| 7 | 7 | | support services agencies for tuberculosis. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subsection (b), Section 142.012, Health and |
|---|
| 10 | 10 | | Safety Code, is amended to read as follows: |
|---|
| 11 | 11 | | (b) Department rules must [The board by rule shall] set |
|---|
| 12 | 12 | | minimum standards for home and community support services agencies |
|---|
| 13 | 13 | | licensed under this chapter that relate to: |
|---|
| 14 | 14 | | (1) qualifications for professional and |
|---|
| 15 | 15 | | nonprofessional personnel, including volunteers; |
|---|
| 16 | 16 | | (2) supervision of professional and nonprofessional |
|---|
| 17 | 17 | | personnel, including volunteers; |
|---|
| 18 | 18 | | (3) the implementation, for professional and |
|---|
| 19 | 19 | | nonprofessional personnel, including volunteers, who have direct |
|---|
| 20 | 20 | | contact with the agency's clients, of a tuberculosis surveillance |
|---|
| 21 | 21 | | program, based on the most current guidelines for preventing the |
|---|
| 22 | 22 | | transmission of Mycobacterium tuberculosis in health care |
|---|
| 23 | 23 | | facilities published by the Centers for Disease Control and |
|---|
| 24 | 24 | | Prevention of the United States Public Health Service; |
|---|
| 25 | 25 | | (4) the provision and coordination of treatment and |
|---|
| 26 | 26 | | services, including support and bereavement services, as |
|---|
| 27 | 27 | | appropriate; |
|---|
| 28 | 28 | | (5) [(4)] the management, ownership, and |
|---|
| 29 | 29 | | organizational structure, including lines of authority and |
|---|
| 30 | 30 | | delegation of responsibility and, as appropriate, the composition |
|---|
| 31 | 31 | | of an interdisciplinary team; |
|---|
| 32 | 32 | | (6) [(5)] clinical and business records; |
|---|
| 33 | 33 | | (7) [(6)] financial ability to carry out the functions |
|---|
| 34 | 34 | | as proposed; |
|---|
| 35 | 35 | | (8) [(7)] safety, fire prevention, and sanitary |
|---|
| 36 | 36 | | standards for residential units and inpatient units; and |
|---|
| 37 | 37 | | (9) [(8)] any other aspects of home health, hospice, |
|---|
| 38 | 38 | | or personal assistance services as necessary to protect the public. |
|---|
| 39 | 39 | | SECTION 2. The executive commissioner of the Health and |
|---|
| 40 | 40 | | Human Services Commission shall adopt rules required by Subsection |
|---|
| 41 | 41 | | (b), Section 142.012, Health and Safety Code, as amended by this |
|---|
| 42 | 42 | | Act, not later than January 1, 2010. |
|---|
| 43 | 43 | | SECTION 3. This Act takes effect September 1, 2009. |
