| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 3807.052, Special District Local Laws |
|---|
| 9 | 9 | | Code, is amended to read as follows: |
|---|
| 10 | 10 | | Sec. 3807.052. APPOINTMENT OF DIRECTORS. (a) The mayor |
|---|
| 11 | 11 | | and members of the governing body of the City of Houston shall |
|---|
| 12 | 12 | | appoint directors from persons recommended by the board. |
|---|
| 13 | 13 | | Notwithstanding [who meet the qualifications prescribed by] |
|---|
| 14 | 14 | | Subchapter D, Chapter 375, Local Government Code, to be qualified |
|---|
| 15 | 15 | | to serve as director, a person must be at least 18 years of age and: |
|---|
| 16 | 16 | | (1) be a resident of the district; or |
|---|
| 17 | 17 | | (2) have a district business interest. |
|---|
| 18 | 18 | | (b) Appointments to the board must ensure that: |
|---|
| 19 | 19 | | (1) at least 60 percent of the directors are residents |
|---|
| 20 | 20 | | of the district; and |
|---|
| 21 | 21 | | (2) each director who does not reside in the district |
|---|
| 22 | 22 | | has a district business interest. |
|---|
| 23 | 23 | | (c) In this section, "district business interest" means |
|---|
| 24 | 24 | | owning or controlling, directly or indirectly, more than a 10 |
|---|
| 25 | 25 | | percent interest in a business entity located in the district. |
|---|
| 26 | 26 | | SECTION 2. Subchapter B, Chapter 3807, Special District |
|---|
| 27 | 27 | | Local Laws Code, is amended by adding Section 3807.053 to read as |
|---|
| 28 | 28 | | follows: |
|---|
| 29 | 29 | | Sec. 3807.053. BOARD OFFICERS. Notwithstanding Section |
|---|
| 30 | 30 | | 375.068, Local Government Code, the board shall select a presiding |
|---|
| 31 | 31 | | officer and other officers according to a rotating schedule as |
|---|
| 32 | 32 | | determined by the board. A presiding officer may not serve |
|---|
| 33 | 33 | | consecutive terms. |
|---|
| 34 | 34 | | SECTION 3. (a) The change in law made by this Act applies |
|---|
| 35 | 35 | | only to a person appointed to the board of directors of a municipal |
|---|
| 36 | 36 | | management district on or after the effective date of this Act. |
|---|
| 37 | 37 | | (b) The change in law made by this Act does not affect the |
|---|
| 38 | 38 | | right of a person appointed to the board of directors of a municipal |
|---|
| 39 | 39 | | management district before the effective date of this Act to |
|---|
| 40 | 40 | | continue to serve on the board until the person's term expires. |
|---|
| 41 | 41 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 42 | 42 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 43 | 43 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 44 | 44 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 45 | 45 | | Act takes effect September 1, 2009. |
