88 Municipal Management District; providing authority to impose a tax.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle C, Title 4, Special District Local Laws
1111 Code, is amended by adding Chapter 3858 to read as follows:
1212 CHAPTER 3858. DRIFTWOOD ECONOMIC DEVELOPMENT MUNICIPAL
1313 MANAGEMENT DISTRICT
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 3858.001. DEFINITIONS. In this chapter:
1616 (1) "Board" means the board of directors of the
1717 district.
1818 (2) "Commissioners court" means the Hays County
1919 Commissioners Court.
2020 (3) "District" means the Driftwood Economic
2121 Development Municipal Management District.
2222 Sec. 3858.002. CREATION AND NATURE OF DISTRICT. The
2323 district is a special district created under Section 59, Article
2424 XVI, Texas Constitution.
2525 Sec. 3858.003. PURPOSE; LEGISLATIVE FINDINGS. (a) The
2626 creation of the district is essential to accomplish the purposes of
2727 Sections 52 and 52-a, Article III, and Section 59, Article XVI,
2828 Texas Constitution, and other public purposes stated in this
2929 chapter. By creating the district, the legislature has established
3030 a program to accomplish the public purposes set out in Section 52-a,
3131 Article III, Texas Constitution.
3232 (b) The creation of the district is necessary to promote,
3333 develop, encourage, and maintain employment, commerce,
3434 transportation, housing, tourism, recreation, the arts,
3535 entertainment, economic development, safety, and the public
3636 welfare in the district.
3737 (c) This chapter and the creation of the district may not be
3838 interpreted to relieve Hays County from providing the level of
3939 services provided as of the effective date of the Act enacting this
4040 chapter to the area in the district. The district is created to
4141 supplement and not supplant county services provided in the
4242 district.
4343 Sec. 3858.004. FINDINGS OF BENEFIT AND PUBLIC PURPOSE. (a)
4444 The district is created to serve a public use and benefit.
4545 (b) All land and other property included in the district
4646 will benefit from the improvements and services to be provided by
4747 the district under powers conferred by Sections 52 and 52-a,
4848 Article III, and Section 59, Article XVI, Texas Constitution, and
4949 other powers granted under this chapter.
5050 (c) The creation of the district is in the public interest
5151 and is essential to further the public purposes of:
5252 (1) developing and diversifying the economy of the
5353 state;
5454 (2) eliminating unemployment and underemployment; and
5555 (3) developing commerce in the state.
5656 (d) The district will:
5757 (1) promote the health, safety, and general welfare of
5858 residents, employers, potential employees, employees, consumers,
5959 and visitors in the district;
6060 (2) provide needed funding for the district to
6161 preserve, maintain, and enhance the economic health and viability
6262 of the district as a community and business center; and
6363 (3) promote the health, safety, welfare, and enjoyment
6464 of the public by providing trails, landscaping, and other services
6565 that are necessary for the restoration, preservation, and
6666 enhancement of the scenic beauty and environment of the area.
6767 Sec. 3858.005. DISTRICT TERRITORY. (a) The district is
6868 composed of the territory described by Section 2 of the Act enacting
6969 this chapter, as the territory may have been modified under:
7070 (1) Section 375.043 or 375.044, Local Government Code;
7171 or
7272 (2) other law.
7373 (b) The boundaries and field notes of the district contained
7474 in Section 2 of the Act enacting this chapter form a closure. A
7575 mistake in the field notes of the district contained in Section 2 of
7676 the Act enacting this chapter or in copying the field notes in the
7777 legislative process does not in any way affect:
7878 (1) the district's organization, existence, or
7979 validity;
8080 (2) the district's right to contract, including the
8181 right to issue any type of bond or other obligation for a purpose
8282 for which the district is created;
8383 (3) the district's right to impose or collect an
8484 assessment, tax, or other revenue; or
8585 (4) the legality or operation of the board.
8686 Sec. 3858.006. APPLICABILITY OF MUNICIPAL MANAGEMENT
8787 DISTRICTS LAW. Except as otherwise provided by this chapter,
8888 Chapter 375, Local Government Code, applies to the district.

9090 SUBCHAPTER B. BOARD OF DIRECTORS
9191 Sec. 3858.051. GOVERNING BODY; TERMS. The district is
9292 governed by a board of five directors who serve staggered terms of
9393 four years, with two or three directors' terms expiring June 1 of
9494 each odd-numbered year.
9595 Sec. 3858.052. APPOINTMENT OF DIRECTORS. (a) The
9696 commissioners court shall appoint as directors the following:
9797 (1) Position 1: a public citizen who resides in Hays
9898 County;
9999 (2) Position 2: a person who owns residential
100100 property in the district;
101101 (3) Position 3: a person who owns commercial property
102102 in the district;
103103 (4) Position 4: a person who meets the qualifications
104104 described by Section 375.063, Local Government Code; and
105105 (5) Position 5: the city administrator of the City of
106106 Dripping Springs.
107107 (b) If the commissioners court is unable to identify a
108108 person qualified for a director's position as provided by
109109 Subsection (a)(2) or (3) who is willing and able to serve, the
110110 commissioners court shall appoint to the place a person who meets
111111 the qualifications under Section 375.063, Local Government Code.
112112 Sec. 3858.053. VACANCY. The commissioners court shall fill
113113 a vacancy on the board by appointing a person who meets the
114114 qualifications prescribed by Section 375.063, Local Government
115115 Code, to serve for the remainder of the unexpired term.
116116 Sec. 3858.054. PETITION; ELECTION. (a) The owner or owners
117117 of at least 40 percent of the assessed value of property in the
118118 district may submit a petition to the commissioners court
119119 requesting an election of the board.
120120 (b) If the commissioners court receives a petition under
121121 Subsection (a), the commissioners court shall order an election of
122122 board members in the district.
123123 (c) The board shall give notice of the election not later
124124 than the 30th day before the date of the election.
125125 (d) Of the directors elected to the board in an election
126126 under this section, the terms of the directors appointed for
127127 positions 1 through 3 expire on the third June 1 after the election,
128128 and the terms of directors appointed for positions 4 and 5 expire on
129129 June 1 following the election.
130130 Sec. 3858.055. INITIAL DIRECTORS. (a) The initial board

149149 (d) This section expires June 1, 2014.

151151 SUBCHAPTER C. POWERS AND DUTIES
152152 Sec. 3858.101. GENERAL POWERS AND DUTIES. The district has
153153 the powers and duties necessary to accomplish the purposes for
154154 which the district was created.
155155 Sec. 3858.102. IMPROVEMENT PROJECTS. (a) The district may
156156 provide, or it may enter into contracts with a governmental or
157157 private entity to provide, the following types of improvement
158158 projects or activities in support of or incidental to those
159159 projects:
160160 (1) the planning, design, construction, improvement,
161161 operation, and maintenance of:
162162 (A) irrigation facilities and landscaping;
163163 (B) highway right-of-way or transit corridor
164164 beautification and improvement;
165165 (C) lighting, banners, and signs;
166166 (D) a street or sidewalk;
167167 (E) a hiking or cycling path or trail;
168168 (F) a park, lake, garden, recreational facility,
169169 sports facility, open space, scenic area, or related exhibit or
170170 preserve;
171171 (G) a fountain, plaza, or pedestrian mall;
172172 (H) a drainage or storm-water detention
173173 improvement;
174174 (I) a wastewater treatment and disposal
175175 facility;
176176 (J) a water quality protection facility;
177177 (K) a facility to enhance groundwater recharge;
178178 (L) an alternative energy facility; or
179179 (M) solid waste management services, including
180180 garbage collection, recycling, and composting;
181181 (2) the planning, design, construction, acquisition,
182182 lease, rental, improvement, maintenance, installation, and
183183 management of and provision of furnishings for a facility for:
184184 (A) a conference, convention, or exhibition;
185185 (B) a manufacturer, consumer, or trade show;
186186 (C) a civic, community, or institutional event;
187187 or
188188 (D) an exhibit, display, attraction, special
189189 event, or seasonal or cultural celebration or holiday; or
190190 (3) a special or supplemental service for the
191191 improvement and promotion of the district or an area adjacent to the
192192 district for the protection of public health and safety in or
193193 adjacent to the district, including:
194194 (A) advertising;
195195 (B) promotion;
196196 (C) tourism;
197197 (D) health and sanitation;
198198 (E) public safety;
199199 (F) security;
200200 (G) fire protection or emergency medical
201201 services;
202202 (H) business recruitment;
203203 (I) development;
204204 (J) elimination of traffic congestion;
205205 (K) recreational, educational, or cultural
206206 improvements, enhancements, and services; or
207207 (L) any similar public improvement, facility, or
208208 service.
209209 (b) The district may not undertake a project under this
210210 section unless the board determines the project to be necessary to
211211 accomplish the public purpose of the district.
212212 Sec. 3858.103. CONTRACTS; GIFTS; DONATIONS. The district
213213 may:
214214 (1) contract with any person to accomplish any
215215 district purpose, including a contract for:
216216 (A) the payment, repayment, or reimbursement of
217217 costs incurred by that person on behalf of the district, including
218218 all or part of the costs of an improvement project and interest on
219219 the reimbursed costs;
220220 (B) the use, occupancy, lease, rental,
221221 operation, maintenance, or management of all or part of a proposed
222222 or existing improvement project; or
223223 (C) the provision of law enforcement services to
224224 the district for a fee;
225225 (2) apply for and contract with any person to receive,
226226 administer, and perform a duty or obligation of the district under a
227227 federal, state, local, or private gift, grant, loan, conveyance,
228228 transfer, bequest, or other financial assistance arrangement
229229 relating to investigation, planning, analysis, study, design,
230230 acquisition, construction, improvement, completion,
231231 implementation, or operation by the district or others of a
232232 proposed or existing improvement project; and
233233 (3) accept a grant or donation from any person.
234234 Sec. 3858.104. RULES; ENFORCEMENT. (a) The district may
235235 adopt and enforce rules:
236236 (1) to administer or operate the district;
237237 (2) for the use, enjoyment, availability, protection,
238238 security, and maintenance of the district's property and
239239 facilities; or
240240 (3) to provide for public safety and security in the
241241 district.
242242 (b) The district may enforce its rules by injunctive relief.
243243 Sec. 3858.105. COMPETITIVE BIDDING. Section 375.221, Local
244244 Government Code, does not apply to the formation of a district
245245 contract.
246246 Sec. 3858.106. EMINENT DOMAIN. The district may not
247247 exercise the power of eminent domain.

249249 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
250250 Sec. 3858.151. DISBURSEMENTS AND TRANSFERS OF MONEY. The
251251 board by resolution shall establish the number of directors'
252252 signatures and the procedure required for a disbursement or
253253 transfer of the district's money.
254254 Sec. 3858.152. BONDS; DEBT. The district may not issue
255255 bonds, borrow money, or incur any type of debt.
256256 Sec. 3858.153. AD VALOREM TAX; ELECTION. (a) The district
257257 must hold an election in the manner provided by Subchapter L,
258258 Chapter 375, Local Government Code, to obtain voter approval before
259259 the district imposes an ad valorem tax.
260260 (b) If authorized at an election under Subsection (a) and
261261 subject to Subsection (c), the district may impose an annual ad
262262 valorem tax on taxable property in the district to:
263263 (1) maintain and operate the district;
264264 (2) construct or acquire improvements; or
265265 (3) provide a service.
266266 (c) The board may impose a tax on residential property in
267267 the district only if the revenue requirements of the district are
268268 not satisfied by the other taxes imposed by the board.
269269 (d) The board shall determine the tax rate. The tax rate may
270270 not exceed 15 cents per $100 valuation.
271271 Sec. 3858.154. ASSESSMENTS; LIENS FOR ASSESSMENTS. (a)
272272 The board by resolution may impose and collect an assessment for any
273273 purpose authorized by this chapter.
274274 (b) An assessment, a reassessment, or an assessment
275275 resulting from an addition to or correction of the assessment roll
276276 by the district, penalties and interest on an assessment or
277277 reassessment, an expense of collection, and reasonable attorney's
278278 fees incurred by the district:
279279 (1) are a first and prior lien against the property
280280 assessed;
281281 (2) are superior to any other lien or claim other than
282282 a lien or claim for county, school district, or municipal ad valorem
283283 taxes; and
284284 (3) are the personal liability of and a charge against
285285 the owners of the property even if the owners are not named in the
286286 assessment proceedings.
287287 (c) The lien is effective from the date of the board's
288288 resolution imposing the assessment until the date the assessment is
289289 paid. The board may enforce the lien in the same manner that the
290290 board may enforce an ad valorem tax lien against real property.
291291 (d) The board may make a correction to or deletion from the
292292 assessment roll that does not increase the amount of assessment of
293293 any parcel of land without providing notice and holding a hearing in
294294 the manner required for additional assessments.
295295 Sec. 3858.155. SALES AND USE TAX. (a) Except as otherwise
296296 provided by this section, Subtitles A and B, Title 2, Tax Code, and
297297 Chapter 151, Tax Code, apply to a tax imposed under this section and
298298 to the administration and enforcement of that tax in the same manner
299299 that those laws apply to a state tax.
300300 (b) Except as otherwise provided by this chapter, Chapter
301301 321, Tax Code, applies to the imposition, computation,
302302 administration, and governance of a sales and use tax imposed under
303303 this section, except that Section 321.101, Tax Code, does not
304304 apply.
305305 (c) The board may impose a tax on the receipts from the sale
306306 at retail of taxable items within the district, and an excise tax on
307307 the use, storage, or other consumption in the district of taxable
308308 items purchased, leased, or rented from a retailer in the district.
309309 (d) The board shall determine the rate of the tax, which may
310310 be in one-eighth of one percent increments not to exceed two
311311 percent.
312312 (e) A tax under this section is applied to the sales price of
313313 a taxable item.
314314 Sec. 3858.156. HOTEL OCCUPANCY TAX. The district may
315315 impose a hotel occupancy tax in the manner that Chapter 351, Tax
316316 Code, provides for a municipality. A tax imposed under this section
317317 may not exceed seven percent of the price paid for lodging in the
318318 district.
319319 Sec. 3858.157. ACCOUNTING. (a) On the conclusion of each
320320 fiscal year, the board shall obtain from an independent entity a
321321 review of the district's financial activities for the preceding
322322 fiscal year.
323323 (b) Not later than September 1, the board annually shall
324324 submit to the commissioners court a written report containing:
325325 (1) the findings of a review under Subsection (a);
326326 (2) if not included in the review, accounting records
327327 of the preceding fiscal year; and
328328 (3) a summary of the activities of the district during
329329 the preceding fiscal year.
330330 (c) Notwithstanding Subsection (b), the board shall submit
331331 its initial annual report not later than September 1, 2010. This
332332 subsection expires October 1, 2010.
333333 SECTION 2. The Driftwood Economic Development Municipal
334334 Management District initially contains all the territory contained
335335 in the following described area:
336336 FIELDNOTE DESCRIPTION of a tract or parcel of land containing
337337 500.286 acres situated in the Fannie A. D. Darden, Abstract No. 664
338338 and the Freelove Woody Survey No. 23, Abstract No. 20, Hays County,
339339 Texas, being a portion of that tract conveyed to Masa Scott Roberts
340340 by deed recorded in Volume 966, Page 156 of the Deed Records of Hays
341341 County, Texas and further described as Tract 1 of 130 acres, Tract 2
342342 of 100 acres and Tract 3 of 47 1/2 acres and Tract 4 of 200 acres,
343343 being further described by the deed recorded in Volume 168, Page 156
344344 of the said Deed Records and all of that 44.1134 acre tract conveyed
345345 to Driftwood Equities, Ltd. By the deed recorded in Volume 1433,
346346 Page 776 of the said Deed Records, said 44.1134 acre tract being a
347347 portion of that 100 acre tract conveyed to Masa Scott Roberts by the
348348 deed recorded in Volume 301, Page 865 of the said Deed Records; the
349349 herein described 500.286 acre tract is more particularly described
350350 by metes and bounds as follows:
351351 BEGINNING at a 1/2" iron rod found in the east right-of-way
352352 line of State Highway FM 150 (80' right-of-way), being the west line
353353 of the above said 288 acre tract, for the northwest corner of a
354354 12.00 acre tract conveyed to Horance Seiders and Violet Seiders by
355355 deed recorded in Volume 354, Page 763 of the said Deed Records, said
356356 1/2" iron rod found bears N0753'25"W, 329.46 feet from a TxDOT Type
357357 I concrete right-of-way monument found 40.00 feet left of State
358358 Highway FM 150 centerline station 281+96.9;
359359 THENCE, N0753'25"W, with the east right-of-way line of State
360360 Highway FM 150, a distance of 663.25 feet to a 1/2" iron rod found
361361 for the southwest corner of that 12.46 acre tract conveyed to
362362 Rudolph Kranse and Gregory Hargis by deed recorded in Volume 771,
363363 Page 651 of the said Deed Records, said 1/2" iron rod found bears
364364 S0753'25"E, 73.86 feet from a TxDOT Type I concrete right-of-way
365365 monument found 40.00 feet left of State Highway centerline station
366366 271+30.4;
367367 THENCE, N8802'55"E, crossing into the 288 acre tract, with
368368 the south line of the said 12.46 acre tract, 912.29 feet to a 1/2"
369369 iron rod set for the southeast corner of the aforesaid 12.46 acre
370370 tract;
371371 THENCE, N0646'55"W, 600.43 feet to a 1/2" iron rod found for
372372 the northeast corner of the said 12.46 acre tract;
373373 THENCE, S8902'53"W, with the north deed line of the said
374374 12.46 acre tract, 77.37 feet to the calculated point of
375375 intersection of this north deed line, with the east deed line of
376376 that 5.2506 acre tract conveyed to Kathleen Collins and Thomas
377377 Wendt by deed recorded in Volume 1427, Page 454 of the said Deed
378378 Records, said 5.2506 acre tract being a portion of that 10.283 acre
379379 tract described in the deed to Warren Dunn, Jr. recorded in Volume
380380 1376, Page 684 of the said Deed Records, the said calculated point
381381 bears N0517'08"E, 2.95 feet from a 1/2" iron rod found for the
382382 southeast corner of the aforesaid 10.283 acre tract;
383383 THENCE, N0517'08"E, with the east line of the 10.283 acre
384384 tract, at a distance of 131.06 feet (record distance) pass the
385385 common east corner of the said 5.2506 acre tract and a 5.04 acre
386386 tract described in a deed to Michael Dunn and recorded in Volume
387387 1296, Page 414 of the said Deed Records, and continuing for a total
388388 distance of 618.54 feet to a 5/8" iron rod found for the northeast
389389 corner of the said 10.283 acre tract and the 5.04 acre tract, being
390390 on the apparent common line between the above said 288 acre tract
391391 and the 100 acre tract, same being the POINT OF REFERENCE for the
392392 5.336 acre tract described below;
393393 THENCE, S8624'25"W, with the above said common line between
394394 the 288 acre tract and the 100 acre tract, being the north line of
395395 the 5.04 acre tract and the 10.283 acre tract, 91.89 feet to a 1/2"
396396 iron rod found for the southeast corner of a 14 acre tract conveyed
397397 to Mrs. Elna Ludine Roberts by deed recorded in Volume 135, Page 38
398398 of the said Deed Records and being the apparent southwest corner of
399399 the 100 acre tract (Tract 2) described above;
400400 THENCE, N0727'54"W, with the common line between the said 14
401401 acre tract and the 100 acre tract, 1242.44 feet to a 1/2" iron rod
402402 found for the common north corner of the aforesaid 14 acre tract and
403403 the 100 acre tract, being in the south line of Lot 1-D, "Division of
404404 Lot 1, the J. V. Ash, Jr. Subdivision", a subdivision recorded in
405405 Volume 10, Page 217 of the Plat Records of Hays County, Texas;
406406 THENCE, S8918'23"E, 174.13 feet to a 1/2" iron rod found for
407407 the southeast corner of said Lot 1-D, being the southwest corner of
408408 that 0.83 acre tract conveyed to Masa Scott Roberts by deed recorded
409409 in Volume 333, Page 323 of the said Deed Records, and being in the
410410 common line between the said 100 acre tract and the 130 acre tract
411411 (Tract 1) described above;
412412 THENCE, N0844'17"W, with the east line of Lot 1-D, being the
413413 west line of the said 0.83 acre tract, 101.46 feet to a 1/2" iron rod
414414 found for an angle point;
415415 THENCE, N3327'31"E, with the west line of the said 0.83 acre
416416 tract, at 148.39 feet pass a 1/2" iron rod found for the common east
417417 corner of Lot 1-D, and Lot 1-B, of said "Division of Lot 1, The J. V.
418418 Ash, Jr. Subdivision", for a total distance of 209.96 feet to a
419419 fence corner post found for an angle point in said Lot 1-B, being
420420 the most northerly corner of the aforesaid 0.83 acre tract;
421421 THENCE, S6954'59"E, with the north line of the said 0.83 acre
422422 tract, 18.34 feet to a cotton gin spindle found in rock, for the
423423 southeast corner of said Lot 1-B, being the southwest corner of Lot
424424 2, Block 'B', "Creek of Driftwood Subdivision", a subdivision
425425 recorded in Volume 8, Page 246 of the said Plat Records;
426426 THENCE, along the centerline of Onion Creek, with the
427427 northeast and easterly line of the above said 130 acre tract, for
428428 the following twenty-six (26) courses:
429429 1) S8026'41"E, 216.51 feet to a calculated angle point in
430430 the south line of Lot 2, Block 'B', from which a 100d nail set for
431431 reference bears S8522'12"W, 52.47 feet;
432432 2) N8933'24"E, 514.79 feet to the calculated southeast
433433 corner of said Lot 2, Block 'B';
434434 3) S5423'50"E, 13.02 feet to a calculated angle point on the
435435 south line of that 9.533 acre tract conveyed to Tom Hewett by deed
436436 recorded in Volume 363, Page 256 of the said Deed Records;
437437 4) N8954'14"E, 70.80 feet to a calculated angle point in the
438438 said south line of the 9.533 acre tract, from which a cotton gin
439439 spindle set for reference bears N6902'42"E, 138.90 feet;
440440 5) N5958'53"E, 562.38 feet to the calculated southeast
441441 corner of the 9.583 acre tract, being the southwest corner of Lot
442442 34, "Driftwood Falls Estates", a subdivision recorded in Volume 4,
443443 Page 111 of the said Plat Records;
444444 6) N5952'14"E, 343.26 feet to a calculated point for the
445445 southeast corner of said Lot 34, "Driftwood Falls Estates", from
446446 which a 1/2" iron rod found with cap, for the northeast corner of
447447 aforesaid Lot 34, bears N4256'02"W, 386.89 feet and a 100d nail set
448448 for reference bears N2035'12"E, 70.23 feet;
449449 7) N2245'14"E, at 257.83 feet pass a calculated point for
450450 the northeast corner of Lot 35, Driftwood Falls Estates, from said
451451 calculated point a 1/2" iron rod found for the most northerly corner
452452 of said Lot 35, bears N7519'16"W, 355.71 feet, and continuing for a
453453 total distance of 752.70 feet to the calculated southeast corner of
454454 Lot 39, "Driftwood Falls Estates", from which a 100d nail set for
455455 reference bears N4329'40"W, 26.48 feet;
