55 AN ACT
66 relating to the board of directors of the Lakeway Municipal Utility
77 District.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. DEFINITIONS. In this Act:
1010 (1) "Additional voting area" means the territory
1111 described by Section 4 of this Act.
1212 (2) "Board" means the board of directors of the
1313 district.
1414 (3) "District" means the Lakeway Municipal Utility
1515 District.
1616 SECTION 2. BOARD OF DIRECTORS. (a) The district is
1717 governed by a board of seven directors elected in accordance with
1818 Chapters 49 and 54, Water Code.
1919 (b) Except as provided by Section 5 of this Act, directors
2020 serve staggered terms of four years.
2121 SECTION 3. EFFECT OF ADDITIONAL VOTING AREA ON VOTING
2222 RIGHTS, ELIGIBILITY FOR OFFICE, AND TAXING AUTHORITY. (a) The
2323 qualified voters residing in the additional voting area are
2424 entitled to vote only in district elections for the election of
2525 directors. The voters in the additional voting area may not vote on
2626 any district bond or tax propositions.
2727 (b) The board by rule shall establish procedures to timely
2828 notify qualified voters residing in the additional voting area of
2929 the locations of polling places for each election of district
3030 directors.
3131 (c) Notwithstanding Section 54.102, Water Code, a resident
3232 of the additional voting area is eligible to be a candidate for or
3333 to be elected to the board.
3434 (d) The district may not impose a tax on any property in or
3535 any resident of the additional voting area.
3636 SECTION 4. ADDITIONAL VOTING AREA. The additional voting
3737 area is that territory in certain subdivisions, the plats of which
3838 are recorded in the plat records of Travis County, Texas, as
3939 follows: Lakeway Section One, recorded in Volume 17, Page 65;
4040 Lakeway Section Two, recorded in Volume 17, Page 74; Lakeway

7171 SECTION 5. ELECTION OF DIRECTORS IN 2010. (a) Not earlier
7272 than the 15th day or later than the sixth day before the date of the
7373 first district election held in which the residents of the
7474 additional voting area are entitled to vote, the district shall
7575 publish notice in the form of a quarter-page advertisement in the
7676 newspaper of general circulation in the district notifying the
7777 residents that they are eligible to vote in the election and state
7878 the location of all polling places for the residents.
7979 (b) On the uniform election date in May of 2010, four
8080 directors shall be elected to the board. The directors elected to
8181 the two additional positions on the board created by this Act shall
8282 draw lots to determine which director serves a two-year term and
8383 which director serves a four-year term.
8484 SECTION 6. NOTICE. (a) The legal notice of the intention
8585 to introduce this Act, setting forth the general substance of this
8686 Act, has been published as provided by law, and the notice and a
8787 copy of this Act have been furnished to all persons, agencies,
8888 officials, or entities to which they are required to be furnished
8989 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9090 Government Code.
9191 (b) The governor has submitted the notice and Act to the
9292 Texas Commission on Environmental Quality.
9393 (c) The Texas Commission on Environmental Quality has filed
9494 its recommendations relating to this Act with the governor,
9595 lieutenant governor, and speaker of the house of representatives
9696 within the required time.
9797 (d) All requirements of the constitution and laws of this
9898 state and the rules and procedures of the legislature with respect
9999 to the notice, introduction, and passage of this Act are fulfilled
100100 and accomplished.
101101 SECTION 7. EFFECTIVE DATE. This Act takes effect
102102 immediately if it receives a vote of two-thirds of all the members
103103 elected to each house, as provided by Section 39, Article III, Texas
104104 Constitution. If this Act does not receive the vote necessary for
105105 immediate effect, this Act takes effect September 1, 2009.
