6	6	AN ACT
7	7	relating to the confidentiality of the home address information of
8	8	the spouses of certain federal judges and certain state judges.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 13.0021(b), Election Code, is amended to
11	11	read as follows:
12	12	(b) If the registration applicant is a federal judge, [or]
13	13	state judge, or the spouse of a state judge or a federal judge who
14	14	seeks to have the applicant's residence address omitted from the
15	15	registration list, the applicant shall include with the application
16	16	an affidavit stating that the applicant is a federal judge or state
17	17	judge, or the spouse of a federal judge or state judge.
18	18	SECTION 2. Sections 13.004(c) and (d), Election Code, are
19	19	amended to read as follows:
20	20	(c) The following information furnished on a registration
21	21	application is confidential and does not constitute public
22	22	information for purposes of Chapter 552, Government Code:
23	23	(1) a social security number;
24	24	(2) a Texas driver's license number;
25	25	(3) a number of a personal identification card issued
26	26	by the Department of Public Safety;
27	27	(4) an indication that an applicant is interested in
28	28	working as an election judge; or
29	29	(5) the residence address of the applicant, if the
30	30	applicant is a federal judge or state judge, as defined by Section
31	31	13.0021, or the spouse of a federal judge or state judge, and
32	32	included an affidavit with the registration application under
33	33	Section 13.0021 or the registrar has received an affidavit
34	34	submitted under Section 15.0215.
35	35	(d) The voter registrar or other county official who has
36	36	access to the information furnished on a registration application
37	37	may not post the following information on a website:
38	38	(1) a telephone number;
39	39	(2) a social security number;
40	40	(3) a driver's license number or a number of a personal
41	41	identification card;
42	42	(4) a date of birth; or
43	43	(5) the residence address of a voter who is a federal
44	44	judge or state judge, as defined by Section 13.0021, or the spouse
45	45	of a federal judge or state judge, if the voter included an
46	46	affidavit with the application under Section 13.0021 or the
47	47	registrar has received an affidavit submitted under Section
48	48	15.0215.
49	49	SECTION 3. Section 15.0215(b), Election Code, is amended to
50	50	read as follows:
51	51	(b) A federal judge, [or] state judge, or the spouse of a
52	52	federal judge or state judge who is registered to vote may at any
53	53	time submit to the registrar of the county in which the judge
54	54	resides an affidavit stating that the voter is a federal judge or
55	55	state judge, or the spouse of a federal judge or state judge.
56	56	SECTION 4. Section 15.081(d), Election Code, is amended to
57	57	read as follows:
58	58	(d) Notwithstanding Subsection (b), the suspense list may
59	59	not contain the residence address of a voter who is a federal judge,
60	60	[or] state judge, or the spouse of a federal judge or state judge,
61	61	if the voter included an affidavit with the voter's registration
62	62	application under Section 13.0021 or the registrar received an
63	63	affidavit submitted under Section 15.0215 before the list was
64	64	prepared. In this subsection, "federal judge" and "state judge"
65	65	have the meanings assigned by Section 13.0021.
66	66	SECTION 5. Section 18.005(c), Election Code, is amended to
67	67	read as follows:
68	68	(c) The original or supplemental list of registered voters
69	69	may not contain the residence address of a voter who is a federal
70	70	judge, [or] state judge, or the spouse of a federal judge or state
71	71	judge, if the voter included an affidavit with the voter's
72	72	registration application under Section 13.0021 or the registrar
73	73	received an affidavit submitted under Section 15.0215 before the
74	74	list was prepared. In this subsection, "federal judge" and "state
75	75	judge" have the meanings assigned by Section 13.0021.
76	76	SECTION 6. Section 18.066(b), Election Code, is amended to
77	77	read as follows:
78	78	(b) Information furnished under this section may not
79	79	include:
80	80	(1) a voter's social security number; or
81	81	(2) the residence address of a voter who is a federal
82	82	judge or state judge, as defined by Section 13.0021, or the spouse
83	83	of a federal judge or state judge, if the voter included an
84	84	affidavit with the voter's registration application under Section
85	85	13.0021 or the applicable registrar has received an affidavit
86	86	submitted under Section 15.0215.
87	87	SECTION 7. Section 25.025(a), Tax Code, as amended by
88	88	Chapters 594 (H.B. 41), 621 (H.B. 455), and 851 (H.B. 1141), Acts of
89	89	the 80th Legislature, Regular Session, 2007, is reenacted and
90	90	amended to read as follows:
91	91	(a) This section applies only to:
92	92	(1) a current or former peace officer as defined by
93	93	Article 2.12, Code of Criminal Procedure;
94	94	(2) a county jailer as defined by Section 1701.001,
95	95	Occupations Code;
96	96	(3) an employee of the Texas Department of Criminal
97	97	Justice;
98	98	(4) a commissioned security officer as defined by
99	99	Section 1702.002, Occupations Code;
100	100	(5) a victim of family violence as defined by Section
101	101	71.004, Family Code, if as a result of the act of family violence
102	102	against the victim, the actor is convicted of a felony or a Class A
103	103	misdemeanor; [and]
104	104	(6) a federal judge, [or] state judge, or the spouse of
105	105	a federal judge or state judge;
106	106	(7) [(6)] a current or former employee of a district
107	107	attorney, criminal district attorney, or county or municipal
108	108	attorney whose jurisdiction includes any criminal law or child
109	109	protective services matters; and
110	110	(8) [(6)] an officer or employee of a community
111	111	supervision and corrections department established under Chapter
112	112	76, Government Code, who performs a duty described by Section
113	113	76.004(b) of that code.
114	114	SECTION 8. This Act takes effect September 1, 2009.
