55 relating to the creation of an advisory committee to study the
66 retail availability of healthy foods in certain underserved areas
77 of this state.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. HEALTHY FOOD ADVISORY COMMITTEE. (a) The
1010 executive commissioner of the Health and Human Services Commission
1111 and the commissioner of the Department of Agriculture shall jointly
1212 establish an advisory committee to study and provide
1313 recommendations to the legislature regarding:
1414 (1) the areas of this state that are underserved in the
1515 retail availability of fresh fruits and vegetables and other
1616 healthy foods; and
1717 (2) the impact of the limited retail availability on
1818 proper nutrition and on obesity and related chronic illnesses.
1919 (b) The advisory committee consists of eight members as
2020 follows:
2121 (1) four members appointed by the executive
2222 commissioner of the Health and Human Services Commission; and
2323 (2) four members appointed by the commissioner of the
2424 Department of Agriculture.
2525 (c) In appointing members of the advisory committee, the
2626 executive commissioner of the Health and Human Services Commission
2727 and the commissioner of the Department of Agriculture shall ensure
2828 that the members reflect the diversity of this state, with members
2929 representing:
3030 (1) rural areas;
3131 (2) urban areas; and
3232 (3) different geographical regions of the state.
3333 (d) An advisory committee member is not entitled to
3434 reimbursement of expenses or to compensation.
3535 (e) The advisory committee shall meet not later than the
3636 30th day after the date the initial appointments are made and shall
3737 select a presiding officer. The committee shall meet regularly as
3838 necessary at the call of the presiding officer.
3939 (f) The advisory committee shall:
4040 (1) investigate the retail availability of fresh
4141 fruits and vegetables and other healthy foods in this state;
4242 (2) develop recommendations for creating and a plan
4343 for implementing a statewide financing program to bring fresh food
4444 retailers into areas of this state that are underserved in regard to
4545 the retail availability of fresh fruits and vegetables and other
4646 healthy foods; and
4747 (3) perform other advisory duties as requested by the
4848 executive commissioner of the Health and Human Services Commission
4949 or the commissioner of the Department of Agriculture regarding the
5050 availability of fresh fruits and vegetables and other healthy foods
5151 in this state.
5252 (g) Not later than September 1, 2010, the advisory committee
5353 shall submit to the legislature a report outlining:
5454 (1) the costs, benefits, and feasibility of a
5555 statewide financing program to bring fresh food retailers into
5656 areas of this state that are underserved in regard to the retail
5757 availability of fresh fruits and vegetables and other healthy
5858 foods; and
5959 (2) a plan for implementing the program.
6060 SECTION 2. INAPPLICABILITY OF CERTAIN LAW. Chapter 2110,
6161 Government Code, does not apply to the advisory committee
6262 established under this Act.
6363 SECTION 3. EXPIRATION. The advisory committee established
6464 under this Act is abolished and this Act expires September 1, 2011.
6565 SECTION 4. EFFECTIVE DATE. This Act takes effect
6666 immediately if it receives a vote of two-thirds of all the members
6767 elected to each house, as provided by Section 39, Article III, Texas
6868 Constitution. If this Act does not receive the vote necessary for
6969 immediate effect, this Act takes effect September 1, 2009.
