1010 relating to the creation of the Harris County Municipal Utility
1111 District No. 524; providing authority to impose a tax and issue
1212 bonds; granting a limited power of eminent domain.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1515 Code, is amended by adding Chapter 8354 to read as follows:
1616 CHAPTER 8354. HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 524
1717 SUBCHAPTER A. GENERAL PROVISIONS
1818 Sec. 8354.001. DEFINITIONS. In this chapter:
1919 (1) "Board" means the district's board of directors.
2020 (2) "Director" means a board member.
2121 (3) "District" means the Harris County Municipal
2222 Utility District No. 524.
2323 Sec. 8354.002. NATURE OF DISTRICT. The district is a
2424 municipal utility district created under Section 59, Article XVI,
2525 Texas Constitution.
2626 Sec. 8354.003. CONFIRMATION AND DIRECTORS' ELECTION
2727 REQUIRED. The temporary directors shall hold an election to
2828 confirm the creation of the district and to elect five permanent
2929 directors as provided by Section 49.102, Water Code.
3030 Sec. 8354.004. CONSENT OF MUNICIPALITY REQUIRED. The
3131 temporary directors may not hold an election under Section 8354.003
3232 until each municipality in whose corporate limits or
3333 extraterritorial jurisdiction the district is located has
3434 consented by ordinance or resolution to the creation of the
3535 district and to the inclusion of land in the district.
3636 Sec. 8354.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
3737 (a) The district is created to serve a public purpose and benefit.
3838 (b) The district is created to accomplish the purposes of:
3939 (1) a municipal utility district as provided by
4040 general law and Section 59, Article XVI, Texas Constitution; and
4141 (2) Section 52, Article III, Texas Constitution, that
4242 relate to the construction, acquisition, or improvement of
4343 macadamized, graveled, or paved roads described by Section 54.234,
4444 Water Code, or improvements, including storm drainage, in aid of
4545 those roads.
4646 Sec. 8354.006. INITIAL DISTRICT TERRITORY. (a) The
4747 district is initially composed of the territory described by
4848 Section 2 of the Act creating this chapter.
4949 (b) The boundaries and field notes contained in Section 2 of
5050 the Act creating this chapter form a closure. A mistake made in the
5151 field notes or in copying the field notes in the legislative process
5252 does not affect the district's:
5353 (1) organization, existence, or validity;
5454 (2) right to issue any type of bond for the purposes
5555 for which the district is created or to pay the principal of and
5656 interest on a bond;
5757 (3) right to impose a tax; or
5858 (4) legality or operation.

6060 SUBCHAPTER B. BOARD OF DIRECTORS
6161 Sec. 8354.051. GOVERNING BODY; TERMS. (a) The district is
6262 governed by a board of five elected directors.
6363 (b) Except as provided by Section 8354.052, directors serve
6464 staggered four-year terms.
6565 Sec. 8354.052. TEMPORARY DIRECTORS. (a) On or after the
6666 effective date of the Act creating this chapter, the owner or owners
6767 of a majority of the assessed value of the real property in the
6868 district may submit a petition to the Texas Commission on
6969 Environmental Quality requesting that the commission appoint as
7070 temporary directors the five persons named in the petition. The
7171 commission shall appoint as temporary directors the five persons
7272 named in the petition.
7373 (b) Temporary directors serve until the earlier of:
7474 (1) the date permanent directors are elected under
7575 Section 8354.003; or
7676 (2) the fourth anniversary of the effective date of
7777 the Act creating this chapter.
7878 (c) If permanent directors have not been elected under
7979 Section 8354.003 and the terms of the temporary directors have
8080 expired, successor temporary directors shall be appointed or
8181 reappointed as provided by Subsection (d) to serve terms that
8282 expire on the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 8354.003; or
8585 (2) the fourth anniversary of the date of the
8686 appointment or reappointment.
8787 (d) If Subsection (c) applies, the owner or owners of a
8888 majority of the assessed value of the real property in the district
8989 may submit a petition to the Texas Commission on Environmental
9090 Quality requesting that the commission appoint as successor
9191 temporary directors the five persons named in the petition. The
9292 commission shall appoint as successor temporary directors the five
9393 persons named in the petition.

9595 SUBCHAPTER C. POWERS AND DUTIES
9696 Sec. 8354.101. GENERAL POWERS AND DUTIES. The district has
9797 the powers and duties necessary to accomplish the purposes for
9898 which the district is created.
9999 Sec. 8354.102. MUNICIPAL UTILITY DISTRICT POWERS AND
100100 DUTIES. The district has the powers and duties provided by the
101101 general law of this state, including Chapters 49 and 54, Water Code,
102102 applicable to municipal utility districts created under Section 59,
103103 Article XVI, Texas Constitution.
104104 Sec. 8354.103. AUTHORITY FOR ROAD PROJECTS. (a) Under
105105 Section 52, Article III, Texas Constitution, the district may
106106 design, acquire, construct, finance, issue bonds for, improve, and
107107 convey to this state, a county, or a municipality for operation and
108108 maintenance macadamized, graveled, or paved roads described by
109109 Section 54.234, Water Code, or improvements, including storm
110110 drainage, in aid of those roads.
111111 (b) The district may exercise the powers provided by this
112112 section without submitting a petition to or obtaining approval from
113113 the Texas Commission on Environmental Quality as required by
114114 Section 54.234, Water Code.
115115 Sec. 8354.104. APPROVAL OF ROAD PROJECT. (a) The district
116116 may not undertake a road project authorized by Section 8354.103
117117 unless:
118118 (1) each municipality or county that will operate and
119119 maintain the road has approved the plans and specifications of the
120120 road project, if a municipality or county will operate and maintain
121121 the road; or
122122 (2) the Texas Transportation Commission has approved
123123 the plans and specifications of the road project, if the state will
124124 operate and maintain the road.
125125 (b) Except as provided by Subsection (a), the district is
126126 not required to obtain approval from the Texas Transportation
127127 Commission to design, acquire, construct, finance, issue bonds for,
128128 improve, or convey a road project.
129129 Sec. 8354.105. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
130130 OR RESOLUTION. The district shall comply with all applicable
131131 requirements of any ordinance or resolution that is adopted under
132132 Section 54.016 or 54.0165, Water Code, and that consents to the
133133 creation of the district or to the inclusion of land in the
134134 district.
135135 Sec. 8354.106. LIMITATION ON USE OF EMINENT DOMAIN. The
136136 district may not exercise the power of eminent domain outside the
137137 district to acquire a site or easement for:
138138 (1) a road project authorized by Section 8354.103; or
139139 (2) a recreational facility as defined by Section
140140 49.462, Water Code.
141141 Sec. 8354.107. DIVISION OF DISTRICT. (a) The district may
142142 be divided into two or more new districts only if the district:
143143 (1) has no outstanding bonded debt; and
144144 (2) is not imposing ad valorem taxes.
145145 (b) This chapter applies to any new district created by the
146146 division of the district, and a new district has all the powers and
147147 duties of the district.
148148 (c) Any new district created by the division of the district
149149 may not, at the time the new district is created, contain any land
150150 outside the area described by Section 2 of the Act creating this
151151 chapter.
152152 (d) The board, on its own motion or on receipt of a petition
153153 signed by the owner or owners of a majority of the assessed value of
154154 the real property in the district, may adopt an order dividing the
155155 district.
156156 (e) The board may adopt an order dividing the district
157157 before or after the date the board holds an election under Section
158158 8354.003 to confirm the district's creation.
159159 (f) An order dividing the district:
160160 (1) shall:
161161 (A) name each new district;
162162 (B) include the metes and bounds of each new
163163 district;
164164 (C) appoint temporary directors for each new
165165 district, or provide that the owner or owners of a majority of the
166166 assessed value of the real property in each new district may submit
167167 a petition to the Texas Commission on Environmental Quality
168168 requesting that the commission appoint as temporary directors the
169169 five persons named in the petition; and
170170 (D) provide for the division of assets and
171171 liabilities between or among the new districts; and
172172 (2) is subject to a confirmation election in each new
173173 district.
174174 (g) On or before the 30th day after the date of adoption of
175175 an order dividing the district, the district shall file the order
176176 with the Texas Commission on Environmental Quality and record the
177177 order in the real property records of each county in which the
178178 district is located.
179179 (h) Any new district created by the division of the district
180180 shall hold a confirmation and directors' election as required by
181181 Section 8354.003. The results of that election must be filed as
182182 required by Sections 49.102(e) and (f), Water Code. If the voters
183183 of a new district do not confirm the creation of the new district,
184184 the assets, liabilities, territory, and governance of the new
185185 district revert to the original district.
186186 (i) Municipal consent to the creation of the district and to
187187 the inclusion of land in the district granted under Section
188188 8354.004 acts as municipal consent to the creation of any new
189189 district created by the division of the district and to the
190190 inclusion of land in the new district.
191191 (j) Any new district created by the division of the district
192192 must hold an election as required by this chapter to obtain voter
193193 approval before the district may impose a maintenance tax or issue
194194 bonds payable wholly or partly from ad valorem taxes.
195195 Sec. 8354.108. FIREFIGHTING AND EMERGENCY MEDICAL
196196 SERVICES. Subchapter L, Chapter 49, Water Code, applies to the
197197 district.

199199 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
200200 Sec. 8354.151. ELECTIONS REGARDING TAXES OR BONDS.
201201 (a) The district may issue, without an election, bonds and other
202202 obligations secured by:
203203 (1) revenue other than ad valorem taxes; or
204204 (2) contract payments described by Section 8354.153.
205205 (b) The district must hold an election in the manner
206206 provided by Chapters 49 and 54, Water Code, to obtain voter approval
207207 before the district may impose an ad valorem tax or issue bonds
208208 payable from ad valorem taxes.
209209 (c) The district may not issue bonds payable from ad valorem
210210 taxes to finance a road project unless the issuance is approved by a
211211 vote of a two-thirds majority of the district voters voting at an
212212 election held for that purpose.
213213 Sec. 8354.152. OPERATION AND MAINTENANCE TAX. (a) If
214214 authorized at an election held under Section 8354.151, the district
215215 may impose an operation and maintenance tax on taxable property in
216216 the district in accordance with Section 49.107, Water Code.
217217 (b) The board shall determine the tax rate. The rate may not
218218 exceed the rate approved at the election.
219219 Sec. 8354.153. CONTRACT TAXES. (a) In accordance with
220220 Section 49.108, Water Code, the district may impose a tax other than
221221 an operation and maintenance tax and use the revenue derived from
222222 the tax to make payments under a contract after the provisions of
223223 the contract have been approved by a majority of the district voters
224224 voting at an election held for that purpose.
225225 (b) A contract approved by the district voters may contain a
226226 provision stating that the contract may be modified or amended by
227227 the board without further voter approval.

229229 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
230230 Sec. 8354.201. AUTHORITY TO ISSUE BONDS AND OTHER
231231 OBLIGATIONS. The district may issue bonds or other obligations
232232 payable wholly or partly from ad valorem taxes, impact fees,
233233 revenue, contract payments, grants, or other district money, or any
234234 combination of those sources, to pay for any authorized district
235235 purpose.
236236 Sec. 8354.202. TAXES FOR BONDS. At the time the district
237237 issues bonds payable wholly or partly from ad valorem taxes, the
238238 board shall provide for the annual imposition of a continuing
239239 direct ad valorem tax, without limit as to rate or amount, while all
240240 or part of the bonds are outstanding as required and in the manner
241241 provided by Sections 54.601 and 54.602, Water Code.
242242 Sec. 8354.203. BONDS FOR ROAD PROJECTS. At the time of
243243 issuance, the total principal amount of bonds or other obligations
244244 issued or incurred to finance road projects and payable from ad
245245 valorem taxes may not exceed one-fourth of the assessed value of the
246246 real property in the district.
247247 SECTION 2. The Harris County Municipal Utility District No.
248248 524 initially includes all the territory contained in the following
249249 area: 990.804 acres in 5 non-contiguous tracts out of Sections 9,
250250 10, 15, and 16 of Harris County School Land Survey, Abstract No 332,
251251 recorded in Vol 17, Pg 222 of the Deed Records of Harris County,
252252 Texas and including within Tracts 1, 2, 3, and 4 an unnamed 66 foot
253253 roadway as shown on the plat of said Harris County School Land being
254254 granted by Commissioners Award recorded in Vol 7448, Pg 181, HCDR;
255255 said roadway does not exist physically on the ground: (All bearings
256256 used herein are based on Highway Right-of-Way Maps provided by the
257257 Texas Department of Transportation)
258258 Tract 1
259259 A tract or parcel of land containing 255.572 acres (11,132,730
260260 square feet) out of Lots 9, 10, 15, and 16 of Section 9 and Lots 1,
261261 2, 7, & 8 of Section 16 of said Harris County School Land Survey,
262262 Abstract No 332, Harris County, Texas; said 255.572 acres being
263263 that same tract of land called 257.230 acres described by deed
264264 recorded in HCCF No M577056 ("Tract 1", therein) and conveyed to
265265 Delta Troy Interests, Ltd by deed recorded in X381657 and more
266266 particularly described by metes and bounds as follows:
267267 COMMENCING at a State Department of Highways and Public
268268 Transportation Horizontal Control Monument located in the
269269 southerly right-of-way line of U.S. 290, 160.00 feet at right
270270 angles from the centerline, across from Engineers Station

272272 THENCE along said southerly right-of-way line, clockwise,
273273 following the arc of a 1855.86 foot radius curve-to-the-right,

698698 its recommendations relating to this Act with the governor, the
