1111 AN ACT
1212 relating to the creation of the Brown's Ranch Municipal Utility
1313 District No. 1 of Grayson County; providing authority to impose a
1414 tax and issue bonds; granting a limited power of eminent domain.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1717 Code, is amended by adding Chapter 8348 to read as follows:
1818 CHAPTER 8348. BROWN'S RANCH MUNICIPAL UTILITY DISTRICT NO. 1 OF
1919 GRAYSON COUNTY
2020 SUBCHAPTER A. GENERAL PROVISIONS
2121 Sec. 8348.001. DEFINITIONS. In this chapter:
2222 (1) "Board" means the district's board of directors.
2323 (2) "Director" means a board member.
2424 (3) "District" means the Brown's Ranch Municipal
2525 Utility District No. 1 of Grayson County.
2626 Sec. 8348.002. NATURE OF DISTRICT. The district is a
2727 municipal utility district created under Section 59, Article XVI,
2828 Texas Constitution.
2929 Sec. 8348.003. CONFIRMATION AND DIRECTORS' ELECTION
3030 REQUIRED. The temporary directors shall hold an election to
3131 confirm the creation of the district and to elect five permanent
3232 directors as provided by Section 49.102, Water Code.
3333 Sec. 8348.004. CONSENT OF MUNICIPALITY REQUIRED. The
3434 temporary directors may not hold an election under Section 8348.003
3535 until each municipality in whose corporate limits or
3636 extraterritorial jurisdiction the district is located has
3737 consented by ordinance or resolution to the creation of the
3838 district and to the inclusion of land in the district.
3939 Sec. 8348.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT.
4040 (a) The district is created to serve a public purpose and benefit.
4141 (b) The district is created to accomplish the purposes of:
4242 (1) a municipal utility district as provided by
4343 general law and Section 59, Article XVI, Texas Constitution; and
4444 (2) Section 52, Article III, Texas Constitution, that
4545 relate to the construction, acquisition, improvement, operation,
4646 or maintenance of macadamized, graveled, or paved roads, or
4747 improvements, including storm drainage, in aid of those roads.
4848 Sec. 8348.006. INITIAL DISTRICT TERRITORY. (a) The
4949 district is initially composed of the territory described by
5050 Section 2 of the Act creating this chapter.
5151 (b) The boundaries and field notes contained in Section 2 of
5252 the Act creating this chapter form a closure. A mistake made in the
5353 field notes or in copying the field notes in the legislative process
5454 does not affect the district's:
5555 (1) organization, existence, or validity;
5656 (2) right to issue any type of bond for the purposes
5757 for which the district is created or to pay the principal of and
5858 interest on a bond;
5959 (3) right to impose a tax; or
6060 (4) legality or operation.

6262 SUBCHAPTER B. BOARD OF DIRECTORS
6363 Sec. 8348.051. GOVERNING BODY; TERMS. (a) The district is
6464 governed by a board of five elected directors.
6565 (b) Except as provided by Section 8348.052, directors serve
6666 staggered four-year terms.
6767 Sec. 8348.052. TEMPORARY DIRECTORS. (a) On or after
6868 September 1, 2009, the owner or owners of a majority of the assessed
6969 value of the real property in the district may submit a petition to
7070 the Texas Commission on Environmental Quality requesting that the
7171 commission appoint as temporary directors the five persons named in
7272 the petition. The commission shall appoint as temporary directors
7373 the five persons named in the petition.
7474 (b) Temporary directors serve until the earlier of:
7575 (1) the date permanent directors are elected under
7676 Section 8348.003; or
7777 (2) September 1, 2013.
7878 (c) If permanent directors have not been elected under
7979 Section 8348.003 and the terms of the temporary directors have
8080 expired, successor temporary directors shall be appointed or
8181 reappointed as provided by Subsection (d) to serve terms that
8282 expire on the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 8348.003; or
8585 (2) the fourth anniversary of the date of the
8686 appointment or reappointment.
8787 (d) If Subsection (c) applies, the owner or owners of a
8888 majority of the assessed value of the real property in the district
8989 may submit a petition to the Texas Commission on Environmental
9090 Quality requesting that the commission appoint as successor
9191 temporary directors the five persons named in the petition. The
9292 commission shall appoint as successor temporary directors the five
9393 persons named in the petition.

9595 SUBCHAPTER C. POWERS AND DUTIES
9696 Sec. 8348.101. GENERAL POWERS AND DUTIES. The district has
9797 the powers and duties necessary to accomplish the purposes for
9898 which the district is created.
9999 Sec. 8348.102. MUNICIPAL UTILITY DISTRICT POWERS AND
100100 DUTIES. The district has the powers and duties provided by the
101101 general law of this state, including Chapters 49 and 54, Water Code,
102102 applicable to municipal utility districts created under Section 59,
103103 Article XVI, Texas Constitution.
104104 Sec. 8348.103. AUTHORITY FOR ROAD PROJECTS. Under Section
105105 52, Article III, Texas Constitution, the district may design,
106106 acquire, construct, finance, issue bonds for, improve, operate,
107107 maintain, and convey to this state, a county, or a municipality for
108108 operation and maintenance macadamized, graveled, or paved roads, or
109109 improvements, including storm drainage, in aid of those roads.
110110 Sec. 8348.104. ROAD STANDARDS AND REQUIREMENTS. (a) A
111111 road project must meet all applicable construction standards,
112112 zoning and subdivision requirements, and regulations of each
113113 municipality in whose corporate limits or extraterritorial
114114 jurisdiction the road project is located.
115115 (b) If a road project is not located in the corporate limits
116116 or extraterritorial jurisdiction of a municipality, the road
117117 project must meet all applicable construction standards,
118118 subdivision requirements, and regulations of each county in which
119119 the road project is located.
120120 (c) If the state will maintain and operate the road, the
121121 Texas Transportation Commission must approve the plans and
122122 specifications of the road project.
123123 Sec. 8348.105. COSTS OF ROAD PROJECT. The district shall
124124 bear the cost of maintaining, improving, operating, and repairing a
125125 road authorized by Section 8348.103 that is located in the
126126 district, regardless of whether the district conveys the road to
127127 this state, a county, or a municipality.
128128 Sec. 8348.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
129129 OR RESOLUTION. The district shall comply with all applicable
130130 requirements of any ordinance or resolution that is adopted under
131131 Section 54.016 or 54.0165, Water Code, and that consents to the
132132 creation of the district or to the inclusion of land in the
133133 district.
134134 Sec. 8348.107. LIMITATION ON USE OF EMINENT DOMAIN. The
135135 district may not exercise the power of eminent domain outside the
136136 district to acquire a site or easement for:
137137 (1) a road project authorized by Section 8348.103; or
138138 (2) a recreational facility as defined by Section
139139 49.462, Water Code.
140140 Sec. 8348.108. LIMITATION ON ANNEXATION. The district may
141141 not annex land without the written consent by resolution or
142142 ordinance of each municipality in whose corporate limits or
143143 extraterritorial jurisdiction the land is located and the written
144144 consent of each water or sewer service provider that holds a
145145 certificate of public convenience and necessity and whose
146146 certificated service area includes any part of the land.
147147 Sec. 8348.109. DIVISION OF DISTRICT. (a) The district may
148148 be divided into two or more new districts only if the district:
149149 (1) has no outstanding bonded debt; and
150150 (2) is not imposing ad valorem taxes.
151151 (b) This chapter applies to any new district created by the
152152 division of the district, and a new district has all the powers and
153153 duties of the district.
154154 (c) Any new district created by the division of the district
155155 may not, at the time the new district is created, contain any land
156156 outside the area described by Section 2 of the Act creating this
157157 chapter.
158158 (d) The board, on its own motion or on receipt of a petition
159159 signed by the owner or owners of a majority of the assessed value of
160160 the real property in the district, may adopt an order dividing the
161161 district.
162162 (e) The board may adopt an order dividing the district
163163 before or after the date the board holds an election under Section
164164 8348.003 to confirm the district's creation.
165165 (f) An order dividing the district shall:
166166 (1) name each new district;
167167 (2) include the metes and bounds description of the
168168 territory of each new district;
169169 (3) appoint temporary directors for each new district;
170170 and
171171 (4) provide for the division of assets and liabilities
172172 between or among the new districts.
173173 (g) On or before the 30th day after the date of adoption of
174174 an order dividing the district, the district shall file the order
175175 with the Texas Commission on Environmental Quality and record the
176176 order in the real property records of each county in which the
177177 district is located.
178178 (h) Any new district created by the division of the district
179179 shall hold a confirmation and directors' election as required by
180180 Section 8348.003.
181181 (i) Municipal consent to the creation of the district and to
182182 the inclusion of land in the district granted under Section
183183 8348.004 acts as municipal consent to the creation of any new
184184 district created by the division of the district and to the
185185 inclusion of land in the new district.
186186 (j) Any new district created by the division of the district
187187 must hold an election as required by this chapter to obtain voter
188188 approval before the district may impose a maintenance tax or issue
189189 bonds payable wholly or partly from ad valorem taxes.

191191 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
192192 Sec. 8348.151. ELECTIONS REGARDING TAXES OR BONDS.
193193 (a) The district may issue, without an election, bonds and other
194194 obligations secured by:
195195 (1) revenue other than ad valorem taxes; or
196196 (2) contract payments described by Section 8348.153.
197197 (b) The district must hold an election in the manner
198198 provided by Chapters 49 and 54, Water Code, to obtain voter approval
199199 before the district may impose an ad valorem tax or issue bonds
200200 payable from ad valorem taxes.
201201 (c) The district may not issue bonds payable from ad valorem
202202 taxes to finance a road project unless the issuance is approved by a
203203 vote of a two-thirds majority of the district voters voting at an
204204 election held for that purpose.
205205 Sec. 8348.152. OPERATION AND MAINTENANCE TAX. (a) If
206206 authorized at an election held under Section 8348.151, the district
207207 may impose an operation and maintenance tax on taxable property in
208208 the district in accordance with Section 49.107, Water Code.
209209 (b) The board shall determine the tax rate. The rate may not
210210 exceed the rate approved at the election.
211211 Sec. 8348.153. CONTRACT TAXES. (a) In accordance with
212212 Section 49.108, Water Code, the district may impose a tax other than
213213 an operation and maintenance tax and use the revenue derived from
214214 the tax to make payments under a contract after the provisions of
215215 the contract have been approved by a majority of the district voters
216216 voting at an election held for that purpose.
217217 (b) A contract approved by the district voters may contain a
218218 provision stating that the contract may be modified or amended by
219219 the board without further voter approval.

221221 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
222222 Sec. 8348.201. AUTHORITY TO ISSUE BONDS AND OTHER
223223 OBLIGATIONS. The district may issue bonds or other obligations
224224 payable wholly or partly from ad valorem taxes, impact fees,
225225 revenue, contract payments, grants, or other district money, or any
226226 combination of those sources, to pay for any authorized district
227227 purpose.
228228 Sec. 8348.202. TAXES FOR BONDS. At the time the district
229229 issues bonds payable wholly or partly from ad valorem taxes, the
230230 board shall provide for the annual imposition of a continuing
231231 direct ad valorem tax, without limit as to rate or amount, while all
232232 or part of the bonds are outstanding as required and in the manner
233233 provided by Sections 54.601 and 54.602, Water Code.
234234 Sec. 8348.203. BONDS FOR ROAD PROJECTS. At the time of
235235 issuance, the total principal amount of bonds or other obligations
236236 issued or incurred to finance road projects and payable from ad
237237 valorem taxes may not exceed one-fourth of the assessed value of the
238238 real property in the district.
239239 SECTION 2. The Brown's Ranch Municipal Utility District No.
240240 1 of Grayson County initially includes all the territory contained
241241 in the following area:
242242 TRACT 1
243243 BEING a tract of land located in the A.M. CROW SURVEY,
244244 ABSTRACT 291, W.H. CROW SURVEY, ABSTRACT NO. 1539 and the W.H. CROW
245245 SURVEY, ABSTRACT NO. 309, Grayson County, Texas arid being part of a
246246 tract of land described in Deed to Marcus H. Brown and wife, Emma
247247 Lee Brown, recorded in Volume 1481, Page 708, Deed Records, Grayson
248248 County, Texas and all of a tract of land described in Deed to Marcus
249249 Brown, recorded in Volume 2081, Page 657, Deed Records, Grayson
250250 County, Texas and all of a tract of land described in Deed to Marcus
251251 H. Brown, recorded in Volume 2247, Page 744, Deed Records, Grayson
252252 County, Texas, and being more particularly described as follows:
253253 BEGINNING at a railroad spike found at the intersection of

386386 THENCE South 88 degrees 59 minutes 13 seconds East, along the
387387 approximate centerline of said Quail Run Road, a distance of
388388 3564.33 feet to the POINT OF BEGINNING and containing 217.026 acres
389389 of land, more or less.
390390 SECTION 3. (a) The legal notice of the intention to
391391 introduce this Act, setting forth the general substance of this
392392 Act, has been published as provided by law, and the notice and a
393393 copy of this Act have been furnished to all persons, agencies,
394394 officials, or entities to which they are required to be furnished
395395 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
396396 Government Code.
397397 (b) The governor, one of the required recipients, has
398398 submitted the notice and Act to the Texas Commission on
399399 Environmental Quality.
400400 (c) The Texas Commission on Environmental Quality has filed
401401 its recommendations relating to this Act with the governor, the
402402 lieutenant governor, and the speaker of the house of
403403 representatives within the required time.
404404 (d) All requirements of the constitution and laws of this
405405 state and the rules and procedures of the legislature with respect
406406 to the notice, introduction, and passage of this Act are fulfilled
407407 and accomplished.
408408 SECTION 4. This Act takes effect September 1, 2009.
