1010 A BILL TO BE ENTITLED
1111 AN ACT
1212 relating to professional staff salaries paid by school districts
1313 that establish a local minimum hiring schedule.
1414 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1515 SECTION 1. Subchapter I, Chapter 21, Education Code, is
1616 amended by adding Section 21.4021 to read as follows:
1717 Sec. 21.4021. SALARIES IN DISTRICTS ESTABLISHING LOCAL
1818 MINIMUM HIRING SCHEDULE. (a) This section applies only to a
1919 school district that establishes a local minimum hiring schedule
2020 that prescribes the minimum salary, based on the employee's level
2121 of experience, that the district will pay a new employee, without
2222 prescribing a minimum salary applicable to subsequent years of that
2323 employee's employment with the district.
2424 (b) A school district to which this section applies that
2525 pays each classroom teacher, full-time librarian, full-time
2626 counselor certified under Subchapter B, or full-time nurse a
2727 greater amount than the minimum monthly salary to which the
2828 employee is entitled under Section 21.402 is not required by this
2929 code to provide annual pay increases based on the employee's level
3030 of experience.
3131 (c) If the minimum salaries prescribed by Section 21.402 are
3232 increased and the state provides additional funding for the amount
3333 of that increase, a school district to which this section applies is
3434 not required to pay an employee more than the sum of the additional
3535 funding per employee provided by the state and the employee's
3636 salary for the school year immediately preceding the school year
3737 for which the additional state funding is provided.
3838 (d) To the extent of any conflict between Section 21.402 and
3939 this section, Section 21.402 prevails.
4040 SECTION 2. This Act applies beginning with the 2009-2010
4141 school year.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2009.
