| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Sections 223.201(f) and (i), Transportation |
|---|
| 13 | 13 | | Code, are amended to read as follows: |
|---|
| 14 | 14 | | (f) Except as provided by Subsections (h) and (i), the |
|---|
| 15 | 15 | | authority to enter into comprehensive development agreements |
|---|
| 16 | 16 | | provided by this section expires on August 31, 2013 [2009]. |
|---|
| 17 | 17 | | (i) The authority to enter into a comprehensive development |
|---|
| 18 | 18 | | agreement for a project exempted from Subsection (f) or Section |
|---|
| 19 | 19 | | 223.210(b) expires August 31, 2015 [2011]. |

| 20 | 20 | | SECTION 2. Sections 370.305(d) and (f), Transportation |
|---|
| 21 | 21 | | Code, are amended to read as follows: |

| 22 | 22 | | (d) Except as provided by Subsections (e) and (f), the |
|---|
| 23 | 23 | | authority to enter into comprehensive development agreements under |
|---|
| 24 | 24 | | this section expires on August 31, 2013 [2009]. |

| 25 | 25 | | (f) The authority to enter into a comprehensive development |

| 30 | 30 | | SECTION 4. This Act takes effect only if Senate Bill No. 17 |

| 31 | 31 | | or another similar bill of the 81st Legislature, Regular Session, |

| 32 | 32 | | 2009, relating to the design, development, financing, |

| 33 | 33 | | construction, and operation of certain toll projects, including the |

| 35 | 35 | | entities, becomes law. If Senate Bill No. 17 or another similar |
|---|
| 36 | 36 | | bill of the 81st Legislature, Regular Session, 2009, relating to |
|---|
| 37 | 37 | | the design, development, financing, construction, and operation of |
|---|
| 38 | 38 | | certain toll projects, including the determination of the primacy |
|---|
| 39 | 39 | | process for local toll project entities, does not become law, this |
|---|
| 40 | 40 | | Act has no effect. |
