9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 36.052, Utilities Code, is amended to | |
11 | 11 | read as follows: | |
12 | 12 | Sec. 36.052. ESTABLISHING REASONABLE RETURN. In | |
13 | 13 | establishing a reasonable return on invested capital, the | |
14 | 14 | regulatory authority shall consider applicable factors, including: | |
15 | 15 | (1) the efforts and achievements of the utility in | |
16 | 16 | conserving resources; | |
17 | 17 | (2) the quality of the utility's services; | |
18 | 18 | (3) the efficiency of the utility's operations; [and] | |
19 | 19 | (4) the quality of the utility's management; | |
20 | 20 | (5) the utility's effective use of competitive | |
21 | 21 | procurement methods; and | |
22 | 22 | (6) the utility's good faith effort to use | |
23 | 23 | historically underutilized businesses. | |
24 | 24 | SECTION 2. The change in law made by this Act applies only | |
25 | 25 | to a final order establishing an electric utility's rates that is | |
26 | 26 | issued by the Public Utility Commission of Texas on or after the | |
27 | 27 | effective date of this Act. A final order issued before the | |
28 | 28 | effective date of this Act is governed by the law in effect when the | |
29 | 29 | order was issued, and the former law is continued in effect for that | |
30 | 30 | purpose. | |
31 | 31 | SECTION 3. This Act takes effect September 1, 2009. |
