Some potential students may choose not to pursue health care careers due to the expense and time required to receive the hepatitis B vaccination. S.B. 291 provides that a rule requiring certain students to have a hepatitis B vaccination applies only to students enrolled in a course of study involving potential exposure to certain blood or bodily fluids. RULEMAKING AUTHORITY Rulemaking authority previously granted to the executive commissioner of the Health and Human Services Commission is modified in SECTION 1 (Section 51.933, Education Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 51.933, Education Code, by adding Subsection (b-1), to authorize that a rule adopted under Subsection (b) that requires a hepatitis B vaccination for students apply only to students enrolled in a course of study that involves potential exposure to human or animal blood or bodily fluids. SECTION 2. Requires the executive commissioner of the Health and Human Services Commission to adopt rules as required by Section 51.933(b-1), Education Code, as added by this Act, not later than November 1, 2009. SECTION 3. Effective date: upon passage or September 1, 2009.
