66 AN ACT
77 relating to the confidentiality of the home address information of
88 the spouses of certain federal judges and certain state judges.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 13.0021(b), Election Code, is amended to
1111 read as follows:
1212 (b) If the registration applicant is a federal judge, [or]
1313 state judge, or the spouse of a state judge or a federal judge who
1414 seeks to have the applicant's residence address omitted from the
1515 registration list, the applicant shall include with the application
1616 an affidavit stating that the applicant is a federal judge or state
1717 judge, or the spouse of a federal judge or state judge.
1818 SECTION 2. Sections 13.004(c) and (d), Election Code, are
1919 amended to read as follows:
2020 (c) The following information furnished on a registration
2121 application is confidential and does not constitute public
2222 information for purposes of Chapter 552, Government Code:
2323 (1) a social security number;
2424 (2) a Texas driver's license number;
2525 (3) a number of a personal identification card issued
2626 by the Department of Public Safety;
2727 (4) an indication that an applicant is interested in
2828 working as an election judge; or
2929 (5) the residence address of the applicant, if the
3030 applicant is a federal judge or state judge, as defined by Section
3131 13.0021, or the spouse of a federal judge or state judge, and
3232 included an affidavit with the registration application under
3333 Section 13.0021 or the registrar has received an affidavit
3434 submitted under Section 15.0215.
3535 (d) The voter registrar or other county official who has
3636 access to the information furnished on a registration application
3737 may not post the following information on a website:
3838 (1) a telephone number;
3939 (2) a social security number;
4040 (3) a driver's license number or a number of a personal
4141 identification card;
4242 (4) a date of birth; or
4343 (5) the residence address of a voter who is a federal
4444 judge or state judge, as defined by Section 13.0021, or the spouse
4545 of a federal judge or state judge, if the voter included an
4646 affidavit with the application under Section 13.0021 or the
4747 registrar has received an affidavit submitted under Section
4848 15.0215.
4949 SECTION 3. Section 15.0215(b), Election Code, is amended to
5050 read as follows:
5151 (b) A federal judge, [or] state judge, or the spouse of a
5252 federal judge or state judge who is registered to vote may at any
5353 time submit to the registrar of the county in which the judge
5454 resides an affidavit stating that the voter is a federal judge or
5555 state judge, or the spouse of a federal judge or state judge.
5656 SECTION 4. Section 15.081(d), Election Code, is amended to
5757 read as follows:
5858 (d) Notwithstanding Subsection (b), the suspense list may
5959 not contain the residence address of a voter who is a federal judge,
6060 [or] state judge, or the spouse of a federal judge or state judge,
6161 if the voter included an affidavit with the voter's registration
6262 application under Section 13.0021 or the registrar received an
6363 affidavit submitted under Section 15.0215 before the list was
6464 prepared. In this subsection, "federal judge" and "state judge"
6565 have the meanings assigned by Section 13.0021.
6666 SECTION 5. Section 18.005(c), Election Code, is amended to
6767 read as follows:
6868 (c) The original or supplemental list of registered voters
6969 may not contain the residence address of a voter who is a federal
7070 judge, [or] state judge, or the spouse of a federal judge or state
7171 judge, if the voter included an affidavit with the voter's
7272 registration application under Section 13.0021 or the registrar
7373 received an affidavit submitted under Section 15.0215 before the
7474 list was prepared. In this subsection, "federal judge" and "state
7575 judge" have the meanings assigned by Section 13.0021.
7676 SECTION 6. Section 18.066(b), Election Code, is amended to
7777 read as follows:
7878 (b) Information furnished under this section may not
7979 include:
8080 (1) a voter's social security number; or
8181 (2) the residence address of a voter who is a federal
8282 judge or state judge, as defined by Section 13.0021, or the spouse
8383 of a federal judge or state judge, if the voter included an
8484 affidavit with the voter's registration application under Section
8585 13.0021 or the applicable registrar has received an affidavit
8686 submitted under Section 15.0215.
8787 SECTION 7. Section 25.025(a), Tax Code, as amended by
8888 Chapters 594 (H.B. 41), 621 (H.B. 455), and 851 (H.B. 1141), Acts of
8989 the 80th Legislature, Regular Session, 2007, is reenacted and
9090 amended to read as follows:
9191 (a) This section applies only to:
9292 (1) a current or former peace officer as defined by
9393 Article 2.12, Code of Criminal Procedure;
9494 (2) a county jailer as defined by Section 1701.001,
9595 Occupations Code;
9696 (3) an employee of the Texas Department of Criminal
9797 Justice;
9898 (4) a commissioned security officer as defined by
9999 Section 1702.002, Occupations Code;
100100 (5) a victim of family violence as defined by Section
101101 71.004, Family Code, if as a result of the act of family violence
102102 against the victim, the actor is convicted of a felony or a Class A
103103 misdemeanor; [and]
104104 (6) a federal judge, [or] state judge, or the spouse of
105105 a federal judge or state judge;
106106 (7) [(6)] a current or former employee of a district
107107 attorney, criminal district attorney, or county or municipal
108108 attorney whose jurisdiction includes any criminal law or child
109109 protective services matters; and
110110 (8) [(6)] an officer or employee of a community
111111 supervision and corrections department established under Chapter
112112 76, Government Code, who performs a duty described by Section
113113 76.004(b) of that code.
114114 SECTION 8. This Act takes effect September 1, 2009.
