8 | 8 | community-based services providers provide services. | |
9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter D, Chapter 161, Human Resources Code, | |
11 | 11 | is amended by adding Section 161.076 to read as follows: | |
12 | 12 | Sec. 161.076. ON-SITE SURVEYS OF CERTAIN PROVIDERS. At | |
13 | 13 | least every 12 months, the department shall conduct an on-site | |
14 | 14 | survey in each group or foster home at which a home and | |
15 | 15 | community-based services provider provides services. The | |
16 | 16 | department shall conduct the survey in a manner consistent with | |
17 | 17 | surveys conducted by the department under Section 142.009, Health | |
18 | 18 | and Safety Code. | |
19 | 19 | SECTION 2. If before implementing any provision of this Act | |
20 | 20 | a state agency determines that a waiver or authorization from a | |
21 | 21 | federal agency is necessary for implementation of that provision, | |
22 | 22 | the agency affected by the provision shall request the waiver or | |
23 | 23 | authorization and may delay implementing that provision until the | |
24 | 24 | waiver or authorization is granted. | |
25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
