55 relating to the statute of limitations for a misdemeanor.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Article 12.02, Code of Criminal Procedure, is
88 amended to read as follows:
99 Art. 12.02. MISDEMEANORS. (a) An indictment or
1010 information for any Class A or Class B misdemeanor may be presented
1111 within two years from the date of the commission of the offense, and
1212 not afterward.
1313 (b) A complaint or information for any Class C misdemeanor
1414 may be presented within two years from the date of the commission of
1515 the offense, and not afterward.
1616 SECTION 2. The change in law made by Article 12.02, Code of
1717 Criminal Procedure, as amended by this Act, does not apply to an
1818 offense if the prosecution of that offense became barred by
1919 limitation before the effective date of this Act. The prosecution
2020 of that offense remains barred as if this Act had not taken effect.
2121 SECTION 3. This Act takes effect September 1, 2009.
