5	5	relating to a bailiff for the 130th District Court.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Subsection (a), Section 53.002, Government Code,
8	8	is amended to read as follows:
9	9	(a) The judges of the 34th, 86th, 130th, 142nd, 238th,
10	10	318th, 355th, and 385th district courts may each appoint a bailiff.
11	11	SECTION 2. Subsection (b), Section 53.004, Government Code,
12	12	is amended to read as follows:
13	13	(b) To be eligible to be appointed bailiff in the 30th,
14	14	78th, 86th, 89th, 130th, or 341st district court, the County Court
15	15	of Harrison County, a court described in Section 53.002(c), a
16	16	district court in Taylor County, or a county court at law of Taylor
17	17	County, a person must be a resident of the county in which the
18	18	person serves the court and must be at least 21 years old.
19	19	SECTION 3. Subsection (a), Section 53.007, Government Code,
20	20	is amended to read as follows:
21	21	(a) This section applies to:
22	22	(1) the 22nd, 34th, 70th, 71st, 86th, 97th, 130th,
23	23	142nd, 161st, 238th, 318th, 341st, 355th, and 385th district
24	24	courts;
25	25	(2) the County Court of Harrison County;
26	26	(3) the criminal district courts of Tarrant County;
27	27	(4) the district courts in Taylor County;
28	28	(5) the courts described in Section 53.002(c), (d),
29	29	(e), or (f);
30	30	(6) the county courts at law of Taylor County;
31	31	(7) the district courts in Tarrant County that give
32	32	preference to criminal cases; and
33	33	(8) the 115th District Court in Upshur County.
34	34	SECTION 4. Section 53.008, Government Code, is amended to
35	35	read as follows:
36	36	Sec. 53.008. OATH. The bailiffs of the 22nd, 34th, 70th,
37	37	86th, 97th, 130th, 142nd, 161st, 238th, 318th, 341st, 355th, and
38	38	385th district courts, the bailiffs of the courts described in
39	39	Section 53.002(c), (d), (e), or (f), the bailiffs and the grand jury
40	40	bailiffs of the district courts in Tarrant County that give
41	41	preference to criminal cases, the bailiffs and grand jury bailiffs
42	42	of the criminal district courts in Tarrant County, the bailiffs of
43	43	the district courts in Taylor County, and the bailiffs of the county
44	44	courts at law of Taylor County shall each swear to the following
45	45	oath, to be administered by the judge: "I solemnly swear that I
46	46	will faithfully and impartially perform all duties as may be
47	47	required of me by law, so help me God."
48	48	SECTION 5. Section 53.009, Government Code, is amended by
49	49	adding Subsection (n) to read as follows:
50	50	(n) A bailiff appointed by the judge of the 130th District
51	51	Court is entitled to receive a salary set by the Commissioners Court
52	52	of Matagorda County in an amount that is not less than the salary of
53	53	a deputy sheriff regularly assigned to patrol duty in that county.
54	54	SECTION 6. This Act takes effect immediately if it receives
55	55	a vote of two-thirds of all the members elected to each house, as
56	56	provided by Section 39, Article III, Texas Constitution. If this
57	57	Act does not receive the vote necessary for immediate effect, this
58	58	Act takes effect September 1, 2009.
