55 AN ACT
66 relating to the establishment of an advisory committee to study the
77 acceptance at farmers markets of food stamps and benefits under the
88 women, infants, and children supplemental food program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. ESTABLISHMENT OF ADVISORY COMMITTEE. (a) In
1111 this Act:
1212 (1) "Farmers market" means a location at which a group
1313 of two or more farmers that are certified under the Department of
1414 Agriculture's farmers market certification program offer produce
1515 for retail sale.
1616 (2) "Food stamp program" means the program operated
1717 under 7 U.S.C. Chapter 51 and administered under Chapter 33, Human
1818 Resources Code.
1919 (3) "W.I.C. program" means the federal special
2020 supplemental food program for women, infants, and children
2121 administered by the Department of State Health Services.
2222 (b) The executive commissioner of the Health and Human
2323 Services Commission and the commissioner of the Department of
2424 Agriculture shall jointly establish an advisory committee to study
2525 and provide recommendations to the legislature regarding the
2626 incorporation and use of food stamps and W.I.C. program benefits at
2727 farmers markets in the state.
2828 (c) The advisory committee consists of nine members
2929 appointed as follows:
3030 (1) the commissioner of the Department of Agriculture
3131 shall appoint four representatives of farmers market vendors, with
3232 two members representing urban farmers markets and two members
3333 representing rural farmers markets or roadside stands; and
3434 (2) the executive commissioner of the Health and Human
3535 Services Commission shall appoint:
3636 (A) one representative of an advocacy group for
3737 W.I.C. program recipients, such as a charity or consumer group;
3838 (B) one representative of an advocacy group for
3939 food stamp recipients, such as a charity or consumer group;
4040 (C) one representative of staff at W.I.C. program
4141 clinics;
4242 (D) one representative of a health and human
4343 services agency who is a subject matter expert on the W.I.C.
4444 program; and
4545 (E) one representative of a health and human
4646 services agency who is a subject matter expert on the food stamp
4747 program.
4848 (d) An advisory committee member is not entitled to
4949 reimbursement of expenses or to compensation.
5050 (e) The advisory committee shall meet within 30 days after
5151 the date the initial appointments have been made and shall select a
5252 presiding officer. The committee shall meet regularly as
5353 necessary.
5454 (f) The advisory committee shall:
5555 (1) study the costs and benefits of incorporating food
5656 stamp and W.I.C. program benefits at farmers markets for the
5757 purchase of fresh, local produce;
5858 (2) determine the feasibility and cost of providing
5959 handheld scanners to farmers market vendors to accept electronic
6060 benefits transfer (EBT) cards;
6161 (3) determine methods of marketing and outreach to
6262 farmers market vendors and food stamp and W.I.C. program
6363 participants to encourage the use of food stamps and W.I.C. program
6464 benefits to purchase fresh, local produce from farmers markets;
6565 (4) study methods of funding the transition to farmers
6666 market participation in the food stamp and W.I.C. programs,
6767 including federal, state, and private funding; and
6868 (5) perform other advisory duties as requested by the
6969 executive commissioner of the Health and Human Services Commission
7070 or the commissioner of the Department of Agriculture regarding the
7171 acceptance of food stamps and W.I.C. program benefits at farmers
7272 markets.
7373 (g) The Department of Agriculture shall provide
7474 administrative support, including staff, for the advisory
7575 committee.
7676 (h) Not later than September 1, 2010, the advisory committee
7777 shall submit to the legislature a report outlining the costs,
7878 benefits, and feasibility of incorporating food stamp and W.I.C.
7979 program benefits at farmers markets to purchase fresh, local
8080 produce.
8181 SECTION 2. INAPPLICABILITY OF CERTAIN LAW. Chapter 2110,
8282 Government Code, does not apply to the advisory committee
8383 established under this Act.
8484 SECTION 3. EXPIRATION. The advisory committee established
8585 under this Act is abolished and this Act expires September 1, 2011.
8686 SECTION 4. EFFECTIVE DATE. This Act takes effect
8787 immediately if it receives a vote of two-thirds of all the members
8888 elected to each house, as provided by Section 39, Article III, Texas
8989 Constitution. If this Act does not receive the vote necessary for
9090 immediate effect, this Act takes effect September 1, 2009.
