8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 401.023(a), Government Code, is amended | |
10 | 10 | to read as follows: | |
11 | 11 | (a) If the governor, lieutenant governor, and president pro | |
12 | 12 | tempore of the senate are unavailable, the following officers in | |
13 | 13 | succeeding order shall exercise the powers and discharge the duties | |
14 | 14 | of the office of governor: | |
15 | 15 | (1) the speaker of the house of representatives; | |
16 | 16 | (2) the attorney general; [and] | |
17 | 17 | (3) the comptroller; | |
18 | 18 | (4) the land commissioner; and | |
19 | 19 | (5) the commissioner of agriculture [the chief | |
20 | 20 | justices of the courts of appeals, in the numerical order of the | |
21 | 21 | supreme judicial districts the courts serve]. | |
22 | 22 | SECTION 2. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
