55 relating to the governing body of the Willacy County Navigation
66 District.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 404, Acts of the 53rd Legislature,
99 Regular Session, 1953, is amended by adding Sections 1A, 1B, and 1C
1010 to read as follows:
1111 Sec. 1A. In this Act:
1212 (1) "Board" means the board of navigation and canal
1313 commissioners of the district.
1414 (2) "Commissioner" means a member of the board.
1515 (3) "District" means the Willacy County Navigation
1616 District.
1717 Sec. 1B. (a) The board shall divide the territory of the
1818 district into four numbered single-member districts for electing
1919 commissioners.
2020 (b) The board may revise the single-member districts as
2121 necessary or appropriate.
2222 (c) The board consists of five commissioners. One
2323 commissioner is elected from each single-member district, and one
2424 commissioner is elected from the district at large.
2525 (d) Commissioners serve staggered four-year terms.
2626 (e) The commissioner elected from the district at large
2727 serves as the presiding officer of the board.
2828 Sec. 1C. The board shall hold an election to elect the
2929 appropriate number of commissioners on the uniform election date in
3030 November of each even-numbered year.
3131 SECTION 2. (a) In this section, "board," "commissioner,"
3232 and "district" have the meanings assigned by Section 1A, Chapter
3333 404, Acts of the 53rd Legislature, Regular Session, 1953, as added
3434 by this Act.
3535 (b) Not later than June 1, 2010, the board shall divide the
3636 territory of the district into four numbered single-member
3737 districts as required by Section 1B, Chapter 404, Acts of the 53rd
3838 Legislature, Regular Session, 1953, as added by this Act.
3939 (c) A commissioner of the district who is serving on the day
4040 before the effective date of this Act shall serve until a successor
4141 qualifies following an election under Subsection (d) of this
4242 section.
4343 (d) On the uniform election date in November 2010, the board
4444 shall hold an election to elect one at-large commissioner and four
4545 commissioners from single-member districts.
4646 (e) The five commissioners elected under Subsection (d) of
4747 this section shall draw lots to determine which two commissioners
4848 shall serve a term expiring December 1, 2012, and which three
4949 commissioners shall serve a term expiring December 1, 2014.
5050 (f) On the uniform election date in November 2012, the board
5151 shall hold an election to elect two commissioners to terms of four
5252 years.
5353 (g) On the uniform election date in 2014, the board shall
5454 hold an election to elect three commissioners to terms of four
5555 years.
5656 SECTION 3. (a) The legal notice of the intention to
5757 introduce this Act, setting forth the general substance of this
5858 Act, has been published as provided by law, and the notice and a
5959 copy of this Act have been furnished to all persons, agencies,
6060 officials, or entities to which they are required to be furnished
6161 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
6262 Government Code.
6363 (b) The governor, one of the required recipients, has
6464 submitted the notice and Act to the Texas Commission on
6565 Environmental Quality.
6666 (c) The Texas Commission on Environmental Quality has filed
6767 its recommendations relating to this Act with the governor, the
6868 lieutenant governor, and the speaker of the house of
6969 representatives within the required time.
7070 (d) All requirements of the constitution and laws of this
7171 state and the rules and procedures of the legislature with respect
7272 to the notice, introduction, and passage of this Act are fulfilled
7373 and accomplished.
7474 SECTION 4. This Act takes effect immediately if it receives
7575 a vote of two-thirds of all the members elected to each house, as
7676 provided by Section 39, Article III, Texas Constitution. If this
7777 Act does not receive the vote necessary for immediate effect, this
7878 Act takes effect September 1, 2009.
