55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the requirement that matching funds be provided by
88 school districts and open-enrollment charter schools under the
99 educator excellence awards program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 21.702, Education Code, is amended by
1212 adding Subsection (a-1) to read as follows:
1313 (a-1) The commissioner may not:
1414 (1) require a school district or open-enrollment
1515 charter school to provide matching funds as a condition of
1616 eligibility for receipt of a program grant; or
1717 (2) give preference in awarding program grants to a
1818 school district or open-enrollment charter school that volunteers
1919 to provide matching funds.
2020 SECTION 2. Section 21.702(a-1), Education Code, as added by
2121 this Act, applies to each school district or open-enrollment
2222 charter school receiving grant funds under Subchapter O, Chapter
2323 21, Education Code, after the effective date of this Act,
2424 regardless of the date on which the district or school initially
2525 received grant funds. The commissioner of education may not
2626 disqualify a school district or open-enrollment charter school from
2727 eligibility for future grant funds or seek to recover allocated
2828 grant funds from the district or school on the grounds that the
2929 district or school ceased providing matching funds previously
3030 agreed to be provided as a condition of eligibility for receiving
3131 grant funds.
3232 SECTION 3. This Act takes effect immediately if it receives
3333 a vote of two-thirds of all the members elected to each house, as
3434 provided by Section 39, Article III, Texas Constitution. If this
3535 Act does not receive the vote necessary for immediate effect, this
3636 Act takes effect September 1, 2009.
