| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter B, Chapter 254, Election Code, is |
|---|
| 13 | 13 | | amended by adding Section 254.04011 to read as follows: |
|---|
| 14 | 14 | | Sec. 254.04011. AVAILABILITY OF REPORTS OF SCHOOL TRUSTEES |
|---|
| 15 | 15 | | ON INTERNET. (a) A report filed under this chapter by a member of |
|---|
| 16 | 16 | | the board of trustees of a school district, a candidate for |
|---|
| 17 | 17 | | membership on the board of trustees of a school district, or a |
|---|
| 18 | 18 | | specific-purpose committee for supporting, opposing, or assisting |
|---|
| 19 | 19 | | a candidate or member of a board of trustees of a school district |
|---|
| 20 | 20 | | must be posted on the Internet website of: |
|---|
| 21 | 21 | | (1) the school district; and |
|---|
| 22 | 22 | | (2) the commission. |
|---|
| 23 | 23 | | (b) A report to which Subsection (a) applies must be |
|---|
| 24 | 24 | | available to the public on the Internet website not later than the |
|---|
| 25 | 25 | | fifth business day after the date the report is filed with the |
|---|
| 26 | 26 | | school district or commission. |
|---|
| 27 | 27 | | (c) The access allowed by this section to reports is in |
|---|
| 28 | 28 | | addition to the public's access to the information through other |
|---|
| 29 | 29 | | electronic or print distribution of the information. |
|---|
| 30 | 30 | | (d) Before making a report available on the Internet under |
|---|
| 31 | 31 | | this section, the school district or commission shall remove each |
|---|
| 32 | 32 | | portion, other than city, state, and zip code, of the address of a |
|---|
| 33 | 33 | | person listed as having made a political contribution to the person |
|---|
| 34 | 34 | | filing the report. The address information removed must remain |
|---|
| 35 | 35 | | available on the report maintained in the school district's or |
|---|
| 36 | 36 | | commission's office but may not be available electronically at that |
|---|
| 37 | 37 | | office. |
|---|
| 38 | 38 | | SECTION 2. Section 254.066, Election Code, is amended by |
|---|
| 39 | 39 | | adding Subsection (c) to read as follows: |
|---|
| 40 | 40 | | (c) A report required to be filed under this subchapter by a |
|---|
| 41 | 41 | | candidate for membership on the board of trustees of a school |
|---|
| 42 | 42 | | district shall also be filed with the commission. |
|---|
| 43 | 43 | | SECTION 3. Section 254.097, Election Code, is amended by |
|---|
| 44 | 44 | | adding Subsection (c) to read as follows: |
|---|
| 45 | 45 | | (c) A report required to be filed under this subchapter by a |
|---|
| 46 | 46 | | member of the board of trustees of a school district shall also be |
|---|
| 47 | 47 | | filed with the commission. |
|---|
| 48 | 48 | | SECTION 4. Section 254.130, Election Code, is amended by |
|---|
| 49 | 49 | | adding Subsection (c) to read as follows: |
|---|
| 50 | 50 | | (c) A report required to be filed under this subchapter by a |
|---|
| 51 | 51 | | specific-purpose committee for supporting, opposing, or assisting |
|---|
| 52 | 52 | | a candidate or member of a board of trustees of a school district |
|---|
| 53 | 53 | | shall also be filed with the commission. |
|---|
| 54 | 54 | | SECTION 5. (a) The change in law made by this Act by adding |
|---|
| 55 | 55 | | Section 254.04011, Election Code, applies only to the posting of a |
|---|
| 56 | 56 | | report of political contributions and expenditures that is required |
|---|
| 57 | 57 | | to be filed on or after January 1, 2010. |
|---|
| 58 | 58 | | (b) Sections 254.066(c), 254.097(c), and 254.130(c), |
|---|
| 59 | 59 | | Election Code, as added by this Act, apply only to a report under |
|---|
| 60 | 60 | | Chapter 254, Election Code, that is required to be filed on or after |
|---|
| 61 | 61 | | January 1, 2010. A report under Chapter 254, Election Code, that is |
|---|
| 62 | 62 | | required to be filed before January 1, 2010, is governed by the law |
|---|
| 63 | 63 | | in effect on the date the report is required to be filed, and the |
|---|
| 64 | 64 | | former law is continued in effect for that purpose. |
|---|
| 65 | 65 | | SECTION 6. This Act takes effect September 1, 2009. |
