66 AN ACT
77 relating to the order of succession to the office of governor.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 401.023(a), Government Code, is amended
1010 to read as follows:
1111 (a) If the governor, lieutenant governor, and president pro
1212 tempore of the senate are unavailable, the following officers in
1313 succeeding order shall exercise the powers and discharge the duties
1414 of the office of governor:
1515 (1) the speaker of the house of representatives;
1616 (2) the attorney general; [and]
1717 (3) the comptroller;
1818 (4) the land commissioner; and
1919 (5) the commissioner of agriculture [the chief
2020 justices of the courts of appeals, in the numerical order of the
2121 supreme judicial districts the courts serve].
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
