| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 46.02, Penal Code, is amended by | |
| 10 | 10 | amending Subsection (b) and adding Subsection (b-1) to read as | |
| 11 | 11 | follows: | |
| 12 | 12 | (b) Except as provided by Subsection (b-1) or (c), an | |
| 13 | 13 | offense under this section is a Class A misdemeanor. | |
| 14 | 14 | (b-1) Except as provided by Subsection (c), an offense under | |
| 15 | 15 | this section is a state jail felony if it is shown on the trial of | |
| 16 | 16 | the offense that the person has previously been convicted of an | |
| 17 | 17 | offense under Chapter 71. | |
| 18 | 18 | SECTION 2. The change in law made by this Act applies only | |
| 19 | 19 | to an offense committed on or after the effective date of this Act. | |
| 20 | 20 | An offense committed before the effective date of this Act is | |
| 21 | 21 | covered by the law in effect when the offense was committed, and the | |
| 22 | 22 | former law is continued in effect for that purpose. For purposes of | |
| 23 | 23 | this section, an offense was committed before the effective date of | |
| 24 | 24 | this Act if any element of the offense was committed before that | |
| 25 | 25 | date. | |
| 26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
