55 relating to the board of directors of the Greater East End
66 Management District.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 3807.052, Special District Local Laws
99 Code, is amended to read as follows:
1010 Sec. 3807.052. APPOINTMENT OF DIRECTORS. (a) The mayor
1111 and members of the governing body of the City of Houston shall
1212 appoint directors from persons recommended by the board.
1313 Notwithstanding [who meet the qualifications prescribed by]
1414 Subchapter D, Chapter 375, Local Government Code, to be qualified
1515 to serve as director, a person must be at least 18 years of age and:
1616 (1) be a resident of the district; or
1717 (2) have a district business interest.
1818 (b) Appointments to the board must ensure that:
1919 (1) at least 60 percent of the directors are residents
2020 of the district; and
2121 (2) each director who does not reside in the district
2222 has a district business interest.
2323 (c) In this section, "district business interest" means
2424 owning or controlling, directly or indirectly, more than a 10
2525 percent interest in a business entity located in the district.
2626 SECTION 2. Subchapter B, Chapter 3807, Special District
2727 Local Laws Code, is amended by adding Section 3807.053 to read as
2828 follows:
2929 Sec. 3807.053. BOARD OFFICERS. Notwithstanding Section
3030 375.068, Local Government Code, the board shall select a presiding
3131 officer and other officers according to a rotating schedule as
3232 determined by the board. A presiding officer may not serve
3333 consecutive terms.
3434 SECTION 3. (a) The change in law made by this Act applies
3535 only to a person appointed to the board of directors of a municipal
3636 management district on or after the effective date of this Act.
3737 (b) The change in law made by this Act does not affect the
3838 right of a person appointed to the board of directors of a municipal
3939 management district before the effective date of this Act to
4040 continue to serve on the board until the person's term expires.
4141 SECTION 4. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2009.
