BILL ANALYSIS Senate Research Center S.B. 2554 By: Hegar Jurisprudence 4/24/2009 As Filed AUTHOR'S / SPONSOR'S STATEMENT OF INTENT Currently, judges serving in the 34th, 86th, 142nd, 238th, 318th, 355th, and 385th district courts are authorized to select their bailiffs. This bill allows the judge of the 130th Judicial District to select a bailiff to serve the court. As proposed, S.B. 2554 amends current law relating to the appointment of a bailiff for the 130th Judicial District. RULEMAKING AUTHORITY This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 53.002(a), Government Code, to authorize the judges of certain district courts, including the 130th district court, to each appoint a bailiff. SECTION 2. Amends Section 53.004(b), Government Code, to make a conforming change. SECTION 3. Amends Section 53.007(a)(1), to make a conforming change. SECTION 4. Amends Section 53.008, to make a conforming change. SECTION 5. Amends Section 53.009(1), Government Code, to entitle each bailiff appointed by a judge of a district court having jurisdiction in Angelina County or a county court at law judge in Angelina County or of the 130th district court, to receive a salary set by the commissioners court of that county in an amount that is not less than the salary of the deputy sheriff regularly assigned to patrol duty in the county. SECTION 6. Effective date: upon passage or September 1, 2009.
