9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 207.021, Labor Code, is amended by | |
11 | 11 | adding Subsection (d) to read as follows: | |
12 | 12 | (d) An individual is available for work for purposes of | |
13 | 13 | Subsection (a)(4) even if the individual is available only for | |
14 | 14 | part-time work if: | |
15 | 15 | (1) the individual establishes to the satisfaction of | |
16 | 16 | the commission that the individual has a legitimate reason to limit | |
17 | 17 | the individual's employment to part-time work; and | |
18 | 18 | (2) the individual's last work was part-time work. | |
19 | 19 | SECTION 2. Section 207.021(d), Labor Code, as added by this | |
20 | 20 | Act, applies only to eligibility for unemployment compensation | |
21 | 21 | benefits based on a claim that is filed with the Texas Workforce | |
22 | 22 | Commission on or after the effective date of this Act. A claim | |
23 | 23 | filed before the effective date of this Act is governed by the law | |
24 | 24 | in effect on the date the claim was filed, and the former law is | |
25 | 25 | continued in effect for that purpose. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
