O'Brien, Director, Legislative Budget Board     IN RE:SB256 by Estes (Relating to an intercollegiate athletics fee at Midwestern State University.), As Engrossed    No significant fiscal implication to the State is anticipated.  Under provisions of the bill, Midwestern State University may charge an intercollegiate athletics fee in an amount not to exceed the lesser of $10 per semester credit hour or $120 for each regular semester or each summer session of more than six weeks or $60 for each summer session of six weeks or less.  The bill provides that the fee may not be charged unless it is approved by a majority vote of students.  The board may increase the fee above the amounts in the bill if the increase is approved by a majority vote of students and does not exceed 10 percent of the amount of the fee charged in the same semester or term in the preceeding academic year.   The University estimates the maximum revenue that could be generated under the bill, if the fee amounts specified in the bill were charged, would be $1.2 million. The University estimates that if the fee begins in the spring of 2010 at a rate of $5 per semester credit hour and does not increase more than 10 percent annually, 2010 revenue would be approximately $694,691 and 2011 revenue would be $760,731.  Local Government Impact No fiscal implication to units of local government is anticipated.
