66 AN ACT
77 relating to the filing and posting on the Internet of reports of
88 political contributions and expenditures required in connection
99 with the office of member of the board of trustees of a school
1010 district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 254, Election Code, is
1313 amended by adding Section 254.04011 to read as follows:
1414 Sec. 254.04011. AVAILABILITY OF REPORTS OF SCHOOL TRUSTEES
1515 ON INTERNET. (a) A report filed under this chapter by a member of
1616 the board of trustees of a school district, a candidate for
1717 membership on the board of trustees of a school district, or a
1818 specific-purpose committee for supporting, opposing, or assisting
1919 a candidate or member of a board of trustees of a school district
2020 must be posted on the Internet website of:
2121 (1) the school district; and
2222 (2) the commission.
2323 (b) A report to which Subsection (a) applies must be
2424 available to the public on the Internet website not later than the
2525 fifth business day after the date the report is filed with the
2626 school district or commission.
2727 (c) The access allowed by this section to reports is in
2828 addition to the public's access to the information through other
2929 electronic or print distribution of the information.
3030 (d) Before making a report available on the Internet under
3131 this section, the school district or commission shall remove each
3232 portion, other than city, state, and zip code, of the address of a
3333 person listed as having made a political contribution to the person
3434 filing the report. The address information removed must remain
3535 available on the report maintained in the school district's or
3636 commission's office but may not be available electronically at that
3737 office.
3838 SECTION 2. Section 254.066, Election Code, is amended by
3939 adding Subsection (c) to read as follows:
4040 (c) A report required to be filed under this subchapter by a
4141 candidate for membership on the board of trustees of a school
4242 district shall also be filed with the commission.
4343 SECTION 3. Section 254.097, Election Code, is amended by
4444 adding Subsection (c) to read as follows:
4545 (c) A report required to be filed under this subchapter by a
4646 member of the board of trustees of a school district shall also be
4747 filed with the commission.
4848 SECTION 4. Section 254.130, Election Code, is amended by
4949 adding Subsection (c) to read as follows:
5050 (c) A report required to be filed under this subchapter by a
5151 specific-purpose committee for supporting, opposing, or assisting
5252 a candidate or member of a board of trustees of a school district
5353 shall also be filed with the commission.
5454 SECTION 5. (a) The change in law made by this Act by adding
5555 Section 254.04011, Election Code, applies only to the posting of a
5656 report of political contributions and expenditures that is required
5757 to be filed on or after January 1, 2010.
5858 (b) Sections 254.066(c), 254.097(c), and 254.130(c),
5959 Election Code, as added by this Act, apply only to a report under
6060 Chapter 254, Election Code, that is required to be filed on or after
6161 January 1, 2010. A report under Chapter 254, Election Code, that is
6262 required to be filed before January 1, 2010, is governed by the law
6363 in effect on the date the report is required to be filed, and the
6464 former law is continued in effect for that purpose.
6565 SECTION 6. This Act takes effect September 1, 2009.
