66 AN ACT
77 relating to nonpayment of hospitals under the state Medicaid
88 program for certain preventable adverse conditions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1111 is amended by adding Section 32.02805 to read as follows:
1212 Sec. 32.02805. NONPAYMENT OF HOSPITALS FOR PREVENTABLE
1313 ADVERSE CONDITIONS. (a) The department in its adoption of
1414 reasonable rules and standards governing the determination of rates
1515 paid for inpatient hospital services on a prospective payment basis
1616 shall assure that a hospital may not receive additional payment
1717 associated with any of the following preventable adverse conditions
1818 if acquired by a recipient of medical assistance during the
1919 recipient's hospitalization:
2020 (1) a foreign object retained after surgery;
2121 (2) intravascular air embolism;
2222 (3) blood or blood product incompatibility;
2323 (4) a stage three or four pressure ulcer;
2424 (5) a fall or trauma resulting in a fracture,
2525 dislocation, intracranial injury, or crushing injury;
2626 (6) a burn or electric shock;
2727 (7) a catheter-associated urinary tract infection;
2828 (8) a vascular catheter-associated infection;
2929 (9) a manifestation of poor glycemic control,
3030 including diabetic ketoacidosis, nonketotic hyperosmolar coma,
3131 hypoglycemic coma, secondary diabetes with ketoacidosis, and
3232 secondary diabetes with hyperosmolarity;
3333 (10) a surgical site infection or mediastinitis
3434 following a coronary artery bypass graft;
3535 (11) a surgical site infection following certain
3636 orthopedic procedures of the spine, neck, shoulder, or elbow;
3737 (12) a surgical site infection following bariatric
3838 surgery for obesity, including laparoscopic gastric bypass
3939 surgery, gastroenterostomy, and laparoscopic gastric restrictive
4040 surgery; and
4141 (13) deep vein thrombosis and pulmonary embolism
4242 following certain orthopedic procedures, including total knee
4343 replacement or hip replacement.
4444 (b) The department's nonpayment of a hospital under this
4545 section does not in itself create civil liability and is not subject
4646 to discovery or admissible in any civil action against the
4747 hospital.
4848 (c) The Health and Human Services Commission shall compile
4949 information regarding the denial of payment to hospitals under this
5050 section.
5151 (d) The Health and Human Services Commission shall make
5252 statistical information derived from the data compiled under
5353 Subsection (c) readily available in a user-friendly format on the
5454 commission's website.
5555 (e) The Health and Human Services Commission may not provide
5656 information under Subsection (d) in a manner that identifies a
5757 recipient of medical assistance.
5858 SECTION 2. Not later than November 1, 2009, the executive
5959 commissioner of the Health and Human Services Commission shall
6060 adopt rules necessary to implement Section 32.02805, Human
6161 Resources Code, as added by this Act.
6262 SECTION 3. Section 32.02805, Human Resources Code, as added
6363 by this Act, applies only to a preventable adverse condition
6464 occurring on or after the effective date of the rules adopted by the
6565 executive commissioner of the Health and Human Services Commission
6666 under Section 2 of this Act.
6767 SECTION 4. If before implementing any provision of this Act
6868 a state agency determines that a waiver or authorization from a
6969 federal agency is necessary for implementation of that provision,
7070 the agency affected by the provision shall request the waiver or
7171 authorization and may delay implementing that provision until the
7272 waiver or authorization is granted.
7373 SECTION 5. This Act takes effect September 1, 2009.
