5	5	relating to the statute of limitations for a misdemeanor.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Article 12.02, Code of Criminal Procedure, is
8	8	amended to read as follows:
9	9	Art. 12.02. MISDEMEANORS. (a) An indictment or
10	10	information for any Class A or Class B misdemeanor may be presented
11	11	within two years from the date of the commission of the offense, and
12	12	not afterward.
13	13	(b) A complaint or information for any Class C misdemeanor
14	14	may be presented within two years from the date of the commission of
15	15	the offense, and not afterward.
16	16	SECTION 2. The change in law made by Article 12.02, Code of
17	17	Criminal Procedure, as amended by this Act, does not apply to an
18	18	offense if the prosecution of that offense became barred by
19	19	limitation before the effective date of this Act. The prosecution
20	20	of that offense remains barred as if this Act had not taken effect.
21	21	SECTION 3. This Act takes effect September 1, 2009.
