77 relating to the regulation of tire businesses in certain counties;
88 creating an offense.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 234, Local Government Code, is amended
1111 by adding Subchapter C to read as follows:
1212 SUBCHAPTER C. BUSINESSES RELATED TO AUTOMOBILE TIRES
1313 Sec. 234.051. DEFINITIONS. In this subchapter:
1414 (1) "Mobile tire repair business" means a business
1515 that repairs tires at any temporary location, including a roadway,
1616 alley, parking lot, or residence.
1717 (2) "Used tire business" means a business or
1818 establishment at which used tires are collected, repaired,
1919 processed, recycled, scrapped, sold, bought, or stored, including a
2020 mobile tire repair business or a salvage yard.
2121 Sec. 234.052. APPLICABILITY. This subchapter applies only
2222 to a county:
2323 (1) with a population greater than 45,000;
2424 (2) in which there is located an Indian reservation
2525 under the jurisdiction of the United States government; and
2626 (3) that is adjacent to an international border.
2727 Sec. 234.053. LICENSE OR PERMIT REQUIRED. The
2828 commissioners court of a county by order may require that the owner
2929 or operator of a mobile tire repair business or used tire business
3030 obtain a license or permit from the county before engaging in
3131 business in the county. The commissioners court by order may
3232 establish a fee to be paid for a license or permit.
3333 Sec. 234.054. RULES. The commissioners court of a county
3434 may adopt rules as necessary to administer this subchapter.
3535 Sec. 234.055. INJUNCTION. A district or county attorney
3636 may bring suit to enjoin the operations of a mobile tire repair
3737 business or used tire business in violation of an order or rule
3838 adopted under this subchapter.
3939 Sec. 234.056. OFFENSE. A person commits an offense if the
4040 person violates an order adopted under this subchapter. An offense
4141 under this section is a Class C misdemeanor.
4242 SECTION 2. This Act takes effect September 1, 2009.
