55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the factors the Public Utility Commission of Texas must
88 consider in determining an electric utility's rate of return.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 36.052, Utilities Code, is amended to
1111 read as follows:
1212 Sec. 36.052. ESTABLISHING REASONABLE RETURN. In
1313 establishing a reasonable return on invested capital, the
1414 regulatory authority shall consider applicable factors, including:
1515 (1) the efforts and achievements of the utility in
1616 conserving resources;
1717 (2) the quality of the utility's services;
1818 (3) the efficiency of the utility's operations; [and]
1919 (4) the quality of the utility's management;
2020 (5) the utility's effective use of competitive
2121 procurement methods; and
2222 (6) the utility's good faith effort to use
2323 historically underutilized businesses.
2424 SECTION 2. The change in law made by this Act applies only
2525 to a final order establishing an electric utility's rates that is
2626 issued by the Public Utility Commission of Texas on or after the
2727 effective date of this Act. A final order issued before the
2828 effective date of this Act is governed by the law in effect when the
2929 order was issued, and the former law is continued in effect for that
3030 purpose.
3131 SECTION 3. This Act takes effect September 1, 2009.
