77 relating to prior approval of residential property insurance rates
88 of certain insurers.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter D, Chapter 2251, Insurance Code, is
1111 amended by adding Section 2251.1511 to read as follows:
1212 Sec. 2251.1511. PRIOR APPROVAL FOR CERTAIN RESIDENTIAL
1313 PROPERTY INSURANCE RATES. (a) An insurer may not use a rate for
1414 residential property insurance until the rate and all other
1515 information required by Section 2251.101 have been filed with the
1616 department and the rate has been approved by the commissioner if the
1717 insurer, together with any of the insurer's affiliates and
1818 subsidiaries, as those terms are defined by Section 823.003, issued
1919 property and casualty insurance policies in this state that
2020 accounted for at least five percent of the total amount of premiums
2121 collected by insurers for property and casualty insurance in this
2222 state in the calendar year preceding the date the filing is
2323 required or the rate is otherwise proposed to be used.
2424 (b) Sections 2251.151(b) and (d) apply to rates filed under
2525 this section.
2626 (c) Section 2251.152 does not apply to rates for which prior
2727 approval is required by this section.
2828 SECTION 2. Section 2251.156(a), Insurance Code, is amended
2929 to read as follows:
3030 (a) If the commissioner disapproves a rate filing under
3131 Section 2251.153(a)(2) or Section 2251.1511, the commissioner
3232 shall issue an order disapproving the filing in accordance with
3333 Section 2251.103(b).
3434 SECTION 3. The change in law made by this Act applies only
3535 to rates for residential property insurance that is delivered,
3636 issued for delivery, or renewed on or after January 1, 2010. Rates
3737 for residential property insurance delivered, issued for delivery,
3838 or renewed before January 1, 2010, are governed by the law as it
3939 existed immediately before the effective date of this Act, and that
4040 law is continued in effect for that purpose.
4141 SECTION 4. This Act takes effect September 1, 2009.
