourth anniversary of the date of the
7777 appointment or reappointment.
7878 (d) If Subsection (c) applies, the owner or owners of a
7979 majority of the assessed value of the real property in the district
8080 may submit a petition to the Texas Commission on Environmental
8181 Quality requesting that the commission appoint as successor
8282 temporary directors the five persons named in the petition. The
8383 commission shall appoint as successor temporary directors the five
8484 persons named in the petition.

8686 SUBCHAPTER C. POWERS AND DUTIES
8787 Sec. 9041.101. GENERAL POWERS AND DUTIES. The district has
8888 the powers and duties necessary to accomplish the purposes for
8989 which the district is created.
9090 Sec. 9041.102. WATER CONTROL AND IMPROVEMENT DISTRICT
9191 POWERS AND DUTIES. (a) The district has the powers and duties
9292 provided by the general law of this state, including Chapters 49 and
9393 51, Water Code, applicable to water control and improvement
9494 districts created under Section 59, Article XVI, Texas
9595 Constitution.
9696 (b) The powers and duties authorized under Subsection (a)
9797 shall specifically include the powers authorized under Subchapter
9898 H, Chapter 51, Water Code.
9999 Sec. 9041.103. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
100100 OR RESOLUTION. The district shall comply with all applicable
101101 requirements of any ordinance or resolution that is adopted under
102102 Section 42.042 or 42.0425, Local Government Code, and that consents
103103 to the creation of the district or to the inclusion of land in the
104104 district.
105105 Sec. 9041.104. LIMITATION ON USE OF EMINENT DOMAIN. The
106106 district may not exercise the power of eminent domain outside the
107107 district to acquire a site or easement for a recreational facility
108108 as defined by Section 49.462, Water Code.

110110 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
111111 Sec. 9041.151. ELECTIONS REGARDING TAXES OR BONDS.
112112 (a) The district may issue, without an election, bonds and other
113113 obligations secured by:
114114 (1) revenue other than ad valorem taxes; or
115115 (2) contract payments described by Section 9041.153.
116116 (b) The district must hold an election in the manner
117117 provided by Chapters 49 and 51, Water Code, to obtain voter approval
118118 before the district may impose an ad valorem tax or issue bonds
119119 payable from ad valorem taxes.
120120 Sec. 9041.152. OPERATION AND MAINTENANCE TAX. (a) If
121121 authorized at an election held under Section 9041.151, the district
122122 may impose an operation and maintenance tax on taxable property in
123123 the district in accordance with Section 49.107, Water Code.
124124 (b) The board shall determine the tax rate. The rate may not
125125 exceed the rate approved at the election.
126126 Sec. 9041.153. CONTRACT TAXES. (a) In accordance with
127127 Section 49.108, Water Code, the district may impose a tax other than
128128 an operation and maintenance tax and use the revenue derived from
129129 the tax to make payments under a contract after the provisions of
130130 the contract have been approved by a majority of the district voters
131131 voting at an election held for that purpose.
132132 (b) A contract approved by the district voters may contain a
133133 provision stating that the contract may be modified or amended by
134134 the board without further voter approval.

136136 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
137137 Sec. 9041.201. AUTHORITY TO ISSUE BONDS AND OTHER
138138 OBLIGATIONS. The district may issue bonds or other obligations
139139 payable wholly or partly from ad valorem taxes, impact fees,
140140 revenue, contract payments, grants, or other district money, or any
141141 combination of those sources, to pay for any authorized district
142142 purpose.
143143 Sec. 9041.202. TAXES FOR BONDS. At the time the district
144144 issues bonds payable wholly or partly from ad valorem taxes, the
145145 board shall provide for the annual imposition of a continuing
146146 direct ad valorem tax, without limit as to rate or amount, while all
147147 or part of the bonds are outstanding as required and in the manner
148148 provided by Chapter 51, Water Code.
149149 Sec. 9041.203. BONDS FOR RECREATIONAL FACILITIES. (a) The
150150 district may develop recreational facilities and issue bonds for
151151 the facilities under Chapter 49, Water Code, notwithstanding any
152152 overlap of the district's territory with the territory of one or
153153 more political subdivisions authorized to develop recreational
154154 facilities and issue bonds under Chapter 49, Water Code.
155155 (b) The authority of the district to develop recreational
156156 facilities and issue bonds under this section does not limit the
157157 authority of any other political subdivision whose territory the
158158 territory of the district may overlap, wholly or partly, to develop
159159 recreational facilities and issue bonds under Chapter 49, Water
160160 Code.
161161 SECTION 2. The Montgomery County Water Control and
162162 Improvement District No. 2 initially includes all the territory
163163 contained in the following area:
164164 TRACT 1
165165 All that certain 527.832 acre (22,992,348 square feet) parcel of
166166 land situated in the Joseph A. Parker Survey, Abstract Number 418,
167167 and the R.N. Davis Survey, Abstract Number 161, both in Montgomery
168168 County, Texas, and being a portion of that certain call 1,554.570
169169 acre tract described in a Warranty Deed to Pacific Indio
170170 Properties, Inc. recorded in Clerk's File Number 2006-013955 of the
171171 Official Public Records of Real Property at Montgomery County,
172172 Texas (O.P.R.R.P.M.C.T.), said 527.832 acre tract being more
173173 particularly described by metes and bounds as follows: (All
174174 bearings are referenced to the Texas State Plane Coordinate System,
175175 South Central Zone)
176176 BEGINNING at a 5/8 inch iron rod with plastic cap stamped "D L
177177 HARDY RPLS 4847" found for the northwest corner of that certain call
178178 640.6 acre tract described in a Warranty Deed with Reservation of
179179 Minerals to J.R. Development, Inc., in Clerk's Number 2002-062840
180180 of the O.P.R.R.P.M.C.T.;
181181 THENCE, through and across said 1,554.570 acre tract, the

568568 introduce this Act, setting forth the general substance of this
569569 Act, has been published as provided by law, and the notice and a
570570 copy of this Act have been furnished to all persons, agencies,
571571 officials, or entities to which they are required to be furnished
572572 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
573573 Government Code.
574574 (b) The governor, one of the required recipients, has
575575 submitted the notice and Act to the Texas Commission on
576576 Environmental Quality.
577577 (c) The Texas Commission on Environmental Quality has filed
578578 its recommendations relating to this Act with the governor, the
579579 lieutenant governor, and the speaker of the house of
580580 representatives within the required time.
581581 (d) All requirements of the constitution and laws of this
582582 state and the rules and procedures of the legislature with respect
583583 to the notice, introduction, and passage of this Act are fulfilled

585585 SECTION 4. This Act takes effect immediately if it receives
586586 a vote of two-thirds of all the members elected to each house, as
587587 provided by Section 39, Article III, Texas Constitution. If this
588588 Act does not receive the vote necessary for immediate effect, this
589589 Act takes effect September 1, 2009.
