77 relating to eligibility for unemployment compensation benefits
88 based on the claimant's availability to do part-time work.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 207.021, Labor Code, is amended by
1111 adding Subsection (d) to read as follows:
1212 (d) An individual is available for work for purposes of
1313 Subsection (a)(4) even if the individual is available only for
1414 part-time work if:
1515 (1) the individual establishes to the satisfaction of
1616 the commission that the individual has a legitimate reason to limit
1717 the individual's employment to part-time work; and
1818 (2) the individual's last work was part-time work.
1919 SECTION 2. Section 207.021(d), Labor Code, as added by this
2020 Act, applies only to eligibility for unemployment compensation
2121 benefits based on a claim that is filed with the Texas Workforce
2222 Commission on or after the effective date of this Act. A claim
2323 filed before the effective date of this Act is governed by the law
2424 in effect on the date the claim was filed, and the former law is
2525 continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2009.
