5	5	AN ACT
6	6	relating to the board of directors of the Lakeway Municipal Utility
7	7	District.
8	8	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
9	9	SECTION 1. DEFINITIONS. In this Act:
10	10	(1) "Additional voting area" means the territory
11	11	described by Section 4 of this Act.
12	12	(2) "Board" means the board of directors of the
13	13	district.
14	14	(3) "District" means the Lakeway Municipal Utility
15	15	District.
16	16	SECTION 2. BOARD OF DIRECTORS. (a) The district is
17	17	governed by a board of seven directors elected in accordance with
18	18	Chapters 49 and 54, Water Code.
19	19	(b) Except as provided by Section 5 of this Act, directors
20	20	serve staggered terms of four years.
21	21	SECTION 3. EFFECT OF ADDITIONAL VOTING AREA ON VOTING
22	22	RIGHTS, ELIGIBILITY FOR OFFICE, AND TAXING AUTHORITY. (a) The
23	23	qualified voters residing in the additional voting area are
24	24	entitled to vote only in district elections for the election of
25	25	directors. The voters in the additional voting area may not vote on
26	26	any district bond or tax propositions.
27	27	(b) The board by rule shall establish procedures to timely
28	28	notify qualified voters residing in the additional voting area of
29	29	the locations of polling places for each election of district
30	30	directors.
31	31	(c) Notwithstanding Section 54.102, Water Code, a resident
32	32	of the additional voting area is eligible to be a candidate for or
33	33	to be elected to the board.
34	34	(d) The district may not impose a tax on any property in or
35	35	any resident of the additional voting area.
36	36	SECTION 4. ADDITIONAL VOTING AREA. The additional voting
37	37	area is that territory in certain subdivisions, the plats of which
38	38	are recorded in the plat records of Travis County, Texas, as
39	39	follows: Lakeway Section One, recorded in Volume 17, Page 65;

71	71	SECTION 5. ELECTION OF DIRECTORS IN 2010. (a) Not earlier
72	72	than the 15th day or later than the sixth day before the date of the
73	73	first district election held in which the residents of the
74	74	additional voting area are entitled to vote, the district shall
75	75	publish notice in the form of a quarter-page advertisement in the
76	76	newspaper of general circulation in the district notifying the
77	77	residents that they are eligible to vote in the election and state
78	78	the location of all polling places for the residents.
79	79	(b) On the uniform election date in May of 2010, four
80	80	directors shall be elected to the board. The directors elected to
81	81	the two additional positions on the board created by this Act shall
82	82	draw lots to determine which director serves a two-year term and
83	83	which director serves a four-year term.
84	84	SECTION 6. NOTICE. (a) The legal notice of the intention
85	85	to introduce this Act, setting forth the general substance of this
86	86	Act, has been published as provided by law, and the notice and a
87	87	copy of this Act have been furnished to all persons, agencies,
88	88	officials, or entities to which they are required to be furnished
89	89	under Section 59, Article XVI, Texas Constitution, and Chapter 313,
90	90	Government Code.
91	91	(b) The governor has submitted the notice and Act to the
92	92	Texas Commission on Environmental Quality.
93	93	(c) The Texas Commission on Environmental Quality has filed
94	94	its recommendations relating to this Act with the governor,
95	95	lieutenant governor, and speaker of the house of representatives
96	96	within the required time.
97	97	(d) All requirements of the constitution and laws of this
98	98	state and the rules and procedures of the legislature with respect
99	99	to the notice, introduction, and passage of this Act are fulfilled
100	100	and accomplished.
101	101	SECTION 7. EFFECTIVE DATE. This Act takes effect
102	102	immediately if it receives a vote of two-thirds of all the members
103	103	elected to each house, as provided by Section 39, Article III, Texas
104	104	Constitution. If this Act does not receive the vote necessary for
105	105	immediate effect, this Act takes effect September 1, 2009.
