66 relating to coverage under a meet and confer agreement for certain
77 municipal firefighters and police officers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 147.002, Local Government Code, is
1010 amended to read as follows:
1111 Sec. 147.002. DEFINITIONS. In this chapter:
1212 (1) "Firefighter" means a firefighter employed by the
1313 municipality who is covered by the municipality's fire pension plan
1414 and is classified by the municipality as nonexempt [exempt]. The
1515 term does not include a firefighter with a rank that is above that
1616 of battalion chief or section chief.
1717 (2) "Firefighter employee group" means an
1818 organization:
1919 (A) in which, on or before September 1, 2007,
2020 firefighters of the municipality have participated and paid dues
2121 via automatic payroll deduction [for at least one year]; and
2222 (B) that exists for the purpose, in whole or in
2323 part, of dealing with the municipality concerning grievances, labor
2424 disputes, wages, rates of pay, hours of employment, or conditions
2525 of employment affecting firefighters.
2626 (3) "Police officer" means a sworn police officer
2727 employed by the municipality who is covered by the municipality's
2828 police pension plan and is classified by the municipality as
2929 nonexempt [exempt]. The term does not include a police officer with
3030 a rank above that of captain, a civilian, or a municipal marshal.
3131 (4) "Police officer employee group" means an
3232 organization:
3333 (A) in which, on or before September 1, 2007, at
3434 least three percent of the police officers of the municipality have
3535 participated and paid dues via automatic payroll deduction [for at
3636 least one year]; and
3737 (B) that exists for the purpose, in whole or in
3838 part, of dealing with the municipality concerning grievances, labor
3939 disputes, wages, rates of pay, hours of employment, or conditions
4040 of employment affecting police officers.
4141 SECTION 2. This Act takes effect September 1, 2009.
