| 10 | 10 | SECTION 1. Section 47.03(b), Penal Code, is amended to read | |

| 12 | 12 | (b) An offense under this section is a felony of the third | |
| 13 | 13 | degree [Class A misdemeanor]. | |
| 14 | 14 | SECTION 2. Section 47.04(c), Penal Code, is amended to read | |
| 15 | 15 | as follows: | |
| 16 | 16 | (c) An offense under this section is a felony of the third | |
| 17 | 17 | degree [Class A misdemeanor]. | |
| 18 | 18 | SECTION 3. The change in law made by this Act applies only | |
| 19 | 19 | to an offense committed on or after the effective date of this Act. | |
| 20 | 20 | An offense committed before the effective date of this Act is | |
| 21 | 21 | covered by the law in effect when the offense was committed, and the | |
| 22 | 22 | former law is continued in effect for that purpose. For purposes of | |
| 23 | 23 | this section, an offense was committed before the effective date of | |
| 24 | 24 | this Act if any element of the offense was committed before that | |
| 25 | 25 | date. | |
| 26 | 26 | SECTION 4. This Act takes effect September 1, 2009. |
