8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
9 | 9 | SECTION 1. Section 533.083, Health and Safety Code, is | |
10 | 10 | amended to read as follows: | |
11 | 11 | Sec. 533.083. [CRITERIA FOR] EXPANSION, CLOSURE, OR | |
12 | 12 | CONSOLIDATION OF FACILITY. (a) The department shall establish | |
13 | 13 | objective criteria for determining when a new facility may be | |
14 | 14 | needed and when a facility may be expanded, closed, or | |
15 | 15 | consolidated. | |
16 | 16 | (b) If the executive commissioner of the Health and Human | |
17 | 17 | Services Commission determines that temporarily or permanently | |
18 | 18 | closing a state school would result in a more efficient use of state | |
19 | 19 | money or other resources, the executive commissioner may close that | |
20 | 20 | state school. | |
21 | 21 | SECTION 2. This Act takes effect immediately if it receives | |
22 | 22 | a vote of two-thirds of all the members elected to each house, as | |
23 | 23 | provided by Section 39, Article III, Texas Constitution. If this | |
24 | 24 | Act does not receive the vote necessary for immediate effect, this | |
25 | 25 | Act takes effect September 1, 2009. |
