| 7 | 7 | | relating to the requirement that matching funds be provided by |

| 8 | 8 | | school districts and open-enrollment charter schools under the |
|---|
| 9 | 9 | | educator excellence awards program. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 21.702, Education Code, is amended by |
|---|
| 12 | 12 | | adding Subsection (a-1) to read as follows: |
|---|
| 13 | 13 | | (a-1) The commissioner may not: |
|---|
| 14 | 14 | | (1) require a school district or open-enrollment |
|---|
| 15 | 15 | | charter school to provide matching funds as a condition of |
|---|
| 16 | 16 | | eligibility for receipt of a program grant; or |
|---|
| 17 | 17 | | (2) give preference in awarding program grants to a |
|---|
| 18 | 18 | | school district or open-enrollment charter school that volunteers |
|---|
| 19 | 19 | | to provide matching funds. |
|---|
| 20 | 20 | | SECTION 2. Section 21.702(a-1), Education Code, as added by |
|---|
| 21 | 21 | | this Act, applies to each school district or open-enrollment |
|---|
| 22 | 22 | | charter school receiving grant funds under Subchapter O, Chapter |
|---|
| 23 | 23 | | 21, Education Code, after the effective date of this Act, |
|---|
| 24 | 24 | | regardless of the date on which the district or school initially |
|---|
| 25 | 25 | | received grant funds. The commissioner of education may not |
|---|
| 26 | 26 | | disqualify a school district or open-enrollment charter school from |
|---|
| 27 | 27 | | eligibility for future grant funds or seek to recover allocated |
|---|
| 28 | 28 | | grant funds from the district or school on the grounds that the |
|---|
| 29 | 29 | | district or school ceased providing matching funds previously |
|---|
| 30 | 30 | | agreed to be provided as a condition of eligibility for receiving |
|---|
| 31 | 31 | | grant funds. |
|---|
| 32 | 32 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 33 | 33 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 34 | 34 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 35 | 35 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 36 | 36 | | Act takes effect September 1, 2009. |
