55 relating to a bailiff for the 130th District Court.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Subsection (a), Section 53.002, Government Code,
88 is amended to read as follows:
99 (a) The judges of the 34th, 86th, 130th, 142nd, 238th,
1010 318th, 355th, and 385th district courts may each appoint a bailiff.
1111 SECTION 2. Subsection (b), Section 53.004, Government Code,
1212 is amended to read as follows:
1313 (b) To be eligible to be appointed bailiff in the 30th,
1414 78th, 86th, 89th, 130th, or 341st district court, the County Court
1515 of Harrison County, a court described in Section 53.002(c), a
1616 district court in Taylor County, or a county court at law of Taylor
1717 County, a person must be a resident of the county in which the
1818 person serves the court and must be at least 21 years old.
1919 SECTION 3. Subsection (a), Section 53.007, Government Code,
2020 is amended to read as follows:
2121 (a) This section applies to:
2222 (1) the 22nd, 34th, 70th, 71st, 86th, 97th, 130th,
2323 142nd, 161st, 238th, 318th, 341st, 355th, and 385th district
2424 courts;
2525 (2) the County Court of Harrison County;
2626 (3) the criminal district courts of Tarrant County;
2727 (4) the district courts in Taylor County;
2828 (5) the courts described in Section 53.002(c), (d),
2929 (e), or (f);
3030 (6) the county courts at law of Taylor County;
3131 (7) the district courts in Tarrant County that give
3232 preference to criminal cases; and
3333 (8) the 115th District Court in Upshur County.
3434 SECTION 4. Section 53.008, Government Code, is amended to
3535 read as follows:
3636 Sec. 53.008. OATH. The bailiffs of the 22nd, 34th, 70th,
3737 86th, 97th, 130th, 142nd, 161st, 238th, 318th, 341st, 355th, and
3838 385th district courts, the bailiffs of the courts described in
3939 Section 53.002(c), (d), (e), or (f), the bailiffs and the grand jury
4040 bailiffs of the district courts in Tarrant County that give
4141 preference to criminal cases, the bailiffs and grand jury bailiffs
4242 of the criminal district courts in Tarrant County, the bailiffs of
4343 the district courts in Taylor County, and the bailiffs of the county
4444 courts at law of Taylor County shall each swear to the following
4545 oath, to be administered by the judge: "I solemnly swear that I
4646 will faithfully and impartially perform all duties as may be
4747 required of me by law, so help me God."
4848 SECTION 5. Section 53.009, Government Code, is amended by
4949 adding Subsection (n) to read as follows:
5050 (n) A bailiff appointed by the judge of the 130th District
5151 Court is entitled to receive a salary set by the Commissioners Court
5252 of Matagorda County in an amount that is not less than the salary of
5353 a deputy sheriff regularly assigned to patrol duty in that county.
5454 SECTION 6. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2009.
